RESOLUTION GIVING NOTICE OF HEARING ON PETITION
TO ABANDON A I'LJI3LIC UTILITY EASE~YIENT
IN LOT 13, COUNTRY ESTATES SUBDIVISION
WHEREAS, this Board has received a petition from five or mare free-holders,
requesting the abandonment of a public utility easement as described below, and at least one of
the petitioners is a resident of the township in which said public utility easement is situated; and
WHEREAS, pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and
Highways Code, commencing with Section 8320, this Board shall set a date, hour and place for a
hearing on the petition for abandonment.
NOW, THEREFORE, BE IT RESOLVED by the Board cif Supervisors:
1. "hhat this Board hereby gives notice that at its regular meeting on
October 12 1999, at 10:00 a.m. in the Board Chambers, Butte County
Administration Building, 25 County Center Drive, Oroville, California, a hearing shall be held to
hear all persons interested in the abandonment of that certain public utility easement located in
the unincorporated area of the C'olulty of Butte, State of California, in the Chico area, in the
Country Estates Subdivision, identified as a portion of Assessar's Parcel Number 042-310-013
and is more particularly described as follows:
A portion of L.ot 13 as shown on C'OUN"hRY ESTATES SUBDIVISION which map was
filed in the Office of the Recorder of the County of Butte, State of California on January
29, 1957, in Baok 22 of Maps at Pages 22 & 23, and also being a portion of Lot 52 oC the
Third Subdivision of the John Bidwell Rancho, Butte County, California and being more
particularly described as follows;
Being a public utility easement 8.00 feet in width, lying Easterly ofland parallel with and
contiguous to the most Westerly Lot line of said Lot 13.
Excepting therefrom the existing 12-Coot Public Utility Easement conti~~uous to the North
line of said Lot 13 as shown on said map.
2. That a map showing the easement to be abandoned is on Iile in the Office of the
Butte County Department of Public Works, 7 County Center Drive. Oroville, California 9965.
3. That at the conclusion of said hearin~~ the Board intends to abandon said public
utility easement.
4. 'hhat this abandonment proceeding is being conducted pursuant to Chapter ~ of
Part 3 of Division 9 of the California Streets and Highways Code, commencing with Section
8320.
5, That this Resolution be posted and published pursuant to the provisions of
Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Codc.
