On August 11, 1998, this Board adopted Resolution No. ~8-124, Resolution Approving Revisions to Engineer's Report, approi~ing revisions in the cost estimate and the property owner's list for the Drescher 'tract Assessment District, County of Butte, State of California. `I'hc construction of the road is now complete and further modification of the report is required to reflect final costs. 2. The Engineer of Work has prepared and submitted the Final Engineer's Report to reflect the total construction cost and a revised contract amount for engineering services as set forth in Exhibit 13 of the Keport. 3. `t'his Board hereby approves the Final 1?nginccr's Report as filed and directs the Clerk of the Board to file copies of this Final Report in the Clerk of the Board's office and in the office of the Director of Public lworks, together with a certified copy of this resolution. 4. This Board further authorizes payment to be made to NorthStar 1:nginccring in accordance with Exhibit I3 in the Final Itcport. BLACKLOCK, Chief Administrative Officer and Clerk of the Board of Supervisors 1 J ~, , i FINAL ENGINEER'S REPORT DRESCHER TRACT ASSESSMENT DISTRICT BUTTE CO[1NTY, CALIFORNIA NORTIISTAR ENGINEERING, Engineer of Work for Drescher Tract Assessment District makes this report, as directed by the Board of Supervisors, pursuant to Section10204 of the Streets and Highways Code (Municipal Improvement Act of 1913). The improvements, which are the subject of this report, are briefly described as follows: The widening and resurfacing of Drescher Tract Road to bring the road up to County of Butte standards for public roads, including the modification of existing drainage crossings as needed and any necessary road base. Bonds representing unpaid assessments and bearing interest at a rate not to exceed twelve percent (12%) per annum, shall be issued in the manner provided by the Improvement Bond Act of 1915 (Division 10, Streets and Highways Code), and the last installment of the bonds shall mature not to exceed (39~ years from the second day of September next succeeding twelve (I 2) months from their date, This report includes the following attached exhibits: EXHIBIT A: As-built plans and specifications of improvements which have been constructed. Plans and specifications are a part of this report whether or not separately bound. EXHIBIT B: A summary of the improvements and formation costs. EXHIBIT C: An assessment roll, showing the amount proposed to be specifically assessed against each parcel of real property within this assessment district. Each parcel is described by County Assessor's parcel number or other designation, and each parcel is also assigned a separate "assessment number" for the purposes of this proceeding. EXHIBIT D: A statement of the method by which the undersigned determined the amount proposed to be assessed against each parcel, based upon benefits to be derived by each parcel, respectively, from the improvements. The following is the breakdown of costs to form the district, prepare the construction drawings, and construct the roadway improvements. The elements of costs consisted of construction of the Roadway and associated improvements; Right-of--way acquisition; Engineering for preparation of the District documents and Plans and Specifications for the Construction Improvements; Legal Services for the formation of the Assessment District; Plan Checking and Inspection Fees to the County of Butte; and an amount attributable to the Bond Reserve. The intention of the district had been to re-construct Drescher Tract Road to County Standard, and dedicate it to the County of Butte for maintenance. Due to the difficulty encountered in acquiring all of the necessary right-of--way, several attempts at negotiation with the reticent property owners were undertaken. Two separate Construction Change orders we adopted with the express intent of reducing the construction costs to enable the district to afford payment far right-of--way acquisition. This report also details the payments made by the individual neighbors to NorthStar Engineering in order to finance the formation and engineering expenses prior to district formation. PAGE 4 OF 5 EXHIBT B The Extra Engineering work cited in Item 2 on Exhibit B page 4 of 5, includes the cost of the initiation of the district proceedings prior to the Resolution of Intention being adopted by the Board. This initial work did not include any survey, boundary resolution or Engineering design work for the ultimate construction of the project which made up the content of the original engineering contract. It did however include the following: site visits and analysis of the existing condition for estimating purposes; the compilation of the records and identification of the district participants and determination of the proposed boundaries of the district; determination of the scope of work and compilation of preliminary construction estimates; preparation and analysis of various spread methodolagy for preparation of preliminary assessment spread; consultation with Bond Counsel, County Staff, utility companies, and neighbors, in order to refine and revise scope of work of district; preparation of assessment roll and assessment diagram for the district, and the preparation of the preliminary Engineer's Report for consideration by the Board. Also during this time, another neighborhood was introduced into the district. "I'he Mission Ulive Road neighbors expressed interest in upgrading their road as well. It was anticipated that including them would reduce the per-capita formation expenses. Several meetings were held in effort to achieve support with the corresponding compilation of records and maps. This effort ultimately failed, but a great deal of time was spent on this effort. The neighbors paid for the majority of these costs. As such we are requesting contract amendments to reimburse them for their contributions. In addition, in a decision made by the neighborhood, the proceedings were structured to have the vote to form the district coincide with the timing of the contract award. This assumed a risk that the accepted contract would fall within the scope of the estimates approved by the district proceedings. The results of the construction bidding resulted in a low bid greater that the amount anticipated in the engineer's estimates. As an added complication, several of the neighbors who had stated verbally their agreement to participate in the necessary right-af--way dedication, decided, after the district was formed, to demand right-of-way compensation. Again, due to prior agreements, these compensation amounts were not considered necessary and therefore not included in the district budget. In effort to make the existing approved assessment amounts work, additional value engineering was done to eliminate certain items from the scope of work. This entailed negotiations with the neighbors and the contractor to the project; modifications to the approved plans to reduce specific items of work; preparation and acquisition of contract change orders to facilitate these reductions; and further consultations with the County Staff, Band Counsel, and the lending entity to determine the most appropriate methodolagy far securing a workable project. All of which was above and beyond the scope of the original contract. During this process and after the contract for engineering services had been adopted, an alternative to conventional financing was discovered. This alternative was a loan program offered by the Federal government. Programs such as these have stringent application requirements. This method of financing, while far better for the property owners, requires a great deal more effort to meet the application requirements and satisfy the agency than conventional financing. None of which was anticipated under the terms of the original contract. The goal of this construction was to allow the property owners to dedicate the roadway to the County of Butte for public ownership and maintenance. This serves to eliminate maintenance responsibilities, along Drescher Tract Road, of those residents party to the road maintenance agreement for said road. Additionally, it serves to eliminate damage or injury liability for accidents occurring along this public roadway. The benefit assessment spread for this project was based upon three elements of benefit. Initially, there is an overall benefit for ownership of property within the district, and the accompanying liability reduction. The assessment for this benefit derives from the value of this liability reduction as well as costs incurred in the formation of the district. "This benefit was apportioned to be 30% of the overall value of the district and constructed improvements. Secondly, there is a specific benefit based upon road frontage of individual parcels. "hhe idea is that those parcels which front along the improved roadway receive a benefit which other parcels within the district do not. It is felt that future appraisals will recognize this benefit and will reflect this benefit in property value. This benefit was apportioned to be 20% of the overall value of the district and constructed improvements. Lastly, there is a graduated benefit based upon the length of constructed roadway any particular parcel shall utilize. It is understood that the most readily realizable benefit shall be the ability to drive along the improved roadway. Those parcels nearer the northerly end of the district will not normally utilize a great deal of the roadGVay. While those parcels nearer the southerly end of the district will normally utilize the majority, if not the entirety of the constructed improvements. In light of this, an incremental assessment of benefit was derived. Two and one-half increments indicate benefit received for the use of the entire constructed roadway. Two increments indicate benefits received from use of the majority of the roadway; and one and one-half increments indicate benefits received from use of a lesser portion of the roadway. One increment indicates benefit from the use of only a small portion of the roadway. "This benefit was apportioned to be 50°l° of the overall value of the district and constructed improvements.
