HomeMy WebLinkAbout99-149WHEREAS, Senate Bill 468 added Section 1522.06 to the California Health and Safety Code, authorizing local law enforcement officials to provide criminal history information, obtained by either a name check via the California Law Enforcement Telecommunications System (CLE~hS) network or via a ]ive-scan fingerprinting device, to any child welfare agency for the purpose of assessing any relative agreeing to receive and care for a minor and all other adults living in the relative's residence, before the minor is placed with the relative; and WHEREAS, law enforcement agencies shall cooperate with requests for criminal history information and shall provide such information to the requesting county child welfare agency in a timely manner; and WHEREAS, any person authorized to receive the information who obtains the information in the record and knowingly provides the information to a person who is not authorized by law to receive the information is guilty of a misdemeanor as specified in Section 11142 of the California Penal Code; and WHEREAS, the County Board of Supervisors must first adopt a resolution authorizing any county child welfare agency access to criminal history information. NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of Supervisors as follows: That the Butte County Department of Social Welfare, Children's Services Division, may secure from municipal, county or state law enforcement personnel a criminal record throu;h the CLETS network or an automated Live-Scan system for the purpose of assessing any relative agreeing to receive and care for a minor and all other adults living in the relative's residence, before the minor is placed with the relative; and That this resolution shall remain in full force and effect until a resolution of Che Butte County Board of Supervisors is adopted amending or rescinding this resolution.
