AND/OR INCREASEll ANNUAL SERVICE CHARGES IN SPEC[FIED COUNTY SERVICE
AREAS AND SE"CI'ING A PUBLIC HEARING TO CONSIDER SUCH CHARGF,S
WHERI~AS, Government Code Section 25210.77a contains authority for the County ol~ Butte to Gx
and collect service charges for a particular extended service provided through a county service area or
gone; and
~VI I~:,RI~~AS, the Board of` Supervisors did, by ordinance adopt Butte Count~• Code Section 21-8~ et
se~~.. establishing a procedure for annually levying and collecting such charges on the tat roll; and
WHEREAS. Article VIII I), Section 6 0l` the California Constitution. as adopted b}~ passage of
Proposition ? I & on November 5, 1 x)96, established procedures for levying new or increased ch~u~~~es: and
WHERI-:.~~5, a written report identifying each parcel of real property receiving a particular extended
service, and the amount of the existing maximum annual charge and the amount of the proposed new or
increased annual charge for each parcel, has been filed with the Clerk of the Board of Supervisors and
resides in the Property Tax Section of the .auditor's Office; and
WHEREAS, the Board wishes to give notice of and to hold a public hearing to consider establishing
such new r>r increased annual service charges in accordance with the procedures specified in Article X[II
U. Section 6. of the California Constitution.

'that a public hearing is set for h'ebruary 8.2000, at 10: i0 a.m. pursuant to Article 7 oI~ Chapter 2.2 0l
Division 2 of Title 3 of the Government Code (commencing with Section 25210.70}, Article VI of
Chapter ~ 1 of the Butte County Code (commencing with Section 21-85) and Article Xlll I), Section 6
of the C'alili~rnia Constitution to hear and consider all objections or protests, if any, ~uu1 thereafter, as
to those charges for which there has not been a majority protest, to adopt a resolution confirming the
repot°t, establishing the. charges in an amount not exceeding the amount set i~>rth i~7 I_:xhibit A, attached
hereto, and calling property owner ballot proceedings as necessary to approve or disapprove the
charges.
?. The Clerk ol~ the Board of Supervisors is directed to publish notice of said hearing as required h}'
Butte County Code Section 21-88 and Article XIII D, Section ~ of the California Constitution. and.
with the assistance of the Elections Department, Public Works Department, Auditor-Co~ltrullcr and
the Assessor. to provide written notice thereof by mail to the record owner of each identified parcel
upon which the new or increased charge is proposed to be levied, as said o~~~net°s are identified on the
currealt tax roll. Said written notice shall be mailed not less than forty-rive {45) days prior to the
hearing and shall include the amount of the proposed new or increased charge. the basis upon which
the amount of the proposed new or increased charge was calcul~.rted, the reason for the netic or
increased charge, and the date, time and location of` the public hearing, and shall state that the record
owner may submit a written protest against the new or increased charge to the Clerl: prior to or duri~lg
the hearing.
