RESOLUTION ESTABLISHING COUNTY SERVICE AREA NO. 172
AUTUI!'[N PARK SUBDIVISION
WHEREAS, pursuant to Title III, Division II, Part 2, Chapter 2.2 of the Government Code
of the State of California, commencing with Section 25210.1, Evelyn C. Liptrap has petitioned the Local
Agency Formation Commission {LAFCO) for the formation of County Service Area No. 1?2; and
WHEREAS, on the 5th day of August 1999, LAFCO adopted and passed Resolution No. 6
1999/00 making determinations and approving the formation of County Service Area No. 1 ?2 (Autumn
Park Subdivision); and
WHEREAS, said Resolution adopted and passed by LAFCo authorized the Board of Supervisors
(Board) of the County of Butte to conduct proceedings for the establishment of County Service Area No.
172 after proper public notice and hearing; and
WHEREAS, LAFCo has certified that it has reviewed and considered the North Chico Specific
Plan Certified Environmental Impact Report prepared by the County of Butte and referenced by the County
of Butte in approving the proposed subdivision which does not identify any significant impacts associated
with the subdivision or subsequent formation of the county service area, and there are no sufficient grounds
to require supplementing the environmental documents prepared by the County of Butte.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE
COUNTY OF BUTTE, STATE OF CALIFORNIA, as follows:
1. Said Board hereby finds and determines that the proceedings herein were conducted pursuant
to Section 25210.1 et seq. of the Government Code.
2. The Board hereby determines to establish said County Service Area No. 1?2 after proper public
notice and hearing.
3. Said Board has certified that it has reviewed and considered the North Chico Specific Plan
Certified Environmental Impact Report prepared by the County of Butte and referenced by the County of
Butte in approving the proposed subdivision which does not identify any significant impacts associated
with the subdivision or subsequent formation of the county service area, and there are no sufficient grounds
to require supplementing the environmental documents prepared by the County of Butte.
4. The formation of County Service Area No. 1?2 is for maintenance of storm drain facilities, fire
protection facilities, landscaping and street lighting for the approved residential subdivision.
5. "The subject territory includes approximately 97.66 acres of private property identified as APN
047-260-138 and is assigned the following distinctive short term designation: 00-05 -Formation of County
Service Area No. 172 (Autumn Park Subdivision}.
6. The Sphere of Influence shall be coterminous with the boundary of the county service area.
7. The boundaries of said county service area are hereby finally determined and established to be
the same as shown on Exhibit "A" attached hereto and incorporated herein and made a part hereof by this
reference.
8. In accordance with the provisions of Government Code Section 25210.77a and Butte County
Code Sections 21.85 through 21.90, aper-parcel service charge shall be levied against all the parcels within
County Service Area No. 172. The initial charge for FY 1999/2000 in the amatmt of $6,071 and for
subsequent years a maximum annual service charge of $578.14 per parcel of real property is adopted by
the Board of Supervisors. Each parcel shall be assessed an individual service charge based upon benefit.
Said charge shall appear as a separate item on the tax bill and shall be collected at the same time and in
the same manner as ordinary county ad valorem taxes are collected and shall be subject to the same
penalties and the same procedure and sale in the case of delinquency as provided for such taxes. All laws
applicable to the levy, collection and enforcement of county ad valorem taxes are collected and shall be
subject to the same penalties and the same procedure and sale in the case of delinquency as provided for
such taxes. All laws applicable to the levy, collection and enforcement of County ad valorem taxes shall
be applicable to such charge, except that if real properly to which such charge relates has been transferred
or canveyed to a bona fide purchaser for value, or if a lien of a bona fide encumbrancer, for value has been
created and attached thereon, prior to the date on which the first installment of said taxes would become
delinquent, then the charge confirmed shall not result in a lien against said real property but instead shall
be transferred to the unsecured roll for collection.
9. Said County Service Area is farmed for all purposes subject only to compliance with the
requirements of Chapter 8 (commencing with Section 54900}, Part I, Division II, Title V of the
Government Code and subject to the provisions of Article 2.5 (commencing with Section 25210.21},
Chapter 2.2, Part II, Division II, Title III of the Government Code of the State of California.

All that certain real property situate in the County of Butte, State of California, described as
follows:
A portion of Sections 31 and 32, Township 23 North, Range 1 East, M.D.B. & M., more
particularly described as follows:
Beginning at the centerline intersection of Garner Lane and Pheasant Run Court, a private
street, said point also being on the easterly line of the southwest quarter of said Section 32;
(1) THENCE along the centerline of Garner Lane and said easterly line of the southwest quarter of
Section 32, South 00°00'41" East, a distance of 651.60 feet;
{2} THENCE leaving said centerline and easterly line of the southwest quarter of Section 32,
South 89°42'01" West, a distance of 4,157.91 feet to a paint on the easterly right-of-way line of
California State Highway 99E;
{3) THENCE along said easterly right-of-way line, North 27°06'10" West, a distance of 277.04 feet;
(4) THENCE leaving said easterly right-of-way line, North 63°19'53" East, a distance of 367.87
feet;
{5) THENCE North 26°10'00" West, a distance of 185.43 feet;
(6) THENCE South 62°16'40" West, a distance of 370.91 feet to a point on the easterly
right-of-way line of California State Highway 99E;
(7) THENCE along said easterly right-of-way line, North 27°06'10" West, a distance of 302.30 feet
to the beginning of a tangent curve having a radius of 618.80 feet, concave to the southwest,
with a chord bearing of North 34°35'25" West, and a chord distance of 165.97 feet;
(8} THENCE continuing along said easterly right-of-way line and northwesterly along said curve,
through a central angle of 15°24'50", and arc distance of 166.47 feet;
{9) THENCE continuing along said easterly right-of-way line, North 42°17'50" West, a distance of
216.97 feet;

intersection of Garner Lane and Pheasant Run Caurt, a private street, and the Point of
Beginning;
The above-described parcel, containing 97.66 acres more or less, is a portion of Assessor's
