4.05 Resolution for CalPERS Post-Retirement Employment Exemption for Margaret (Peggy) Moak - The
Public Employees' Pension Reform Act (PEPRA) of 2013 makes retirees ineligible for a period of 180
days after retirement. An exemption to this rule is permitted by Government Code Section
7522.56(f)(1) if approved by the governing body in a public meeting on the regular agenda. The
Treasurer-Tax Collector Department recommends approval of a resolution to allow the extra-help
hiring of Margaret (Peggy) Moak as an Assistant Treasurer-Tax Collector. Ms. Moak retired from her
elected Treasurer-Tax Collector position on December 30, 2018. There are two Assistant Treasurer-
Tax Collector positions in the Department with one dedicated to treasury functions. This position
requires significant expertise in the areas of investment, cash flow and finance management, as well
as personnel and related management duties. There is no staff member in the Department with the
level of expertise required to perform the necessary job functions of Assistant Treasurer-Tax
Collector specific to the Treasury Division. Ms. Moak will fill the vacancy for a limited duration until
the recruitment of a permanent Assistant Treasurer-Tax Collector has been completed and the
position is filled. The Director of Human Resources has reviewed the facts and concurs that the
request is consistent with Government Code section 7522.56(f)(1) — action requested — ADOPT
RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. (Treasurer-Tax Collector)
