SIIASTA UNION DRAINAGE
WHEREAS, pursuant to 't'itle III, Division II, Part 2, Chapter 2.2 of the Government Code oi~ the
State of California, commencing with Section 25210.1, Ritchie Construction, Inc. has petitioned the Butte
Local Agency Formation Commission ("LA1~CU"} for the annexation of the Stratford [atates Subdivision,
Phase I, to County Service Area No. 25 (Shasta Union Drainage); and
WI-IEREAS, on .tune 3, 1999, LAFCO adopted and passed Resolution No. 28 1998!99 making
determinations and approving the annexation of the Stratford Estates Subdivision, Phase I, to County
Service Area No. 25; and
WHEREAS, the LAFC"o has certified that it has independently reviewed, analysed, and considered
the Negative Declaration with mitigation measures prior to making its decision on the project, and t~1e
Mitigated Negative Declaration retleets the independent judgement of t1AFCo; and
WHERF,AS, said Resolution adopted and passed by LAFCo authorised the Board of~Supervisors
ofthe ('ounty ol~Buttc to conduct proceedings for the annexation to County Scrvicc Area Nu. 23 without
notice and hearing and the Board may proceed in such manner pursuant to Government Code. Section
25210.14.
NOW, THEREFORE, BE IT RF,SOLVED BY THE BOARD OF SUPERVISORS OF THE
COUNTY OF BUTTE, STATE OF CALIFORNIA, as follows:
1. Said Board hereby finds and determines chat the proceedings herein were conducted pursuant
to Section 25210.1 ct..eer/. of the Government Code.

3. The subject area includes approximately 4.5 acres of private propet~ty and is identified as APN
042-450-003.
4. 'The boundaries of the annexation to said County Service Area No. 25 are hereby determined
and established to be the same as shown on Exhibit "A" attached hereto and incorporated herein and made
a part hereof by this reference.
5. The subject annexation is assigned the following short form designation: 99-16 -Annexation
to County Scrvicc Area Nn. 25 (Shasta Union Drainagc)~
6. 'l~hc reason fur the annexation to County Service Area No. 25 {Shasta Union l)rainagc) is to
utilize district drainage facilities as a condition of~subdivision approval for residential dc;~~°clopmcnt of~thc
property.
?. The single parcel identified in this annexation will be detached li-om County Service Area No.
1 l4 (Chico Urban Area Nitrate) as the stormwater drainage and sewer planning tunction of this County
Service Area will be assumed by the City of Chico.
8. The single parcel identified in this annexation will remain in Cc'n-nty Scrvicc Area Nu. 24

~?. In accordance with the provisions ofGovernment Code Section 25210.77(x} and Butte County
('ode Sections 21.85 through 21.90, aper-parcel service charge shall be levied against all the parcels within
County Scrvicc Area No. 25. hash parcel shall be assessed are individual service charge based upon
benefit. Said charge shall appear as a separate item on the tax bill and shall be collected at the same tithe
and i-1 the same manner as ordinary County ad valorem taxes are collected and shall be subject to the same
penalties and the same p--ocedure and sale in the case of delinquency as provided for such taxes, All laws
applicable to the levy, collection and enforcement of C'o~mty ad valore-n taxes are collected and shall be
subject to the same penalties and the same procedure and sale in the case of delinquency as provided for
such taxes. All laws applic~ible to the levy, collectian and enforcement of County ad valorem taxes shall
be applicable to such charge, except that if real property to ~~~hich such charge relates has been transferred
or conveyed to a bona lids purchaser for value, or if a lien of a bona fide encumbrance for ~~~alue has bc;cn
created and attached thereon, prior to the date on which the first installment. of said taxes i~~ould become
delinquent, then the charge confirmed shall not result in a lie-1 against said real property but instead shall
be U~ansferred to the a-lsecured roll for collection.
10. Currently, there is no additional charge to fund the drainage services ~~-ithin County Scrvicc
Area No. 25. Any new andior increased charges would need to be processed in accordance ~~rith the
provisions of Proposition 218.

ANNEXATION TO COUNTY SERVICE AREA N0.25
STRATFORD ESTATES SUBDIVISION, PHASE I
All that certain real property situate in the City of Chico, County of Butte, State of California,
described as follows:
Being Parcel 3 as said Parcel is shown on that certain Parcel Map filed for record in the Office of
the County Recorder of the County of Butte, State of California, in Book 48 of Parcel Maps, at
page 83, and a portion of Cussick Avenue right of way, more particularly described as follows:
COMMENCING at the intersection of the centerline of Renshaw Avenue and the centerline of
Cussick Avenue;
a THENCE along the centerline of said Cussick Avenue South 37° 33' 28" East a distance of
345.04 feet to the TRUE POINT OF BEGINNING for the parcel herein described;
0 THENCE from said TRUE POINT OF BEGINNING, leaving said centerline of Cussick
Avenue North 52° 27' 41" East a distance of 30.00 feet, along the northeasterly
prolongation of the northwesterly line of said Parcel 3, to a paint on the northeasterly right
of way line of Cusick Avenue and a point on the existing boundary of the Shasta Union
Drainage Assessment District as described in Butte County Board of Supervisor's
Resolution Number 65-138, dated December 28, 1965;
THENCE South 37° 33' 28" East a distance of 315.08 feet along said northeasterly right of
way line of Cusick Avenue and the existing boundary of the Shasta Union Drainage
Assessment District;
