HomeMy WebLinkAbout994~~~ 1 2 3 4 b 8 .7 8 9 10 11 12 l'3 14 `15 !T6 'T7 18 19 20 '21 22 23 24 2S 26 27 28 29 30 31 ORDINAi)1CE NO. 99~ AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIF0Rj)7IA, PURSUANT TO ORDINANCE NOS. 475, 522 A1VD 676 OF SAID COUNTY The Board of Supervisors of the County of Butte, State of Cali- fornia, under and pursuant to Ordinance No. 475 of said County, being the Zoning Enabling Ordinance of said County, as amended by 'Ordinance Nos. 522 and 676, do ordain as follows: SECTION 1. fihe hereinbelow described area, situate in the County of Butte, State of California, shall be .and it.is hereby zoned as an "R-1" (Single Family Residential) District and such area shall be sub3ect to the restrictions and restricted uses and regulations hereinafter specified and provided. Said area so zoned being located in the unincorporated area of Butte County, Clipper ritills, California, and particularly described as follows: Merry Mountain Village Subdivision, Units 2 & 3 as described ,by map on .file in the Office of the Butte County Planning Commission. SECTION 2. REGULATIONS FOR "R-1" DISTRICT. The following regulations shall apply in an "R-1" District: 2.1 USES PERMITTED: a: Single-family dwellings, not including tents or trailers. b. Accessory buildings pertinent to the permitted uses. c. Household pets (but not including livestock, poultry or poisonous reptiles). 2.2 LOT AREA REQUIRED: Minimum required area of a lot per dwelling unit shall be no less than eight thousand, one hundred twenty-five (8,125) square feet. 2.3 LOT WIDTH REQUIRED: Minimum lot width shall not be less than sixty-five (65) feet. 2.4 FRONT YARD REQUIRED: Minimum front yard shall be fifty (50) feet from the centerline of the road, except where the road is classified by the County as a Federal Aid Secondary Road, the mini- mum building setback requirement shall be fifty-five (55) feet from the centerline of said road. 2.5 SIDE YARD REQUIREMENT: Minimum side yard shall not be less than five (5) feet. 2.6 THE FOLLOWING USES SUBJECT TO SECURING A USE PERMiT IN EACH CASE: a. Golf courses and country clubs. b. Public and quasi-public uses including churches, fire- houses, hospitals, parks and playgrounds, Schools and publicutility buildings. SECTION 3. All uses of land within the District not specific- ally authorized and permitted in Section 2, are prohibited. SECTION 4. In compliance with the provisions of said Enabling Ordinance, the same is hereby amended by adding to Section 5 thereof this Ordinance in full. 32 '1 2 3 4 s B 7 8. 9 10 ,11 12 113 14 15 16 17 18 i19 20 21 22 23 24 23 26 27 28 29 30 31 32 SECTION 5. 'The penalties for the violation of the zoning here- by imposed within tkze District shall be as provided in the Zoning Enabling Ordinance. In compliance with the provisions of the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date become a supplement to and part of the Zoning Enabling Ordinance. SECTION 6. This Ordinance shall be and it is hereby declared to be in full force and effect from and after thirty (30) days after the date of its passage, and before the expiration of .fifteen (15} days after the date of passage this Ordinance shall be published once with the names of the members of the Hoard of Supervisors- voting for-and against it in the Oroville Mercury , a, newspaper published in the County of Butte, State of California.
