BEHAVIORAL
HEALTH 3.01 * Northern Valley Catholic Social Services (NVCSS) -
approval is requested for an agreement with NVCSS for
the provision of linguistic and cultural specialty
prevention and early intervention services for the
Latino populations in Gridley and the Latino and Hmong
populations at Vista Verde and East of Eaton Apartment
Complexes in Chico. The term of the agreement is
November 1, 2009 through June 30, 2010 with a maximum
amount payable of $191,634.06 (department budget
utilizing MHSA funds) - action requested - APPROVE
AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO
REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER.
3.02 * California Department of Alcohol and Drua Programs -
Comprehensive Drua Court Implementation (CDCI)
Dependency Drua Court Grant Award - The Department of
Behavioral Health has received a CDCI Dependency Drug
Court Award for Fiscal Year (FY) 2009/2010 which will
fund an Integrated Dependency Drug Court (DDC) program
that focuses on parents whose substance abuse
contributes to child abuse and/or neglect resulting in
involvement with juvenile court dependency
proceedings. The term of the agreement is July 1, 2009
through June 30, 2010 with a maximum amount receivable
of $238,946 (department budget). There is a required
County match of $47,789 (budgeted) - action
requested - APPROVE THE AGREEMENT AND AUTHORIZE THE
CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND
THE AUDITOR-CONTROLLER.

3.03 * California Department of Alcohol and Drua Programs -
(CDCI) Dependency Drua Court Grant Award - The
Department of Behavioral Health has received a CDCI
Dependency Drug Court Award for FY 2009/2010 and FY
2010/2011 to continue the Drug Court Program. This
program provides a range of services to participants
who are convicted of felonies and are placed on formal
probation. These services include: residential
treatment, non-residential outpatient drug services,
individual sessions, group sessions, anger
management/violence prevention, assessment, client
public transportation, day-care habilitative substance
abuse treatment, drug testing, vocational counseling,
and various incentives. The term of the agreement is
January 1, 2010 through December 31, 2010 with a
maximum amount receivable of $126,707 (department
budget). There is a required County match of $25,341
(budgeted) - action requested - APPROVE THE AGREEMENT
AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY
COUNTY COUNSEL AND THE AUDITOR-CONTROLLER.
3.04 * California Department of Alcohol and Drua Programs -
Drua Court Partnership (DCP) Project Grant Award - The
Department of Behavioral has received a DCP Project
Grant Award to continue the Drug Court Program for FY
2009/2010. The term of the agreement is July 1, 2009
through June 30, 2010 with a maximum amount receivable
of $126,270 (department budget). There is a required
County match of $25,254 (budgeted) - action
requested - APPROVE THE AGREEMENT AND AUTHORIZE THE
CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND
THE AUDITOR-CONTROLLER.
3.05 * Feather River Tribal Health, Inc. - amendment -
approval is requested for an amendment to the agreement
with Feather River Tribal Health, Inc. This
organization acts as Co-Director to the Connecting
Circles of Care (CCOC) grant from the Substance Abuse
and Mental Health Services Administration. The
amendment increases the maximum amount payable to
$221,087.18 (an increase of $43,912.33) - action
requested - APPROVE THE AGREEMENT AMENDMENT AND
AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY
COUNSEL AND THE AUDITOR-CONTROLLER; AND APPROVE
RELATED BUDGET TRANSFER (4/5 vote required) ACCEPTING
AND APPROPRIATING FUNDS AS DETAILED IN THE AGENDA
REPORT .

Ishi Valley Estates - approval is requested for a
budget adjustment in the amount of $1,200 to cover the
cost of an emergency repair of a hydrant system for CSA
158 - action requested - APPROVE BUDGET TRANSFER (4/5
vote required) ACCEPTING AND APPROPRIATING FUNDS AS
DETAILED IN THE AGENDA REPORT.
3.08 * Resolution Authorizincr Master Property Tax Sharincr
Agreement with Butte Water District - The proposed
property tax sharing agreement provides that no
property tax transfer will occur as a result of any
annexation of territory to Butte Water District. The
agreement, which was requested by the Butte Water
District is consistent with prior direction from the
Board of Supervisors - action requested - ADOPT
RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN.
3.09 * Resolution Authorizincr Master Property Tax Sharincr
Acreement with Richvale Sanitary District - The
proposed property tax sharing agreement provides that
no property tax transfer will occur as a result of any
annexation of territory to Richvale Sanitary District.
The agreement, which was requested by the Richvale
Sanitary District is consistent with prior direction
from the Board of Supervisors - action requested -
ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN.

Recruest for Election Consolidation - A resolution and
notice has been submitted by the Butte County Board of
Education requesting consolidation of the governing
board member elections with the Primary Election to be
held on June 8, 2010, for the purpose of electing the
following: 1) two Members, Trustee Area 2 (Oroville
Area); and 2) one member, Trustee Area 3 (Paradise
Area) - action requested - APPROVE CONSOLIDATION.
Carol A. Smoots - amendment - approval is requested for
an amendment to the agreement with Carol A. Smoots at
Perkins Coie, LLP for the provision of legal services
relating to the Federal Energy Regulatory Commission's
re-licensing of the California Department of Water
Resources' facility at Lake Oroville - action
requested - APPROVE AGREEMENT AMENDMENT AND AUTHORIZE
THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL
AND THE AUDITOR-CONTROLLER.

12ESOUizcES 3.12 Adoption of Salary Ordinance - the department has
prepared a salary ordinance which incorporates changes
from the Final Budget for Fiscal Year 2009/2010 and
subsequent, approved amendments since that time. The
following is a summary of the proposed ordinance:
SECTION 1: SUBJECT AND SHORT TITLE - Identifies the
subject of the ordinance as determining salaries and
positions, and that it shall be known as the "Salary
Ordinance."
SECTIONS 2 THROUGH 56: ALLOCATED POSITIONS -
Identifies the number of positions and appropriate
classifications authorized for each designated
department or budget unit, by budget unit number and
department name.
SECTION 57: SALARY PLAN FOR CLASSIFIED POSITIONS -
Identifies the classified positions and the appropriate
salary designation per classification by employee
association unit. All salary tables now have the
adjusted salaries that became effective on October 7,
2007. This is the effective date of the last cost of
living adjustment (COLA) agreed upon with the
respective bargaining units.
SECTION 58: SALARY PLAN FOR ELECTED AND APPOINTED
OFFICIALS - Identifies the appropriate salary
designation for appointed and elected officials.
Reference C, Board of Supervisors' Members reflects the
salary after January 1, 2007.
SECTION 59 PAYMENT OF SALARIES AND WAGES - Specifies
salary and wage policies shall be in accordance with
the Merit System Ordinance and Resolution, and when
salaries are to be paid.
SECTION 60: REPEAL - Repeals the existing Salary
Ordinance No. 3991, all amendments thereto, and any and
all other inconsistent ordinances.
SECTION 61: SEVERABILITY - The invalidity of any part
of the ordinance shall not affect the remaining parts.
SECTION 62: EFFECTIVE DATE AND PUBLICATION - The
Salary Ordinance shall be in effect as of February 9,
2010. Within fifteen (15) days after its passage, a
summary shall be published with names of those
supervisors voting for and against it, a certified copy
of the full text shall be posted in the Office of the
Clerk of the Board of Supervisors - action requested -
ADOPT ORDINANCE AND AUTHORIZE THE CHAIR TO SIGN. (FROM
1-26-10 [Item 3.12]).

3.13 * Resolution to Amend the Salary Ordinance - the
department has prepared a resolution which will amend
the salary ordinance as follows:
CLERK-RECORDER - requests to delete the following: one
position of Administrative Assistant,
Senior/Administrative Assistant and one .25 FTE
position of Accountant, Senior; and one .75 FTE
position of Accountant, Senior. The department
requests to add the following positions: one position
of Deputy County Clerk-Registrar III/Deputy County
Clerk-Registrar II and one .25 FTE position of
Administrative Analyst, Senior/Administrative
Analyst/Administrative Analyst, Associate and one .75
FTE position of Administrative Analyst,
Senior/Administrative Analyst/Administrative Analyst,
Associate. These changes were included in the
department's FY 2009/2010 budget. The total allocations
in the department remain unchanged at 23.
HUMAN RESOURCES - requests to change the annual base
salary for the Director of Behavioral Health to
$142,000 pursuant to Resolution 09-171 - Resolution of
the County of Butte Salary and Benefits of Butte County
Appointed Department Heads as detailed in the agenda
report - action requested - ADOPT RESOLUTION AND
AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY
COUNSEL AND THE AUDITOR-CONTROLLER.
LIBRARY 3.14 * Library Donations - The Library has received the
following donations: $4,800 from Paradise Friends of
the Library; $120 from Margaret Swick honoring Barbara
Todd; $300 from Maudie Penney; $760 from Chico Friends
of the Library; $600 from Oroville Friends of the
Library; $250 from Dorothy Dingfelder; $100 from Maxine
Rodgers; $100 from Donald & Cleo Reed; $354.63 from
Ruthmarie Ferris and $1,062.36 from an anonymous source
have received for books - action requested - ACCEPT
DONATIONS AND AUTHORIZE LETTERS OF APPRECIATION.

3.15 * Overdrive, Inc. - approval is requested for an
agreement with Overdrive, Inc. This agreement will
enable the Butte County Library to offer access to
digital books from the Butte County Library website.
The term of the agreement is March 1, 2010 through
February 28, 2014 with a maximum amount payable of
$38,400 (department budget) - action requested -
APPROVE AGREEMENT AND AUTHORIZE CHAIR TO SIGN SUBJECT
TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER.
PROBATION 3.16 * Accept Unanticipated Revenue and Make Technical
Adjustments to Balance Interdepartmental Transfers -
The Probation Department receives an annual grant from
the California Emergency Management Agency used to fund
certain functions with the Butte Interagency Narcotics
Task Force. The funds are received by Probation, and
portions are internally transferred to the Sheriff and
District Attorney. The grant amount received was
$70,909 higher than budgeted, therefore a budget
adjustment to the Probation Department to accept and
appropriate the unanticipated revenue is needed.
Additionally, some of the budgeted transfers between
Probation, Sheriff, and District Attorney were not
reconciled and now require technical adjustments as
detailed in the Board Transfer Request Worksheet.
These adjustments do not increase net county cost -
action requested - APPROVE BUDGET TRANSFER (4/5 vote
required) ACCEPTING AND APPROPRIATING UNANTICIPATED
REVENUE AS DETAILED IN THE AGENDA REPORT.
PUBLIC
HEALTH 3.17 * Recruest to Waive Public Health Clinic Fees - approval
is requested to waive the $71 standard clinic fee for
immunizations for volunteers traveling to Haiti to
provide emergency assistance. The requested fee waiver
would only apply to administering the travel
immunizations while the costs of the required
immunizations would continue to be covered by the
receiving party - action requested - PURSUANT TO BUTTE
COUNTY CODE 1-18, FIND THAT IT IS IN THE PUBLIC
INTEREST TO WAIVE THE $71 PUBLIC HEALTH DEPARTMENT
CLINIC FEE FOR VOLUNTEERS PROVIDING ASSISTANCE TO
HAITI.

Lead Agency for the Submittal of the Local Government
Waste Tire Cleaning and Amnesty Day Grant Application
for FY 2010/2011 - consideration of a resolution which
authorizes Butte County to act as Lead Agency for the
submittal of the Local Grant Application for FY
2010/2011 - action requested - ADOPT RESOLUTION AND
AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY
COUNSEL AND THE AUDITOR-CONTROLLER; AND AUTHORIZE THE
DIRECTOR OF PUBLIC WORKS, OR DESIGNEE, TO EXECUTE ALL
NECESSARY DOCUMENTS RELATED TO THE GRANT.
SHERIFF-
CORONER 3.19 * Budget Adjustment and Fixed Asset Purchase - approval
is requested for the fixed asset purchase of furniture
for the civil sergeant's office to replace thirty year-
old desks and file cabinets. Pursuant to Government
Code Section 26731, the furniture will be purchased
with funds from a special fund that can only be used
for the purchase of auxiliary equipment and
furnishings - action requested - APPROVE FIXED ASSET
PURCHASE OF FURNITURE AND EQUIPMENT IN THE AMOUNT OF
$20,000; AND APPROVE BUDGET TRANSFER (4/5 vote
required) ACCEPTING AND APPROPRIATING FUNDS AS DETAILED
IN THE AGENDA REPORT.

TAX COLLECTOR 3.20 * Tax Sale Services of California - approval is requested
for an agreement with Tax Sale Services of California
for the provision of coordinating the June 2010
Internet auction of tax-defaulted properties. The term
of the agreement is from January 1, 2010 through

$35,750 (department budget) - action requested -

ITEMS 4.05 * Resolutions Resolving Impasse in the Meet and Confer
Process - California Government Code Sections 3500-3511
(Myers-Milias-Brown Act) provide that the County shall
meet and confer in good faith with representatives of
a recognized employee organization in order to endeavor
to reach agreement regarding proposed changes in wages,
hours, and other terms and conditions of employment.
California Government Code Section 3505.4 provides that
if after meeting and conferring in good faith, an
impasse has been reached, and impasse procedures, where
applicable, have been exhausted, a public agency that
is not required to proceed to interest arbitration,
(which Butte County is not) may implement its last,
best, and final offer.
A. Butte County Deputy Sheriffs' Association
Management and Supervisory Unit (DSA Management
Unit - The County and representatives of the DSA
Management Unit have been meeting and conferring
since June 27, 2008. The County presented its
Last, Best and Final Offer on December 29, 2009
and again on January 11, 2010. Both were rejected
by the DSA Management Unit members. Impasse was
reached on January 12, 2010 - action requested -
ADOPT THE RESOLUTION RESOLVING IMPASSE IN THE MEET
AND CONFER PROCESS AND APPROVE ADOPTION OF THE
TERMS AND CONDITIONS OF EMPLOYMENT FOR DECEMBER 1,

Information and Procedures Concerning the Agenda and Conduct of
the Board of Supervisors Meetings
Meeting Information: Meetings are generally held the second and fourth Tuesday of each month. Meetings start at 9:00 a.m. and are
held in the Board of Supervisors Chambers, County Admini stration Building, 25 County Center Drive, Oroville.
At the end of each year the Board adopts a meeting schedule for the upcoming year. Meeting dates can be
changed as a result of holidays or other events so please check the meeting calendar to be certain. Copies of
the adopted meeting calendar for the year are available in the County Administrative Office or at the Clerk of
the Board website at www.buttecounty.net/cob.
Agenda Information: The agenda for every meeting of the Board is posted in front of the County Administration Building at least
72 hours before each meeting, and is available by mail subscription, e-mail subscription, or at the Clerk of the
Board website. A copy of the agenda and supporting materials provided to the Board of Supervisors members
to explain each agenda item (excluding documents that are not a public record within the meaning of the Public
Records Act) are available for your review at the County Administrative Office, the Chico, Oroville, and
Paradise libraries (please do not remove items from these files), and at the Clerk of the Board website. Copies
of supporting materials can be made for you at a charge to cover costs. The list of communications included
with the agenda packages is not comprehensive. Additional communications to the Board of Supervisors may
have been received but not included in the agenda supporting material. Copies of all communications received
by the Board of Supervisors (excluding documents that are not a public record within the meaning of the Public
Records Act) are available at the Administrative Office upon request. An (*) appearing before an agenda item
signifies that material has been provided to the Board of Supervisors members to explain that item.
Agenda Format and
Meeting Order: The agenda is usually organized into the following areas and meetings generally proceed in the following order:
1. ConsentAgenda: these are items that are considered routine and are handled by one motion and vote
of the Board. If you wish to discuss any item on the Consent Agenda you can either fill out a speaker
card (located in the back of the board room) and give it to the Clerk of the Board (sitting to the right
of the Board) or, when the Chair asks if there is anything anyone would like to remove from the
Consent Agenda, stand and approach the podium and request the item be removed. The removed
items are discussed at the end of the Regular Agenda.
2. Regular Agenda: this is where presentations to the Board and items that require full discussion are
heard. Items removed from the Consent Agenda are discussed under this section.
3. Public Hearing and Timed Items: this is where items that are required by law to be heard as a public
hearing are set. This is the section where appeals before the Board are usually discussed. Hearings
may start after the time listed, but will never start before the time listed.
4. Public Comment: this is the area of the agenda where members of the audience may address the
Board on any matter not listed on the agenda. The Board, by law, cannot take action on any matter
not listed on the agenda, but may respond to statements or questions and provide staff direction.
5. Closed Session: the Board is authorized, by law, to meet in a closed session in certain circumstances.
This area of the agenda identifies those items that will be discussed during the closed session.
Public Participation: It is the policy of the Board of Supervisors, and a requirement of the California Open Meetings Law, to allow
members of the public the opportunity to comment on all matters before the Board. Public participation is
limited to matters within the subject matter jurisdiction of the Board pursuant to Government Code Section
54954.3. The Board has adopted policy and procedures to facilitate the meeting process and conduct. A
complete listing of these policies and procedures can be found in the printed booklet agenda, obtained at the
County Administrative Office, or viewed at the Clerk of the Board website.
The Board of Supervisors is also committed to making its proceedings accessible to all citizens. Individuals
with special needs should call the Clerk of the Board at 530-538-7631, Monday through Friday, 8:00 a.m. to
5:00 p.m. to request disability-related modifications/accommodations or to request materials in alternate
formats. All requests for special accommodations and/or alternative format documents must be made 48 hours
prior to the meeting.
