Said Board hereby finds and determines that the proceedings herein were conducted pursuant to Section 2521{).1 c't..ti~ec~. ol~ihe Governl~~ent Code. 2. The Board hereby determines to annex the Engelbert!Magnuson Subdivision to said County Service Area No. 2 ~ (Pleasant Valley Drainage) without notice and hearing. 3. The subject area includes approximately 6.8 acres identified as APN 045-750-010. 4. The boundaries of the annexation to said County Service Area No. 23 arc hereby finally determined and established to be the same as shoEV~l on Exhibit "A" attached hereto and incorporated herein and made a part hereof by this reference. 5. "C'he subject annexation is assigned the lollowing short farm designation: ~)~-~0 - Aniexation to County Service Arca No. 23 (Pleasant Valley Drainage District). 6. The reason for the annexation to County Service Area No. 23 is to utilise district drainage facilities as a condition of Subdivision map approval. 7. The State Board of Equalisation ices shad be paid by the landowner. 8. [n accordance with the provisions of Government Code Scctioll 2521 U.77(a) and Butte County Codc Sections 21.85 through 21.90, apes-parcel scrvicc charge shall he levied ~i~ainst all the parcels within County Service Area No. 2~. Each parcel shall be assessed an individual sci-vice charge b~lsed upon benefit. Said charge shall appear as ~i separate item on the tax bill and shall be collected at the same time and in the same manner as ordinary County ad valorem taxes arc collected and shall be subject to the same pcnaliics and the same procedure and sale in the case oCdclinquency as provided Cos such taxes. All laws applicable to the levy, collection and enforcement oCCounty ad valorem taxes are collected and shall be subject to the same penalties and the same procedure and sale in the case ot~delinquency as provided for such taxes. All laws applicable to the levy, collection and enforcement of County ad valorem faxes shall be applicable to such charge, exeeht that il~rcal property to which such charge relates has been transferred or conveyed to a bona fide purchaser for value, or i C a lien of a bona Gde encumbrance Cor value has been created and attached thereon, prior to the date on which the first installment oC said taxes would become delinquent, then the charge confirmed shall not result in a lice against said real property but instead shall be transferred to the unsecured roll for collection. 9. Currently, there is no additional charge to Cued the drainage services within County Service Arca No. 2 ~.
