BEHAVIORAL 3.01* Blue Cross (BC) of California -Blue Cross' Affiliate, Anthem BC Life 8c Health Insurance
HEALTH Company, has entered into an agreement with the County Medical Services Program
(CMSP) Governing Board to act as a third party administrator, to administer health care
services for persons served by CMSP in certain California counties. By entering into this
agreement CMSP members can be treated at the department's Psychiatric Health Facility,
with the department reimbursed from Blue Cross for providing these services to this
eligible population. Approval is requested to amend the agreement with Blue Cross to
extend the term of the agreement through December 31, 2015. The agreement will
thereafter renew without a formal amendment unless either party terminates -action
requested -APPROVE THE AGREEMENT AMENDMENT AND AUTHORIZE THE CHAIR TO
SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER.
3.02* Youth With aMission -Springs of LivinE? Water- Hiah School Reach -Youth With a Mission
- Springs of Living Water is a conference grounds at Richardson Springs, Chico. The
organization provides accommodations and meals for conference participants. Approval is
requested to enter into an agreement with Youth With a Mission to provide
accommodations and meals for high school students attending the High School Reach for
the Future Conference. The term of the agreement is March 27, 2014 through March 29,
2014. The maximum financial obligation under this agreement shall not exceed $34,829 -
action requested -APPROVE THE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN
SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER.
3.03* Youth With aMission - Springs of Living Water -Junior Hiah Reach -Approval is requested
to enter into an agreement with Youth With a Mission to provide accommodations and
meals for Junior High School students attending the Junior High School Reach for the
Future Conference. The term of the agreement is March 6, 2014 through March 8, 2014.
The maximum financial obligation under this agreement shall not exceed $34,829 -action
requested -APPROVE THE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO
REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER.

CHIEF 3.04* Fiscal Year (FYI 2013 Homeland Security Grant Program -Budget Adjustment and
ADMINISTRATIVE Donation to Church of the Nazarene -The Board of Supervisors authorized the Emergency
OFFICE Services Officer to apply for funding under the FY 2013 Homeland Security Grant Program
(HSGP). The Governor's Office of Emergency Services approved the grant application and
on October 22, 2013, the Board approved appropriation for all but $50,000 of the grant.
The remaining $50,000 of the grant will be used to purchase and install a power transfer
switch at Oroville Church of the Nazarene allowing a generator to be hooked up which
will increase the sheltering capabilities of the Red Cross and the County during an
emergency sheltering situation. The County, through General Services, will enter into an
agreement with the Oroville Church of the Nazarene giving the church ownership of and
maintenance responsibility for the equipment and the County the option to use the
facility as an emergency shelter. General Services and the Office of Emergency
Management, through a contract with an electrician for all labor and materials, will work
with the Oroville Church of the Nazarene to install the power transfer switch that will
remain, as a donation, with the facility -action requested - i) APPROVE BUDGET
ADJUSTMENT (4/6 vote required); AND 2) APPROVE DONATION AND TRANSFER OF
OWNERSHIP OF POWER TRANSFER SWITCH TO THE OROVILLE CHURCH OF THE
NAZARENE.
DEVELOPMENT 3.06* Two California Land Conservation (Williamson) Act Certificates of Expiration -Under
SERVICES Section 51245 of the Williamson Act, either the landowner or the County may serve a
Notice of Nonrenewal for property under the Williamson Act at any time. After
completing the nonrenewal period (normally nine years), during which the level of
Williamson Act tax preference is reduced each year, affected properties exit from the Act
and are no longer subject to its benefits or restrictions. The Department of Development
Services (DDS) is forwarding for the Chair's signature and subsequent recordation,
Certificates of Expiration for Assessor's Parcel Numbers 026-250-021 (Chaffin - 18.9 acres)
and 047-260-199 (Liptrap - 47.6 acres). These parcels completed the required nonrenewal
period and are no longer subject to the Act effective January 1, 2014. DDS expects to
forward several more Certificates of Expiration to the Board of Supervisors for signature
during early 2014 -action requested -ACCEPT THE CERTIFICATES OF EXPIRATION AND
AUTHORIZE THE CHAIR TO SIGN.
GENERAL 3.06* Amendment 1 to Contract with Disability Access Consultants for Updating the County
SERVICES Accessibility Self-Evaluation and Transition Plan - Following a solicitation for services, the
Board approved a contract on November 12, 2013, in the amount of $59,850, with
Disability Access Consultants to complete aSelf-Evaluation and Transition Plan for several
County owned facilities as is required by the Americans with Disabilities Act (ADA). It is
anticipated that the project will be completed prior to the original estimated date of
completion and staff recommends that the Board now approve a $31,400 amendment to
include inspections of additional facilities including a number of leased facilities in the
project. Including the leased facilities established in the contract amendment will enable
General Services to work with the property owners to establish transition plans for
improving accessibility in leased facilities too. The funding source is a Community
Development Block Grant included in the General Services FY 2013-14 approved budget
and no additional appropriation is required -action requested -APPROVE THE CONTRACT
AMENDMENT AND AUTHORIZE THE CHAIR TO SIGN.

3.07* Budget Adiustment for Purchase of SunGard's Work Order System - In 2001, General
Services acquired the Mainsaver Computerized Maintenance Management System
(CMMS) for $64,000 and immediately began depreciating the system so that funding
would be available to modify or change the system in the event the needs of the County
changed. At the time, connectivity to other County department computer based
applications was not a priority and General Services was focused mainly on routine
facilities related work. The focus of the department now includes managing larger capital
facilities related projects that require more complex systems so the department
completed an evaluation of CMMS products available including the CMMS product
offered by SunGard, the firm that provides the County's financial system. In addition to
providing connectivity to the County's financial system, the SunGard CMMS also supports
the key components of both routine and capital facilities related work handled by General
Services. Staff requests the Board approve a budget adjustment transferring $19,300
from the Support Services Equipment Replacement Fund to General Services to fund the
purchase of the SunGard CMMS application -action requested -APPROVE THE BUDGET
ADJUSTMENT. (4/S vote required)
HUMAN 3.08* Resolution to Amend The Salary Ordinance -The Department of Human Resources has
Resources prepared a resolution to amend the Salary Ordinance. These changes will initially increase
the total allocations in the County by one (1) position until a departmental recruitment in
General Services can be conducted and the vacated position deleted at a future Board
meeting. The following are the sections of the Salary Ordinance to be amended:
Human Resources: The Human Resources Department is requesting to change the
classification title of Sheriff's Administrative Secretary (Class Code 1059) to SherifYs
Administrative Assistant (Class Code 1065). In addition the department is requesting to
add the classification of Sheriff's Administrative Assistant, Senior (Class Code 1066). Both
of these changes shall be reflected on Section 57, Reference E of the Salary Ordinance
titled, "Management and Supervisory (BCMEA) Unit Classifications." These changes were
agreed to by Human Resources and BCMEA. Additionally the department is requesting to
move the Correctional Deputy Trainee (Class Code 6828) classification from the Section
57, Reference M of the Salary Ordinance titled, "Classifications with Flat Rate
Assignments" to Section 57, Reference A of the Salary Ordinance titled, "Butte County
Correctional Officers-General Unit." After review of the duties and responsibilities of this
position, this classification should be included as part of the BCCOA-General Unit. The
classification will maintain the bi-weekly flat rate that is currently listed on the Salary
Ordinance. This change was agreed to by Human Resources and the BCCOA-General Unit.
Sheriff's Office: Concurrent with the Human Resources Department's request above, the
SherifYs Office is requesting to change the allocation of SherifYs Administrative Secretary
to a flexibly staffed position of SherifYs Administrative Assistant, Senior/Sheriff's
Administrative Assistant. These changes will leave the total allocations unchanged and
any increase in costs associated with this change will be covered in the department's FY
2013-14 budget.

General Services: The General Services Department is requesting to add one (1) flexibly
staffed position of Administrative Analyst/Administrative Analyst, Associate. This change
will initially increase the allocations in the department by one (1) position until a
departmental recruitment can be conducted to fill the new position. Once the
departmental recruitment is complete, the position that was vacated will be eliminated at
a future Board meeting. Any increase in costs associated with this change will be covered
in the department's FY 2013-14 budget -action requested -ADOPT THE RESOLUTION
AND AUTHORIZE THE CHAIR TO SIGN.
PUBLIC HEALTH 3.09* Children's Medical Service FY 2013-14 Child Health and Disability Prevention (CHDP) and
California Children Services (CCS) Joint Plan -Each year, the Public Health Department
prepares a Children's Medical Services Plan for submittal to the State. The purpose of the
plan is to summarize the overall program activities that will be accomplished within the
Child Health and Disability Prevention (CHDP) Program and the California Children's
Services Program. The CHDP program provides for early and periodic health screening of
children, adolescents and young adults. The California Children Services program provides
financial help for medical care and physical/occupational therapy for children who have
serious or disabling health problems -action requested - 1) APPROVE SUBMISSION OF
THE PLAN TO THE STATE DEPARTMENT OF HEALTH SERVICES; AND 2) AUTHORIZE THE
CHAIR TO SIGN PLAN DOCUMENT.
3.10* Asreement with California Family Health Council, Inc. for 2014 Title X Family Plannine
Program -The California Family Health Council, Inc. (CFHC) has received a federal grant
pursuant to Title X of the Public Health Services Act for the purpose of providing
comprehensive family planning services. CFHC is authorized and desires to contract with
Butte County Public Health as asub-recipient to provide family planning services to
residents within Butte County. The term of the contract is January 1, 2014 through
December 31, 2014 in the amount of $100,750. The funds from this contract will augment
the existing family planning program within the Public Health Clinics -action requested -
APPROVE AGREEMENT AND AUTHORIZE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY
COUNSEL AND AUDITOR-CONTROLLER.
Puauc Woaxs 3.11* Resolution Authorizing Submittal of Application for CalRecycle Grants - In previous years,
the Board of Supervisors authorized the Public Works Department to submit applications
for CalRecycle for the following grants: Tire Enforcement, Farm and Ranch, Local
Government Waste Tire Cleanup, and Tire Amnesty. The County has been successful in
obtaining these grants, which has resulted in over 50,000 tires being collected and
recycled. Many illegal waste tire dump sites have been cleaned up using these grant
funds. Previously, CalRecycle required a separate resolution for each grant application.
CalRecycle will now accept one resolution authorizing submittal of applications for all
CalRecycle grants for which the entity is eligible. This resolution authorizes the
department to apply for any CalRecycle grant that the County is eligible for the term FY
2014-15 through 2018-19 -action requested -ADOPT RESOLUTION AND AUTHORIZE
CHAIR TO SIGN.

3.12* Authorization to Advertise for Bids for the Construction of the Foothill Boulevard eridae
Across Wyman Ravine, County Proiect No. 23511-03-1, Federal Bridge Replacement
Proiect BRLS-5912 (0601 -Authorization is requested for the Public Works Director to
advertise for bids, to authorize the Director to sign the plans and adopt a wage scale for
the construction of the Foothill Boulevard Bridge across Wyman Ravine. The proposed
project involves, in general, removing an existing reinforced concrete bridge located on
Foothill Boulevard, and constructing an approximately 36-foot long, three span, cast-in-
place triple box culvert bridge having an overall width of 58-feet. The project will include
reconstructing approximately 900 lineal feet of roadway. All work will take place in the
existing or newly acquired right of way or within temporary construction easements, as
applicable. By adopting a Wage Scale, the Board of Supervisors has ascertained, pursuant
to Section 1773 of the Labor Code, the general prevailing wage rates for straight time,
overtime, Saturday, Sunday and holiday work applicable to the work to be done in Butte
County is the same as the general prevailing wage rates as determined by the Department
of Industrial Relations. These rates are on file in the office of the Director of Public Works,
7 County Center Drive, Oroville, CA 95965. Future effective wage rates, which have been
predetermined and are on file with the Department of Industrial Relations are referenced
but may not show in said file. The Federal minimum wage rates shown in Section D of
these Special Provisions are determined by the Secretary of Labor. If there is a difference
between the minimum wage rates predetermined by the Secretary of Labor and the
prevailing wage rates determined by the Department of Industrial Relations for similar
classifications of labor, the Contractor and his subcontractors shall pay not less than the
higher wage rate -action requested - 1) AUTHORIZE THE DIRECTOR OF PUBLIC WORKS
TO ADVERTISE FOR BIDS; AND 2) AUTHORIZE THE DIRECTOR OF PUBLIC WORKS TO SIGN
PLANS; AND 3) ADOPT WAGE SCALE.
SHERIFF- 3.13* Accept Donated Trailer from Search and Rescue -The function of search and rescue is a
CORONER government mandate of the Sheriff, and the Sheriff has designated Butte County Search
and Rescue as the primary agency to manage county-wide search and rescue operations.
Search and Rescue is a donation driven volunteer organization that receives limited
financial support from the SherifYs Office via a facility, insurance, maintenance and fuel
for Search and Rescue equipment and operations. Search and Rescue purchased a new
trailer to haul a Sno-Cat and is donating the trailer to the Butte County SherifYs Office for
assignment back to Search and Rescue. The trailer was assigned county asset #1907. The
value is: $9,025 -action requested -ACCEPT DONATED TRAILER.
3.14* Contract Amendment. Lexis Nexis -The Sheriff's Office is required to offer a law library for
inmate use within the jail and utilizes the services of Lexis Nexis. The Sheriff's Office went
out to bid to solicit the best provider of legal materials and Lexis Nexis returned again as
the best service for our needs. Lexis Nexis is an on-line access to the most current law
library materials available. In conjunction with the Contracts Division of General Services,
it was decided to amend the existing contract with Lexis Nexis to extend the term of
services through November 30, 2016 and to make some minor contractual language
changes. Pay schedule is as follows: $499 per month -December 1, 2013 through
November 30, 2014; $509 per month -December 1, 2014 through November 30, 2015;
and $519 per month -December 1, 2015 through November 30, 2016- action requested -
APPROVETHE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY
COUNTY COUNSEL AND AUDITOR-CONTROLLER.

TREASURE 3.15* Thermalito and Palermo Union School Districts 2013-2014 Mid-Year TRANS Issuance -The
TAX COLLECTOR Thermalito and Palermo Union School Districts find it necessary to secure short term cash
flow financing, and, in order to benefit from an established pooled program and reduced
costs of issuance, desire to participate in the California School Cash Reserve 2013-2014
Mid-Year TRAN Program ("the Program"). The Program is sponsored by the California
School Boards Association Finance Corporation. California Government Code Section
53853 provides that the County Board of Supervisors is to issue TRANS on behalf of school
districts; however, an exception applies to TRANS issued in conjunction with other TRANS.
Under this exception, if the County Board fails to authorize, by resolution, the issuance of
a TRAN in the name of the requesting school district, or if the County Board notifies the
school district that it will not authorize issuance within a 45 day period from the date of
the request, then such TRAN may be issued by the requesting school district in its name,
via participation in the pooled TRANS Program. If the Board of Supervisors prefers to
adopt a resolution authorizing issuance by the County on behalf of the District, a County
Resolution will be provided for consideration at a future meeting. The Thermalito and
Palermo Union School Districts have communicated a desire to 1) participate in the
Program; 2) issue aMid-Year TRAN during the month of February, and 3) each issue in its
own name, in the interest of meeting critical timelines. Accordingly, the Districts have
requested that the Board of Supervisors exercise its option to notify the Districts that it
will not authorize the issuance of the TRAN of each District within the 45 -day period
beginning January 6, 2014 (the date of receipt of the letter containing the District
Resolution and said request), and provide notice to that effect to the District -action
requested -EXERCISE THE OPTION TO NOTIFY THE DISTRICT THAT COUNTY ISSUANCE OF
A TRAN ON BEHALF OF THE THERMALITO UNION SCHOOL DISTRICT AND THE PALERMO
UNION SCHOOL DISTRICT WILL NOT BE AUTHORIZED; AND DIRECT THE CLERK OF THE
BOARD TO SIGN THE MEMORANDUM AND FORWARD TO EACH DISTRICT.
OTHER 3.16* Reappointments to the Oroville Mosquito Abatement District (OMAD) -The Chair of
DEPARTMENTS OMAD submits a request for reappointment of the following Board of Trustee members:
AND AGENCIES Dennis Diver and Scott Damon - to 2-year terms ending December 31, 2015; and Steve
Lawrence and Marvin Mitchell - to 1-year terms ending December 31, 2014. OMAD has
requested the 1-year terms for Mr. Lawrence and Mr. Mitchell in order to re-establish
staggered terms of their members-action requested -MAKE APPOINTMENTS.

6.01* Public Hearin? -Butte County Draft Climate Action Plan (CAP), CAP Work Plan, and
Environmental Impact Report (EIR) Addendum -The Department of Development Services
coordinated the preparation of the CAP for the unincorporated area of Butte County. The
Butte County General Plan was adopted and the General Plan EIR was certified in April
2010 and was amended in November 2012 by the Butte County Board of Supervisors
(County Resolutions 10-152, 10-150, 12-124, and 12-123). General Plan goals, policies, and
actions to address global Greenhouse Gas (GHG) emissions include, but are not limited to,
a requirement to reduce GHG emissions from County operations and community-wide
sources. General Plan Action COS-A1.1 specifically calls for preparation, maintenance, and
implementation of a CAP. The proposed CAP identifies a GHG emissions reduction target
and describes how the County will reduce both community-wide and government
operations emissions to achieve the target. The CAP identifies a GHG emissions reduction
target of 15 percent below baseline levels by the year 2020. The year 2006 has been
identified as the baseline year in conformance with state legislation. The CAP provides
measures and associated actions for energy efficiency and renewable energy, alternative
fuel vehicles and equipment, transportation, agriculture, and solid waste. It also addresses
GHG emissions generated from County government operations and outlines a strategy the
County can use to adapt to a changing climate. The CAP supports statewide GHG reduction
goals identified in State Assembly Bill 32 and State Senate Bill 375 -action requested - 1)
APPROVE THE RESOLUTION ADOPTING THE CLIMATE ACTION PLAN; 2) APPROVING THE EIR
ADDENDUM; AND 3) APPROVE THE RESOLUTION ADOPTING THE CLIMATE ACTION PLAN
WORK PLAN.

10:45A.M. 5.02* Timed Item -Introduction of an Ordinance Amendin¢ Ordinance 4051, Restrictions on
Cultivation of Medical Mariiuana -At the meeting of January 14, 2014, the Board directed
amendments be made to the County's ordinance regarding restrictions on the cultivation
of medical marijuana (Ordinance 4051). Pursuant to Board direction, submitted is a
proposed amendment that makes the following major changes:
1. Sets the cultivation limits as follows:
a. Parcels 0.5 and less -indoor cultivation only, in a detached structure no larger than
120 sq. ft. in size, 15 ft. setbacks (unchanged from previous requirements);
b. Parcels >0.5 acres - <5 acres - 50 sq. ft. of cultivation area, 50 ft. setbacks -with at
least 1 recommendation;
c. Parcels >/= 5 acres - <10 acres - 100 sq. ft. of cultivation area, 75 ft. setbacks -with
at least 2 recommendations;
d. Parcels >/=10 acres and up - 150 sq. ft. of cultivation area, 150 ft. setbacks -with at
least 3 recommendations.
2. Requires cultivation to be in a single cultivation area;
3. Revises the setback requirements for harvesting (drying, processing and storage) to the
same as cultivation setbacks;
4. Limits the harvesting of marijuana to the marijuana grown on that parcel (not allowed
to bring material into process); and
5. Revises the complaint process to allow anyone to complain.
A strike-through version and an un-marked version of the proposed ordinance are
provided as part of the agenda item -action requested - WAIVE READING OF THE
ORDINANCE.

Information and Procedures Concerning the Agenda and Conduct of
the Board of Supervisors Meetings
Meetine Information: Meetings are generally held the second and fourth Tuesday of each month. Meetings start at 9:00 a.m.
and are held in the Board of Supervisors Chambers, County Administration Building, 25 County Center
Drive, Oroville. At the end of each year the Board adopts a meeting schedule for the upcoming year.
Meeting dates can be changed as a result of holidays or other events so please check the meeting
calendar to be certain. Copies of the adopted meeting calendar for the year are available in the County
Administrative Office or at the Clerk of the Board website at www.buttecountv.net/cob.
Aeenda Information: The agenda for every meeting of the Board is posted in front of the County Administration Building at
least 72 hours before each meeting, and is available by mail subscription, a-mail subscription, or at the
Clerk of the Board website. A copy of the agenda and supporting materials provided to the Board of
Supervisors members to explain each agenda item (excluding documents that are not a public record
within the meaning of the Public Records Act) are available for your review at the County Administrative
Office, the Chico, Oroville, and Paradise libraries (please do not remove items from these files), and at
the Clerk of the Board website. Copies of supporting materials can be made for you at a charge to cover
costs. The list of communications included with the agenda packages is not comprehensive. Additional
communications to the Board of Supervisors may have been received but not included in the agenda
supporting material. Copies of all communications received by the Board of Supervisors (excluding
documents that are not a public record within the meaning of the Public Records Act) are available at the
Administrative Office upon request. An (*) appearing before an agenda item signifies that material has
been provided to the Board of Supervisors members to explain that item.
A¢enda Format and The agenda is usually organized into the following areas and meetings generally proceed in the following
Meetine Order: order:
1. Consent Aeenda: these are items that are considered routine and are handled by one motion and vote of
the Board. If you wish to discuss any item on the Consent Agenda you can either fill out a speaker card
(located in the back of the board room) and give it to the Clerk of the Board (sitting to the right of the
Board) or, when the Chair asks if there is anything anyone would like to remove from the Consent
Agenda, stand and approach the podium and request the item be removed. The removed items are
discussed at the end of the Regular Agenda.
2. Regular Aeenda: this is where presentations to the Board and items that require full discussion are
heard. Items removed from the Consent Agenda are discussed underthis section.
3. Public Hearine and Timed Items: this is where items that are required by law to be heard as a public
hearing are set. This is the section where appeals before the Board are usually discussed. Hearings may
start after the time listed, but will never start before the time listed.
4. Public Comment: this is the area of the agenda where members of the audience may address the Board
on any matter not listed on the agenda. The Board, by law, cannot take action on any matter not listed
on the agenda, but may respond to statements or questions and provide staff direction.
5. Closed Session: the Board is authorized, by law, to meet in a closed session in certain circumstances.
This area of the agenda identifies those items that will be discussed during the closed session.
Public Participation: It is the policy of the Board of Supervisors, and a requirement of the California Open Meetings Law, to
allow members of the public the opportunity to comment on all matters before the Board. Public
participation is limited to matters within the subject matter jurisdiction of the Board pursuant to
Government Code Section 54954.3. The Board has adopted policy and procedures to facilitate the
meeting process and conduct. A complete listing of these policies and procedures can be found in the
printed booklet agenda, obtained at the County Administrative Office, or viewed at the Clerk of the Board
website.
The Board of Supervisors is also committed to making its proceedings accessible to all citizens. Individuals
with special needs should call the Clerk of the Board at 530-538-7631, Monday through Friday, 8:00 a.m.
to 5:00 p.m. to request disability-related modifications/accommodations or to request materials in
alternate formats. All requests for special accommodations and/or alternative format documents must be
made 48 hours priorto the meeting.
