RESOLUTION OF APPLICATION
BY THE BOARD OF S[JPERVISORS OF THE COUNTY OF BUlhTE
REQUEST[NG TIIE LOCAL. AGENCY FORMATION COMMISSION TO rI'AKE PROCEEDINGS
FOR THE FORMATION OF THE BUTTE COUNTY RESOURCE CONSERVATION DISTRICT
WHEREAS, the Board of Supervisors of the County of Butte desires to initiate Proceedings pursuant
to the Cortese-Knox Local Government Reorganization Act of 198.5, commencing with s~'~s6000 of the
California Government Code, for the formation of a resource conservation district, to be known as the Butte
County Resource Conservatian District ("the District") pLU~suant to Chapter ~ of Division 9 of the Public
Resources Code, commencing with y91.51; ~u~d
WHEREAS, notice ol~ intention to hold a public hearing to consider adoption of this resolution has
been published pursuant to the reduirements of Public Resources Code X91(7 (b} and Government Code
~s,'6061, and said public hearing has been duly held; and
WHEREAS, the boundaries of the proposed District shall be the boundaries oC the County of Butte,
includin~~ all the unincorporated areas therein, but excluding all the ten-itory within the Vina Resource
Conservation District and all incorporated areas; and
WHEREAS, the sphere of influence of the District shall be coterminous with the boundaries of the
District and the District will provide services of a type not now provided or contemplated to be provided by
other governmental entities; and
WHEREAS, the formation of the District will be consistent with the General Plan of the County of
Butte, including but not limited to, the Conservation Element, the Agricultural Element and the Safety
Element; and

WHEREAS, the proposeU District shall waive any claim to current or future property tax revenues
collected by the County of Butte; and
WHEREAS, this Board, in the public interest, will request that the Butic County Local Agency
Formation Commission ("LAFCo")waive application fees, and the District is proposed to be financed with
a $6,Oti0 start-up fund to be provided by the County of Butte, will have unpaid Directors and Associate
Directors, will initially rely upon unpaid volunteer staff, and expenses related to District formation, including
the State Board of Equalisation fee, will, to the extent possible, be paid with revenues donates! by members
of the public and other entities; and
WHEREAS, the reasons for forming the District are to obtain grants and other funding from public
and private sources to bring money and resources into Butte County to be made available on a voluntary
basis to individual property owners and other entities for addressing conservation issues including, but not
limited to: soil and water conservation, the control ofrunofl~, the prevention and control of soil erosion, and
erosion stabilization, including, but not limited to, these purposes in open areas, agricultural areas, urban
development, wildlife areas, recreational developments, watershed management, including but not limited
to fuel mana~~~ment, the protection of water quality and water reclamation, the development of storage and
distribution of water, and the treau7~enl of each acre ol~ land according to its needs; and
WHEREAS, die board of directors of the District shall consist of live (5) directors, one from each
supervisorial district, and four (4) non-voting associate directors, two (2) of wham shall represent the
western area of the county and two (2) of whom shall represent the eastern area of the county.
NOW, THEREFORE, BE IT RESOLVED, that:
1. This Resolution of Application is hey°eby adopted and approved by the Board of Supervisors of the
County of Butte, and LAFCo is hereby requested to take proceedings for the formation of the Butte County
Resource Conservation District, according to the terms and conditions stated above and in the manner
provided by the Cortese-Knox Local Government Reorganization Act of 198>, as amended.
2. The Chief Administrative Officer of the County of Butte, or his designee, is authorized and directed to

do all things necessary and desira~nle to complete the application to LAFCo and to submit this Resolution
to LAFCo, together with any and all required application forms and related documents.
3. The Butte County Resource Conservation District Trust Fund shall be and is hereby established to accept
donations from members of the public and other entities to assist in financing the formation and on-going
operations of the District.
4. LAFCo is requested, in the public interest, and in consideration of the fact that no budgeted county funds
are available to pay LAFCo fees, to waive any and all LAFCo fees in connection with the said application
and the processing thereof. Provided, however, that to the extent possible, actual expenses incu~7-ed by
LAFCo in processing the application shall be paid from The Butte County Resource Conservation District
Trust Fund.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of
CalifoT~r~ia, on the 9th day of November 1999 by the following votes:
