CONSENT AGENDA 3.01 Fiscal Year (FY) 2018 Homeland Security Grant Program (HSGP) Budget Adjustment and Capital Asset Purchase - The Board of Supervisors authorized the Emergency Services Officer to apply for funding under the FY 2018 HSGP on November 6, 2018.The Governor's Office of Emergency Services has approved the grant application in the amount of $300,809. The local Approval Authority Body (Butte County Health officer, the County Fire Chief, a municipal fire chief, the County Sheriff, a local chief of police) recommends that the grant funds be appropriated for the following purposes: $7,400 Security camera upgrade for Gridley Police Department $41,791 Portable radios for Chico Fire Department $48,000 Portable radios for Chico Police Department $19,600 Ballistic shields, helmets, and thermal imaging monoculars for Paradise Police Department $15,027 Grant management and administration $43,200 Automated vehicle locators for Gridley Fire and Paradise Fire CAPITAL ASSETS $41,791 Portable radios for Butte County Fire Department $16,000 Portable communications system for emergency response $68,000 Computer-aided dispatch connection between CALFIRE, the Butte County Fire Department, and the Chico Fire Department Action requested—1)APPROVE BUDGET ADJUSTMENT(4/5 VOTE REQUIRED); AND 2) APPROVE CAPITAL ASSET PURCHASES(3). (County Administration) Page 1 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA-JANUARY 8,2019 3.02 Consolidated Development Impact Fee Report for FY 2017-18 and Required Findings - Pursuant to Government Code section 66006(b),the Butte County Consolidated Development Impact Fee Report for FY 2017-18 (Report) has been available for the public in the Office of the Clerk of the Board since December 20, 2018. The Report includes both County and special district development impact fee fund information and findings. Government Code section 66001(d)sets forth the requirements of findings the Board of Supervisors must make in the fifth year following the first deposit into a fund and every fifth year thereafter regarding amounts held in that fund. Department heads and special district managers are responsible for the five year findings required for their development impact fee funds — action requested — 1) ACCEPT FOR INFORMATION; AND 2) MAKE FINDINGS AS DETAILED IN THE REPORT FOR EACH OF THE REQUIRED FUNDS AS SET FORTH IN GOVERNMENT CODE SECTION 66001(d). (County Administration) 3.03 Resolution Establishing the Deadline for Approved Alternative Fire Debris Removal Program Applications - On December 11, 2018, the Board of Supervisors adopted Ordinance No. 4151— "An Urgency Ordinance of the County of Butte—Requirements for the Removal of Fire Damaged Debris from Private Property Following the Camp Fire." The Ordinance prohibits removal of fire debris from private property that contains a qualifying structure, unless it is removed through the California Office of Emergency Services (CalOES) Program or by an entity approved through the County's Alternative Fire Debris Removal Program (Alternative Program). Section 8(A)of the Ordinance allows the Board of Supervisors to set a deadline for approved Alternative Program applications. The Chief Administrative Officer recommends the Board set the deadline for February 28, 2019, by resolution—action requested -ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. (County Administration) 3.04 Accept 2018 Local Agency Conflict of Interest Code Biennial Notice for School District that Files Form 700s with Butte County Office of Education -The Bangor Union Elementary School District has reviewed its Conflict of Interest Code pursuant to California Government Code section 87306.5(b) and has determined that the agency's code is current and in no need of revision. County Counsel has reviewed the 2018 Local Agency Biennial Notice and believes it to be proper —action requested -ACCEPT 2018 LOCAL AGENCY BIENNIAL NOTICE. (County Counsel) 3.05 Budget Adjustment to Recognize Additional State Funding Allocations to Add Six Positions- Each year, the Department of Employment and Social Services prepares a budget for its various programs based on anticipated funding allocations from the State. Since the State funding allocations are not finalized until after the Board of Supervisors approves the Recommended Budget, a budget adjustment is often required. For FY 2018-19, the Department received additional allocations totaling $1,570,265 as follows: California Work Opportunity and Responsibility to Kids (CalWORKs) will receive an additional $733,010. The CalWORKs program assists people transitioning from welfare to work by providing assistance and services to eliminate barriers to employment. The CalWORKs Housing Support Program (HSP) will receive an additional $663,000.The objective of CalWORKs HSP is to foster housing stability for families who are in the CalWORKs program and experiencing homelessness. The Emergency Child Care Bridge Program will receive an additional $174,255. The Bridge program provides time limited child care payments or vouchers to help pay child care costs for eligible families. The budget adjustment will allow the Department to add six new positions and to provide additional services —action requested -APPROVE BUDGET ADJUSTMENT(4/5 VOTE REQUIRED). (Employment and Social Services) Page 2 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA-JANUARY 8,2019 3.06 Resolution Recognizing Chief Darren Read Upon His Retirement — The Fire Department recommends the Board of Supervisors adopt a resolution recognizing Chief Darren Read upon his retirement—action requested —ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. (Fire) 3.07 Contract with Kitchell for Project Management Services for the Jail Expansion Project - The County is in the design phase of the Jail Expansion Project. Following solicitation for services,the Department of General Services and the Sheriff's Office recommend entering into a contract with the Sacramento office of Kitchell to provide constructability reviews, cost estimating services, construction submittal evaluations, and field inspections for the Jail Expansion Project.The term of contract is date of execution through June 19, 2020, not-to-exceed $300,000 — action requested - APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. (General Services / Sheriff-Coroner) 3.08 Contract with Kitchell for Project Management Services for the Evidence Storage Building and Morgue Facility Project-The County is in the design phase of the Evidence Storage Building and Morgue Facility Project. Following solicitation for services, the Department of General Services and the Sheriff's Office recommend entering into a contract with the Sacramento office of Kitchell to provide constructability reviews, cost estimating services, construction submittal evaluations, and field inspections for the Evidence Storage Building and Morgue Facility Project. The term of contract is date of execution through June 19,2020, not-to-exceed$150,000—action requested - APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. (General Services / Sheriff-Coroner) 3.09 Contract with Unique Surveillance LLC dba Fast Guard Service Corp for Security Guard Services in the 2018 Camp Fire Response-The 2018 Camp Fire response requires security guard services at a number of locations for the Emergency Operations Center (EOC) and Disaster Recovery Operations Center (DROC). The General Services Department recommends entering into a contract with Unique Surveillance LLC dba Fast Guard Service Corp for security guard services in the 2018 Camp Fire response. These guard services will be used on an as needed basis as requested through resource requests from the EOC and DROC. At the outset of the emergency response, the County first contacted respondents to the recent County RFP for guard services and other local companies, and found they could not provide the number of guards and immediate activation needed to meet the response effort.The County then contacted larger out of area guard service companies and determined Fast Guard was able to meet the needs of the response effort. In addition to Fast Guard, the County continues to use a local guard service company commensurate to their staffing capacities at other locations serving the response effort. The term of the contract is three months through February 15, 2019, not-to-exceed $10,250,000. These costs are anticipated to be reimbursable under FEMA Public Assistance Category B. FEMA has already approved an expedited expense request for 50%of these costs— action requested—1) APPROVE BUDGET ADJUSTMENT(4/5 VOTE REQUIRED); AND 2)APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. (General Services) 3.10 Resolution to Amend the Salary Ordinance-The Department of Human Resources has prepared a resolution to amend the Salary Ordinance for the following departments: DEPARTMENT OF EMPLOYMENT AND SOCIAL SERVICES: Delete 1 flexibly staffed Administrative Analyst and add 1 Supervisor,Administrative Analyst.These changes better meet the operational and supervisory needs of the Department.Add 6 Employment and Eligibility Specialist positions. These positions are funded by additional State and federal allocations. Total allocations to increase by 6.There will be no impact on the General Fund Budget. Page 3 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA-JANUARY 8,2019 PROBATION DEPARTMENT: Add 1 Evidence/Photographic Technician to better suit the current and future needs of the Department. Additional costs associated with this position will be covered by the Butte Interagency Narcotic Task Force (BINTF).Total allocations to increase by 1. There will be no impact on the General Fund Budget. SHERIFF'S OFFICE: Add 1 Public Safety Dispatcher and delete 1 Sheriff's Warrant Officer. This change will better suit the current and future needs of the Department. Total allocations to remain unchanged.This change will result in budget savings. Action requested - ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. (Human Resources) 3.11 Resolution Adopting Amended and Restated Butte County Employees' 457 Plan and Trust -The transition of the management of the Butte County 457 Deferred Compensation Plan to Nationwide Retirement Solutions is progressing as provided in the contract and agreement approved by the Board of Supervisors on December 11, 2018. The agreement with Nationwide provides for administrative and record keeping services at no cost to the County, and accrues revenues to be utilized for payment of consultant services and fiduciary insurance coverage. As part of this process, the Internal Revenue Service requires an Adopting Resolution from the Employer approving and adopting the form of amended 457 Plan and Trust.The Department of Human Resources recommends adopting a resolution for the Butte County 457(b) Deferred Compensation Plan; the Butte County Social Security Replacement Plan, as amended and restated; the Nationwide Trust Company, FSB 457 Trust Agreement; and the Summary of 457 Provisions contained in the restated Plan as provided by Nationwide Retirement Solutions, Inc. — action requested — 1) ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN; AND 2) AUTHORIZE THE DIRECTOR OF HUMAN RESOURCES TO SIGN ANY AND ALL PLAN DOCUMENTS REQUIRED TO COMPLETE THE ESTABLISHMENT OF THE BUTTE COUNTY EMPLOYEES' 457 DEFERRED COMPENSATION PLAN WITH NATIONWIDE RETIREMENT SOLUTIONS. (Human Resources) 3.12 Contract Amendment with California Association of Environmental Health Administrators (CAEHA) for Environmental Health Services Related to Camp Fire Recovery -The Public Health Department currently has a contract with CAEHA to provide environmental health services related to the Camp Fire. CAEHA provides staff to act as a coordinator and liaison with disaster mutual aid and Right of Entry oversight. CAEHA staff also assist in the collaboration and coordination between many other agencies, including California's Department of Toxic Substances,the United States Environmental Protection Agency,Governor's Office of Emergency Services, and CalRecycle. As the Camp Fire recovery continues, the need for additional hours of CAEHA staff is needed. The Department recommends amending the contract with CAEHA for environmental health services related to the recovery process of the Camp Fire.The amendment increases the maximum payable amount by$272,932, not-to-exceed $372,432. All other terms remain the same. Contract costs will be covered by Public Health Realignment and submitted for disaster reimbursed to the State—action requested —APPROVE CONTRACT AMENDMENT AND AUTHORIZE THE CHAIR TO SIGN. (Public Health) Page 4 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA—JANUARY 8,2019 3.13 Memorandum of Understanding (MOU) with Butte County Superior Court for Security Services and Budget Adjustment - The Sheriff's Office recommends entering into an MOU for Court security services with the Butte County Superior Court (Court). As the Sheriff is responsible for providing all security services, the Court agrees to pay the Sheriff's Office $481,445 in FY 2018- 19. During FY 2018-19 budget projections,the Sheriff's Office budgeted$475,691 and therefore needs to increase appropriations by$5,754. The Court will issue four equal quarterly payments to the Sheriff's Office. The term of the MOU is July 1, 2018 through June 30, 2019 — action requested—1)APPROVE THE MEMORANDUM OF UNDERSTANDING AND AUTHORIZE THE CHAIR TO SIGN; AND 2) APPROVE BUDGET ADJUSTMENT (4/5 VOTE REQUIRED). (Sheriff-Coroner) 3.14 Capital Asset Surplus -Washing Machine -The Sheriff's Office washes all inmate clothing at an on-site commercial laundry facility. One of the six commercial washing machines is obsolete and unrepairable. The broken commercial washing machine was purchased in 1995 at a cost of $11,641. The Sheriff's Office completed a Request for Proposal to replace, remove, and dispose of the broken commercial washing machine. This commercial washing machine is extremely large and heavy and cannot be moved or managed by county surplus. The Department recommends to surplus to the vendor the broken commercial washing machine — action requested-DECLARE CAPITAL ASSET SURPLUS TO THE NEEDS OF THE COUNTY. (Sheriff-Coroner) 3.15 Contract Amendment with the Consensus Building Institute for Facilitation Services in the Vina, Wyandotte Creek, and Butte Subbasins -The Department of Water and Resource Conservation recommends amending the contract with the Consensus Building Institute to facilitate the development of governance structures in the Vina, Wyandotte Creek, and Butte subbasins to implement the Sustainable Groundwater Management Act. The amendment adds facilitation services for the Butte subbasin and increases the maximum payable amount by$19,350, not-to- exceed $55,000. The contract is funded from a California Department of Water Resources Proposition 1 grant. All other terms remain the same—action requested -APPROVE CONTRACT AMENDMENT AND AUTHORIZE THE CHAIR TO SIGN. (Water and Resource Conservation) 4. Board Member/Committee Reports and Board Member Comments (Pursuant to California State law,the Board is prohibited from taking action on any item not listed on the agenda) 4.03 Update of Budget, Legislative, and Other Current Issues by the Chief Administrative Officer 4.04 Adoption of an Ordinance for the CalPERS Cost Share Amendment for DSA - The Board of Supervisors approved memorandum of understanding with the Deputy Sheriff's Association (DSA) General and Management/Supervisory bargaining units on December 6, 2016. The agreements contained a provision that employees will pay an additional percentage of pensionable compensation towards the County's share of PERS pension. Employees represented by these bargaining units will now contribute an additional 1%of pay in retirement contributions that will count towards the employer's share of contributions for their PERS retirement. Upon implementation, the County agreed to work with PERS to process a PERS contract amendment, which would credit this contribution towards the employee's account. PERS requires several steps to be completed before a contract amendment can become official.All required steps have been completed, with the exception of the final step, which is for the Board of Supervisors to adopt an Ordinance approving the PERS amendment- action requested — 1) ADOPT THE ORDINANCE AND AUTHORIZE THE CHAIR TO SIGN; AND 2) APPROVE THE CALPERS CONTRACT AMENDMENT AND AUTHORIZE THE CHAIR TO SIGN.
