Mental Health Resources, Inc. - Dr. Adegoke Adeyemo of A.A. Mental Health Resources, Inc. is a licensed physician and surgeon experienced in the delivery of psychiatric services through telepsychiatry, whereby clients receive psychiatric services by video-conferencing. Dr. Adeyemo's services will supplement those of other Butte County psychiatrists. Approval is requested for an agreement with A.A. Mental Health Resources, Inc. for these services. The term of the agreement is July 1, 2014 through June 30, 2015. The maximum financial obligation under this agreement shall not exceed $293,760 – action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER. 3.02* Beth Jones - Beth Jones was selected through a competitive Request for Qualifications process to fill a contracted position of Patients’ Rights Advocate. Beth Jones provides direct on-site advocacy services to protect and enforce the legal and human rights of Butte County Behavioral Health (BCDBH) clients. Approval is requested to renew the agreement with Beth Jones to provide patient rights advocacy for BCDBH clients. The term of the agreement is July 1, 2014 through June 30, 2015. The maximum financial obligation under this agreement shall not exceed $33,500 – action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER. 3.03* California Psychiatric Transitions, Inc. (CPT) - CPT operates mental health rehabilitation center facilities providing a structured program to assist clients with the development of skills necessary to transition from supervised care to independent living. Approval is requested for an agreement with CPT to provide 24-hour mental health rehabilitation center services. The term of this agreement is April 3, 2014 through June 30, 2014. This agreement is replacing the Interim Agreement, which has been in place since April 3, 2014. The maximum financial obligation under this agreement shall not exceed $57,400 – action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER. BUTTE COUNTY BOARD OF SUPERVISORS AGENDA – MAY 6, 2014 PAGE 3 May 6, 2014 3.04* Clean King by DeHart, Inc. - Clean King by DeHart, Inc. (Clean King), established in 1989, provides a variety of services from commercial office cleaning to carpet restoration services throughout Butte County. Clean King was selected through a competitive Request for Proposals for the provision of housekeeping services for the Psychiatric Health Facility (PHF). Approval is requested to renew the agreement with Clean King to provide housekeeping for the PHF. The term of the agreement will begin July 1, 2014 and will terminate June 30, 2015. The maximum financial obligation under this agreement shall not exceed $50,218 – action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER. 3.05* Counseling Solutions - Counseling Solutions, a nonprofit agency established in 2002, provides mental health services to Butte County youth living in the foster care system. Counseling Solutions helps children, adults and families work through issues that cause barriers to healthy relationships. Approval is requested for an agreement with Counseling Solutions to provide mental health services to Medi-Cal eligible children. The term of this agreement is July 1, 2014 through June 30, 2015. The maximum financial obligation under this agreement shall not exceed $337,040 – action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER. 3.06* Debra Villasenor - Debra Villasenor provides a wide array of services associated with the identification, development and operation of housing for clients with serious mental illness who receive services through BCDBH. The housing services include: determining housing needs of BCDBH clients, identifying accessible housing, building partnerships with housing owners and property management firms to obtain more available units for BCDBH clients, developing plans for use of Mental Health Services Act housing funds, and ensuring compliance with reporting requirements of housing grants. Approval is requested to renew the agreement with Debra Villasenor. The term of the agreement is July 1, 2014 through June 30, 2015. The maximum financial obligation under this agreement shall not exceed $49,980 – action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER. 3.07* Thomas Lancaster, M.D. - Thomas Lancaster, M.D. provides services in the specialized field of psychiatry as required for adult clients at the BCDBH Oroville Outpatient Center, Gridley Outpatient Center, and participates in after-hours and on-call shifts on a rotating schedule at the Psychiatric Health Facility. Approval is requested for an agreement with Dr. Lancaster for these services. The term of this agreement is July 1, 2014 through June 30, 2015. The maximum financial obligation under this agreement shall not exceed $340,920 – action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER. 3.08* Gerald E. Maguire, M.D. - Gerald E. Maguire, M.D. provides services in the specialized field of psychiatry as required for adult clients at the BCDBH Paradise Treatment Center. Approval is requested for an agreement with Dr. Maguire for the provision of these services. The term of this agreement is July 1, 2014 through June 30, 2015. The maximum financial obligation under this agreement shall not exceed $40,500 – action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER. BUTTE COUNTY BOARD OF SUPERVISORS AGENDA – MAY 6, 2014 PAGE 4 May 6, 2014 3.09* MLN Consulting Services, Inc. - MLN Consulting Services provides State regulated monitoring and compliance evaluations for Driving Under the Influence (DUI) programs for multiple California counties. Approval is requested to renew the agreement with MLN Consulting Services to provide audits for the Prevention Education Program and Solutions for Positive Choices, Butte County's two DUI programs. Butte County receives a percentage of the fees collected from each DUI program to cover the State mandated monitoring costs. The term of this agreement is July 1, 2014 through June 30, 2015. The maximum financial obligation under this agreement shall not exceed $26,300 – action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER. 3.10* On Site Medical Services PA Corporation - On Site Medical Services PA Corporation conducts health histories and physical examinations for clients in the Butte County Psychiatric Health Facility. Examinations are conducted on a daily basis, seven (7) days a week, and within 24 hours of the client’s admission to the Psychiatric Health Facility as required by law. BCDBH requests approval of agreement with On Site Medical Services PA Corporation for the provision of physicals and medical evaluations. The term of this agreement is July 1, 2014 through June 30, 2015. The maximum financial obligation under this agreement shall not exceed $45,570 – action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER. 3.11* Summitview Child and Family Services, Inc. - Summitview is a private, nonprofit organization licensed by the State of California to provide a variety of mental health services to children and families. Approval is requested for an agreement with Summitview for these services. The term of this agreement is July 1, 2014 through June 30, 2015. The maximum financial obligation under this agreement shall not exceed $69,545.54 – action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER. 3.12* Valley Oak Children's Services, Inc. (VOCS) - VOCS is a private nonprofit agency serving Butte County. The agency’s primary function is to support, empower and advocate for children, families and child care providers through education, resources, and the promotion of quality child care services. VOCS provides support to licensed child care centers, family child care homes and informal child care providers on dealing with and managing children with challenging behaviors. Approval is requested for an agreement with VOCS to provide mental health services to full scope Medi-Cal children. The term of this agreement is July 1, 2014 through June 30, 2015. The maximum financial obligation under this agreement shall not exceed $56,780 – action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER. BUTTE COUNTY BOARD OF SUPERVISORS AGENDA – MAY 6, 2014 PAGE 5 May 6, 2014 3.13* Cash Advance for Butte County Department of Behavioral Health - In recent years, the BCDBH faced significant cash flow problems primarily due to slow reimbursements from the State. When the department became its own fund, it needed a cash advance to close the books at the end of a fiscal year. To improve cash flow, the department has continued to budget less expenditures than anticipated revenues and improved its billing process. Additionally, the department implemented a cash deficit reduction plan in fiscal year (FY) 2013-14 in an effort to further reduce the deficit. As of the end of March 2014, the cash deficit was approximately $5.1 million. In comparison to March 2013, this is an improvement of approximately $1.1 million over the cash deficit at that time which was $6.2 million. Due to continued volatility of State reimbursements, the department is requesting a cash advance of up to $8 million should this amount be necessary. The advance would come from available and appropriate restricted and non-restricted cash accounts. In the past, the Public Health realignment restricted cash accounts (Fund 0021 accounts 10117411, 10117421, 10117451 and 10117461) were the only accounts used. However, there is the potential, should the cash deficit reach the $8 million amount that other available and appropriate accounts will be drawn from. The department will transfer the cash advance back to the funds impacted at the beginning of FY 2014-15 – action requested - AUTHORIZE A CASH ADVANCE OF UP TO $8 MILLION FROM THE PUBLIC HEALTH REALIGNMENT RESTRICTED CASH ACCOUNTS (FUND 21 ACCOUNTS 10117411, 10117421, 10117451 AND 10117461) INTO THE BEHAVIORAL HEALTH FUND (FUND 22) UP TO THE AVAILABLE AMOUNT AND, IF NEEDED, AUTHORIZE A CASH ADVANCE FROM OTHER AVAILABLE AND APPROPRIATE RESTRICTED AND NON-RESTRICTED CASH ACCOUNTS UP TO THE TOTAL DEFICIT ON JUNE 30, 2014. 3.14* Resolution Recognizing May 2014 as Mental Health Awareness Month - action requested - ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. CHIEF ADMINISTRATIVE OFFICE 3.15* Adoption of Ordinance Regarding Compensation of Members of the Board of Supervisors - The salary of members of the Board of Supervisors (Board Members) is set by ordinance. The current ordinance, Ordinance No. 4025, specifies that each year the salary of each Board Member shall be increased by the percentage increase of the salary for judges, as specified in Government Code Section 68203, provided however, that the annual increase in the salary shall in no case exceed five (5) percent. The judges’ salaries, and therefore the Board Members' salaries, have not been increased since January 2007. Per a November 27, 2013 letter from the Judicial Council of California - Administrative Office of the Courts, judicial salaries are being increased 1.4% retroactive to July 1, 2013. Per County Ordinance, salary for Board Members will be increased 1.4% effective July 5, 2014. With the current annual salary set at $53,014, a 1.4% increase will increase the annual salary of Board Members by $742 to $53,756 per year. The ordinance to be introduced replaces Ordinance Numbers 4025 and 4039 to reflect the new annual salary of Board Members, as well as updates language to allow for changes to salaries at such time judges salaries are changed and not specifically on July 1st of any given year – action requested - ADOPT ORDINANCE AND AUTHORIZE THE CHAIR TO SIGN. BUTTE COUNTY BOARD OF SUPERVISORS AGENDA – MAY 6, 2014 PAGE 6 May 6, 2014 CHILD SUPPORT SERVICES 3.16* Butte County Child Support Services and Butte County Office of the District Attorney Memorandum of Understanding (MOU) for Investigative Services and Process Services - Title IV-D of the Social Security Act mandated all states establish a program to locate noncustodial parents, establish paternity, establish and enforce child support obligations, and collect, distribute, and disburse support payments. Federal regulations, codified in Part 300 of 45 Code of Federal Regulations, further delineated the specific responsibilities of the Federal, State, and local governments. The purpose of this MOU is to coordinate each department’s respective roles and to delineate their responsibilities for carrying out the requirements of Title IV-D of the Social Security Act and all Federal and State regulations and requirements promulgated there under. Butte County Department of Child Support Services requests approval of the department's MOU with the Butte County Office of the District Attorney. The MOU is for Investigative and Process Services. The term of this MOU is July 1, 2014 through June 30, 2015. The financial obligation under this MOU shall not exceed $254,382 – action requested - APPROVE THE MOU AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER. DISTRICT ATTORNEY 3.17* Budget Adjustment - Approval is requested for a budget adjustment for the Memorandum of Understanding - Enhanced Victim Restitution Collection and Disbursement Pilot Program which was approved by the Board of Supervisors at the February 25, 2014 Board meeting. There was an oversight in that the Budgetary Adjustment Worksheet was not prepared. The adjustment transfers $17,958.37 from Unclaimed Victim Restitution funds from the Treasurer Tax Collector’s budget to the District Attorney’s budget – action requested - APPROVE BUDGET ADJUSTMENT. (4/5 vote required) 3.18* Authorize a 3rd Party Partnership Revenue Contract for the Sale of Paving Equipment as Ordered by the Butte County Superior Court - The Superior Court of California, County of Butte, Criminal Court ordered paving equipment into receivership with the District Attorney and directed the District Attorney to sell the equipment at fair market value. A contract with Ritchie Brothers Auctioneers, whose business is the auction of large construction equipment, should be authorized. The assets are set for the auction to be held on June 4, 2014 at the auction site in Dunnigan, California – action requested - AUTHORIZE A CONTRACT WITH RITCHIE BROTHERS AUCTIONEERS TO SELL PAVING EQUIPMENT AS ORDERED BY THE SUPERIOR COURT, COUNTY OF BUTTE, CRIMINAL COURT. 3.19* Request Relief of Accountability - Approval is requested for relief of accountability for two (2) RFID (Radio Frequency Identification) wands. The wands were purchased in 2008 in the amount of $5,851.86 each with a File Tracking System using RFID tags. The Butte County District Attorney’s office had not been using the wands for several years because of an improvement change to the system. Unexpectedly, the Marin County District Attorney's Office (MCDA) needed to replace two broken wands and made a request to purchase both wands. MCDA indicated they needed the wands as quickly as possible because they relied on the wands as a component of their system. The wands were sold to the MCDA for an amount of $1,500 each. After making the sale and transferring the items to MCDA, the BCDA realized that because of the original price of the items, Board of Supervisors approval was needed to sell the capital assets. A check from MCDA in the amount of $3,000 is in the possession of the BCDA but not yet deposited – action requested - GRANT RELIEF OF ACCOUNTABILITY. BUTTE COUNTY BOARD OF SUPERVISORS AGENDA – MAY 6, 2014 PAGE 7 May 6, 2014 EMPLOYMENT AND SOCIAL SERVICES 3.20* Agreement Between DESS and California SAWS Consortium (CIV) Joint Powers Authority for the Provision of a Fully Functional Site at Feather River Hospital - Approval is requested for an agreement with the CIV Joint Powers Authority for the provision of a one-time installation and ongoing production maintenance for the Feather River Hospital remote site to become a fully functional C-IV site. The agreement will allow County staff to use all aspects of the C-IV system including scanning documents and accessing data at the Feather River Hospital. This will increase efficiency, providing our customers better service and enabling the hospital to be paid for Medi-Cal services provided in a timely manner. The term of the agreement shall be May 1, 2014 through October 31, 2019 with a maximum financial obligation of $125,310 ($35,615 FY 2013-14; $16,559 FY 2014-15; $16,559 FY 2015-16; $16,559; FY 2016-17; $16,559 FY 2017-18; $16,559 FY 2018-19; and $16,900 FY 2019-20) – action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR-CONTROLLER. 3.21* Amendment One to Agreement with Northern California Youth and Family Programs for the Provision of the Transitional Housing Placement - Plus Program - Approval is requested for an agreement amendment with Northern California Youth and Family Programs to be one (1) of two (2) providers of the Transitional Housing Placement – Plus (THP-Plus) Program, including providing the Independent Living Program Services Oversight of THP- Plus participants. The agreement is being amended to expand THP - Plus services to add an additional component of the program for youth who exited foster care between the ages of 17 years and 17 years, 11 months and are not eligible for Extended Foster Care placement services and would otherwise be homeless. The additional service component is referred to as THP - Plus - Connections. The THP - Plus Program was established by the California State Legislature in 2001 and provides affordable housing and comprehensive supportive services for up to 24 months to help former foster care and probation youth, ages 18 to 24, make the successful transition from foster care, or other out of home placement, to independent living. The term of the agreement remains July 1, 2013 through June 30, 2015. The maximum payable for the agreement is $527,603 (Broken down as follows: FY 2013-14: $244,115 - an increase of $7,875 and FY 2014-15: $283,488 - an increase of $47,248) – action requested - APPROVE AGREEMENT AMENDMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR- CONTROLLER. BUTTE COUNTY BOARD OF SUPERVISORS AGENDA – MAY 6, 2014 PAGE 8 May 6, 2014 3.22* Amendment One to Agreement with Youth For Change for the Provision of the Transitional Housing Placement – Plus Program - Approval is requested for an agreement amendment with Youth for Change to be one (1) of two (2) providers of the Transitional Housing Placement – Plus (THP-Plus) Program. The agreement is being amended to expand THP - Plus services to add an additional component of the program for youth who exited foster care between the ages of 17 years and 17 years, 11 months and are not eligible for Extended Foster Care placement services and would otherwise be homeless. FIRE 3.23* HR 1424 Secure Rural Schools and Community Self-Determination Act of 2000 (Federal Fire Safe Funding) FY 10-11 Project Authorization, Amendment – Change Termination Date - The Fire Department would like to amend Contract X18618 between the County of Butte and the Butte County Fire Safe Council. The contract has a termination date of June 30, 2014. The amendment will change the termination date to June 30, 2016. The original contract was brought to the Board in 2010-11 and is funded for projects under the Secure Rural Schools and Community Self-Determination Act of 2000 (HR1424). Not all of the projects have been completed, therefore an amendment to extend the termination date is needed – action requested - APPROVE AND SIGN CONTRACT AMENDMENT #2 TO AMEND TERMINATION DATE TO JUNE 30, 2016 SUBJECT TO REVIEW BY AUDITOR-CONTROLLER. 3.24* HR 1424 Secure Rural Schools and Community Self-Determination Act of 2000 (Federal Fire Safe Funding) FY 11-12 Project Authorization, Amendment – Change Termination Date - The Fire Department would like to amend Contract X19149 between the County of Butte and the Butte County Fire Safe Council. The contract has a termination date of June 30, 2014. The amendment will change the termination date to June 30, 2016. The original contract was brought to the Board in 2011-12 and is funded for projects under the Secure Rural Schools and Community Self-Determination Act of 2000 (HR1424). Not all the projects have been completed, therefore an amendment to extend the termination date is needed – action requested - APPROVE AND SIGN CONTRACT (X19149) AMENDMENT #2 TO AMEND TERMINATION DATE TO JUNE 30, 2016 SUBJECT TO REVIEW BY AUDITOR- CONTROLLER. BUTTE COUNTY BOARD OF SUPERVISORS AGENDA – MAY 6, 2014 PAGE 9 May 6, 2014 GENERAL SERVICES 3.25* Contract Award: ADA Construction Services, Inc. for the Remodel of 560 Cohasset - As identified in the Capital Improvement Program, several of the Chico-based Behavioral Health programs will, over the next several years, centralize into the 560 Cohasset facility. The next phase of this transition is to relocate the Chico Prevention Program from 260 Cohasset to the centralized facility. General Services published the Invitation to Bid (IFB) 60-14 in the local contractors’ exchanges, plan rooms, and the County public purchase website to obtain bids for the tenant improvements necessary to accommodate the program within 560 Cohasset. The bid summary is as follows: 1) ADA Construction, Rocklin, CA - $213,000; 2) Billson Construction, Chico, CA - $217,941; 3) Holt Construction Inc., Chico, CA - $249,000; 4) Modern Building, Inc., Chico, CA - $259,940; 5) Legend Construction, Inc., Roseville, CA - $305,088. Staff recommends an award of contract for $213,000 to ADA Construction. The overall net savings in lease payments, after tenant improvements, is estimated to exceed $220,000 over the anticipated 20-year occupancy. The funds are included within the FY 2013-14 budget and no additional appropriation is required. The fully documented specification files are available for review in the General Services Office – action requested – 1) APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN; AND 2) APPOINT THE GENERAL SERVICES DIRECTOR AS THE OFFICER OF THE PROJECT. HUMAN RESOURCES 3.26* Side Letter with Butte County Employees Association-Social Services Workers Unit (BCEA- SSW) - Approval is requested for a side letter agreement with BCEA-SSW on behalf of Kimberly Lamb. Ms. Lamb is employed by the Department of Employment and Social Services as an Employment Case Manager, Senior. Ms. Lamb has been offered and accepted a temporary position on the Interim Statewide Automated Welfare System (ISAWS) Migration Program (C-IV) Team to provide services to the State, while maintaining her employment status with the County of Butte. This assignment is consistent with the Memorandum of Understanding between the California Statewide Automated Welfare System Consortium IV and the County of Butte signed by the Board of Supervisors on June 9, 2009 – action requested - APPROVE SIDE LETTER AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. 3.27* Resolution to Amend the Salary Ordinance - The Department of Human Resources has prepared a resolution to amend the Salary Ordinance. These changes will leave the total allocations in the County unchanged. The following are the sections of the Salary Ordinance to be amended: General Services: The General Services Department is requesting to delete one (1) vacant position of Inventory/Warehouse Specialist or Inventory/Warehouse Specialist, Senior and add one (1) flexibly staffed position of Contracts Procurement Agent/Contracts Procurement Agent, Associate. This change will provide the department with staffing to meet current operational needs, improved services and a more balanced workload within the department. Any increase in costs associated with this change will be fully offset by the reduction in Extra Help hours resulting from this change. During the process of migrating to the new Integrated Library System (ILS), it has become apparent that significant additional staff time will be required in order to generate the reports necessary to migrate the existing data to the new ILS. Library staff requests that all branches of the library be permitted to remain closed on Sunday, May 18, 2014, so that library staff may generate the necessary reports in order to have the new ILS functioning by Monday, May 19. The resolution presented for adoption incorporates previous Board actions approved on February 11, 2014 – action requested - ADOPT THE RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. PROBATION 3.29* Anti-Drug Abuse (ADA) Enforcement Team Program Operation Agreement Approval - The California Board of State and Community Corrections, which administers the Federal Edward Byrne Memorial Justice Assistance Grant (JAG), has awarded Butte County $130,663 for the award period October 1, 2013 through September 30, 2014. The funds will be used toward staffing and support costs associated with the Butte Interagency Narcotics Task Force (BINTF). Previous Board approval on December 10, 2013 authorized the Chief Probation Officer to apply for the award, sign all grant documents, and administer the grant. Board approval is requested for an operational agreement between the Butte County Probation Department, the Butte County Sheriff, and the Butte County District Attorney, to work toward the goal of providing maximum available assistance for ADA Enforcement Team Program services in Butte County. $85,500 of the amount awarded will be reimbursed to the Butte County Sheriff for clerical services provided, and $14,000 will be reimbursed to the District Attorney for Evidence Technician services. The remaining $31,163 will be used by the Probation Department for program support costs. All necessary appropriations were included in the current year participating departments’ approved budget – action requested - APPROVE THE OPERATIONAL AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN, SUBJECT TO COUNTY COUNSEL AND AUDITOR CONTROLLER. BUTTE COUNTY BOARD OF SUPERVISORS AGENDA – MAY 6, 2014 PAGE 11 May 6, 2014 PUBLIC HEALTH 3.30* Revision of Public Health Permits Ordinance (18A) and Adoption of Retail Food Facility Placarding Ordinance (18B) to Implement Retail Food Facility Color-Coded Placarding Program - Rating the level of food safety at retail food facilities, and providing the information to the public using grades or colored placards, has been shown in jurisdictions where rating systems have been adopted to promote public health by reducing the occurrence of food borne illness. Rating systems for retail food facilities are popular with the public and supported by the retail food industry in jurisdictions where rating systems have been established. The Butte County Food Safety Advisory Group reviewed both the grading and the placarding rating systems and determined that a placarding program following the Sacramento County model would be best suited to meet the needs of Butte County residents. A placarding program proposal was developed and shared with the retail food industry and with the general public in a series of regional workshops and by information provided on the department's website. Opinion surveys provided at all the workshops and on the department's website indicated strong support by both the retail food industry and the general public for the placarding proposal. The proposal was taken to the Board of Supervisors on December 10, 2013 and the Board directed the department to return with an ordinance to implement the placarding program as presented. The department returned to the Board on April 22, 2014 with: (a) A proposed modification of the Public Health Permits Ordinance (BCC 18A), (b) A proposed new Retail Food Facility Placarding Ordinance (BCC 18B), and (c) A Board resolution describing key elements of the proposed placarding program. At that time, the Board waived the first reading of the two ordinances and adopted the resolution – action requested – 1) ADOPT REVISED PUBLIC HEALTH PERMIT ORDINANCE (BCC 18A) AND AUTHORIZE THE CHAIR TO SIGN; AND 2) ADOPT NEW RETAIL FOOD FACILITY PLACARDING ORDINANCE (BCC 18B) AND AUTHORIZE THE CHAIR TO SIGN. PUBLIC WORKS 3.31* Authorization to Award Project to the Lowest Responsive and Responsible Bidder for the 2014 Slurry Seal Project - The 2014 Slurry Seal project of various roads in the Thermalito and Oroville areas was authorized for advertisement at the March 25, 2014 Board of Supervisors meeting. Cape seals are a combination of a chip seal plus a slurry seal. Public Works crews will place the initial chip seal portion of the cape seal on the roads. The slurry seal that will be placed over the chip seal can be completed most efficiently by a private contractor. The County received a total of six (6) bids for the project, which were opened on April 15, 2014. The low bidder was Windsor Fuel Company of Pittsburg, CA. The low bid amount was $172,320. The bid amount from Windsor Fuel Company was 19.36% below the engineers estimate of $213,700 – action requested - AWARD THE CONTRACT TO THE LOWEST RESPONSIBLE AND RESPONSIVE BIDDER AND AUTHORIZE THE DIRECTOR OF PUBLIC WORKS TO EXECUTE SUBJECT TO REVIEW BY COUNTY COUNSEL AND AUDITOR- CONTROLLER. BUTTE COUNTY BOARD OF SUPERVISORS AGENDA – MAY 6, 2014 PAGE 12 May 6, 2014 3.32* Authorization to Advertise - Durham Dayton Highway Sidewalk Rehabilitation - During the fall of 2013, the Durham Rotary Club approached the Public Works Department to see if they could donate funds for improvements to a section of sidewalk as one of its projects. The sidewalk in question is on Durham Dayton Highway between Putney Drive and the Durham Elementary parking lot. Each winter, the sidewalk has standing water on it whenever it rains, thus causing problems for pedestrians and especially school children going to and from school. Upon review, the department determined that in order to prevent the drainage problems with the new sidewalk or other adjacent facilities, it would be necessary to install approximately 146 linear feet of curb and gutter along this section of road to control drainage, as well as an accessible ramp for the school crosswalk crossing Durham Dayton Highway to Holland Ave. The department also determined the need to replace the two (2) existing accessible ramps at the corners of Putney Drive that do not meet current ADA standards. Durham Rotary is donating $3,000 for the new sidewalk and will be asking the community for additional donations with a goal of raising another $3,000. Durham Rotary also asked Northstar Engineering to donate the project’s engineering design. Jay Lowe who is an Associate Civil Engineer with Northstar Engineering, lives in Durham and has children attending the Durham school system and he has volunteered his time to do the necessary design work – action requested - AUTHORIZE THE DIRECTOR OF PUBLIC WORKS TO ADVERTISE THE DURHAM DAYTON SIDEWALK REHABILITATION PROJECT. 3.33* Las Plumas Avenue Safe Routes to School (SRTS) Project for Oakdale Heights School, County Project No. 23501-2012-1, Federal Project No. SRTS-59(096) - It is requested that the Board of Supervisors adopt a resolution authorizing the Director of Public Works to negotiate and enter into agreements for the acquisition of real property, temporary construction easements, and permits to enter and construct improvements for the Las Plumas Avenue SRTS Project from Walmer Road to Crest Ridge Drive and on Walmer Road from Lincoln Boulevard to Rosedale Avenue for the benefit of the Oakdale Heights Elementary School. Construction is partially funded through a grant received from the federal SRTS Program and includes constructing curb, gutter, sidewalk, and pavement tie- in improvements along both sides of Las Plumas Avenue from Walmer Road to the Oakdale Heights School and on Walmer Road from Lincoln Boulevard to Rosedale Avenue. Also included are new pedestrian Americans with Disabilities (ADA) ramp improvements at all corners and crossings, new crosswalks, flashing pedestrian crossing signs, driver feedback signs, driveway and back of walk conforms, related drainage system improvements, hot mix asphalt pavement overlay, and replacement traffic striping spaning the entire project. Most of the construction work will take place in the existing right of way with newly acquired right of way being primarily necessary for enlarging several curb returns and utility relocations – action requested - ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. BUTTE COUNTY BOARD OF SUPERVISORS AGENDA – MAY 6, 2014 PAGE 13 May 6, 2014 SHERIFF- CORONER 3.34* Law Enforcement Memorial Week - May 11-17, 2014 is National Law Enforcement Memorial Week. A time to honor and remember those law enforcement officers who have died in the line of duty protecting their communities – action requested - ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. 3.35* Budget Adjustment for State of California, Off-Highway Motor Vehicle Recreation (OHMVR) Grant - On April 22, 2014, the Board of Supervisors accepted the Butte County Sheriff's Office request to accept a $22,897 grant from the State of California, Department of Parks and Recreation, Division of Off-Highway Motor Vehicle Recreation (OHMVR). The Sheriff’s Office will provide extra help and overtime uniformed deputy sheriffs year-round to patrol the Jonesville Snow Park and Butte Meadows utilizing snow mobiles and 4-wheel drive vehicles. Uniform law enforcement personnel will provide patrol shifts during high usage periods, especially holiday weekends, and as needed. The grant will be utilized for personnel costs, fuel and maintenance, first aid kits, and safety equipment. The grant requires a $7,860 match that will be met by utilizing Butte County Sheriff's Office personnel providing supervision of grant activities, financial oversight, as well as volunteer search and rescue (S&R) staff from the Butte County Search & Rescue when performing S&R missions. It is now requested that the Board approve a budget adjustment accepting and appropriating the grant funds – action requested - APPROVE BUDGET ADJUSTMENT. (4/5 vote required) WATER AND RESOURCE CONSERVATION 3.36* May 2014 Water and Watershed Awareness Month Resolution - California water agencies have celebrated May as Water Awareness Month since 1989. May brings warmer weather and an opportunity to remind us all to use water wisely inside and outside the home, especially in this dry year. The California Water Awareness Campaign is a year-long effort by organizations throughout California to heighten public awareness about the conservation, supply, quality, and distribution of water. Their "Nice Save!" public education campaign shows consumers the many ways to conserve water. The California Watershed Network launched California's first annual Watershed Awareness Month in May 2005. Throughout the month of May, volunteer community organizations, educators, and other groups are encouraged to promote the importance of watersheds at the grass-roots and community levels by organizing and conducting watershed awareness activities. In light of these statewide efforts, Butte County along with the Butte County Resource Conservation District and other local watershed groups and water agencies would like to join with others around the State to encourage wise water use and raise awareness for the health and management of our watersheds and water resources – action requested - ADOPT THE RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. BUTTE COUNTY BOARD OF SUPERVISORS AGENDA – MAY 6, 2014 PAGE 14 May 6, 2014 3.37* Resolution of Support for the April 14, 2014 Northern Sacramento Valley Integrated Regional Water Management Plan (NSVIRWMP) - In 2006, Butte County entered into a Memorandum of Understanding (MOU) with other counties within the northern Sacramento Valley to cooperate and share information on water-related issues that often cross over and between local jurisdictions. Over the years since the original MOU, there have been four 4) addendums to the MOU, which culminated in the counties of Butte, Colusa, Glenn, Tehama, Shasta and Sutter cooperating to form the Northern Sacramento Valley Regional Water Management Group. This group worked to seat a Board of Directors (NSV Board) with three (3) appointments by each of the six (6) counties to oversee the completion of the NSVIRWMP. This planning effort was funded through a Prop 84 funding grant in 2011. The draft plan was approved by the NSV Board on September 9, 2013 and released as the public draft. This version of the plan, supported by Butte County through resolution 13-136 was revised based on input from representatives from Glenn and Colusa Counties. A final IRWMP was unanimously supported by the NSV Board on April 14, 2014. Requested is the appointment of two (2) Board members to serve on the policy council for this health assessment and improvement plan project. The term of appointment is for a period of three (3) years effective May 15, 2014. Meetings will occur approximately four (4) to six (6) times a year. Comprised of community leaders throughout the area, the council’s charge will be to provide overall project guidance, feedback, and oversight for participating partners and county residents – action requested - APPOINT TWO (2) BOARD MEMBERS TO SERVE ON THE POLICY COUNCIL FOR A COUNTY-WIDE COMMUNITY HEALTH ASSESSMENT AND IMPROVEMENT PLAN PROJECT. Approval is requested for an amendment with YFC for the Master Lease and Transitional Aged Youth (TAY) Mobile Housing Programs. The amendment would add funding to the TAY mobile housing program, providing additional housing options to this population. The term of the agreement will remain July 1, 2013 through June 30, 2014. (Behavioral Health) 4.06* Resolution Recognizing May 2014 as Building Safety Month and Amnesty Program for May and June 2014 - The Building Safety Month (May 2014) and the Permit Amnesty Program (through June 30, 2014) are aimed at protecting public health, home/business owners’ safety, and the environment by encouraging property owners to complete the County’s permit process. These efforts are designed to ensure construction meets acceptable standards and to educate the public about building codes through outreach activities. The Amnesty Program provides property and business owners the opportunity to apply for permits for buildings, additions, and remodels not previously permitted with the following intended benefits: 1) The 60% investigative building permit penalty fees would not be imposed; and 2) Assignment of a staff member to assist the property owners through the application process. Compliance with the building permit process can assist those property owners that may have their properties on the market where the sale may be jeopardized due to unpermitted work. The desired standard shall be 300 feet, but may be adjusted to address unusual circumstances.*" Article 17, Agricultural Buffer Setbacks, in the Zoning Ordinance establishes the setback for dwellings within an agricultural buffer area at 300 feet from any property line that abuts Agriculture (Agriculture (AG) and Agriculture Services (AS)) (BCC §24-83) zones. The distance may be adjusted based upon an Unusual Circumstances Review (BCC §24-84). The recent processing of several applications for tentative parcel maps and a vesting tentative subdivision map on lands with a residential land use designation adjacent to existing operating agricultural uses (also located within this residential designation) requires Board direction on where the 300’ buffer should be applied when both proposed residential development and surrounding orchards exist in a residential land use designation (such as Very Low Density Residential [VLDR]). The Board granted the request and directed County staff to meet with the contractors and bring back the results of that meeting to the Board in one month. Public Works staff met with the contractors on April 10, 2014. In summary those requested changes are as follows: 1) Increase the lower limit for requiring a grading permit to either 250 or 500 cubic yards (CY); 2) Relaxed grading plan requirements for ministerial permits; 3) Use of over the counter permits for ministerial permits; 4) Increase of the defensible space distance; and 5) Increase of driveway length in the grading permit exemption for building permits. Meetings start at 9:00 a.m. and are held in the Board of Supervisors Chambers, County Administration Building, 25 County Center Drive, Oroville. At the end of each year the Board adopts a meeting schedule for the upcoming year. Meeting dates can be changed as a result of holidays or other events so please check the meeting calendar to be certain. Copies of the adopted meeting calendar for the year are available in the County Administrative Office or at the Clerk of the Board website at www.buttecounty.net/cob. Agenda Information: The agenda for every meeting of the Board is posted in front of the County Administration Building at least 72 hours before each meeting, and is available by mail subscription, e-mail subscription, or at the Clerk of the Board website. A copy of the agenda and supporting materials provided to the Board of Supervisors members to explain each agenda item (excluding documents that are not a public record within the meaning of the Public Records Act) are available for your review at the County Administrative Office, the Chico, Oroville, and Paradise libraries (please do not remove items from these files), and at the Clerk of the Board website. Copies of supporting materials can be made for you at a charge to cover costs. The list of communications included with the agenda packages is not comprehensive. Agenda Format and Meeting Order: The agenda is usually organized into the following areas and meetings generally proceed in the following order: 1. Consent Agenda: these are items that are considered routine and are handled by one motion and vote of the Board. If you wish to discuss any item on the Consent Agenda you can either fill out a speaker card (located in the back of the board room) and give it to the Clerk of the Board (sitting to the right of the Board) or, when the Chair asks if there is anything anyone would like to remove from the Consent Agenda, stand and approach the podium and request the item be removed. The removed items are discussed at the end of the Regular Agenda. 2. Regular Agenda: this is where presentations to the Board and items that require full discussion are heard. Items removed from the Consent Agenda are discussed under this section. 3. Public Hearing and Timed Items: this is where items that are required by law to be heard as a public hearing are set. This is the section where appeals before the Board are usually discussed. Hearings may start after the time listed, but will never start before the time listed. 4. Public Comment: this is the area of the agenda where members of the audience may address the Board on any matter not listed on the agenda. The Board, by law, cannot take action on any matter not listed on the agenda, but may respond to statements or questions and provide staff direction. 5. Closed Session: the Board is authorized, by law, to meet in a closed session in certain circumstances. This area of the agenda identifies those items that will be discussed during the closed session. Public Participation: It is the policy of the Board of Supervisors, and a requirement of the California Open Meetings Law, to allow members of the public the opportunity to comment on all matters before the Board. Public participation is limited to matters within the subject matter jurisdiction of the Board pursuant to Government Code Section 54954.3. The Board has adopted policy and procedures to facilitate the meeting process and conduct. A complete listing of these policies and procedures can be found in the printed booklet agenda, obtained at the County Administrative Office, or viewed at the Clerk of the Board website. The Board of Supervisors is also committed to making its proceedings accessible to all citizens.
