CORRECTIONS AND~OR CHANGES TO THE AGENDA. 3.00 CONSENT AGENDA BEHAVIORAL HEALTH 3.01 * Accept Donation - approval is requested to accept donation of $1,000 from the Cumming Foundation on behalf of the Ventura family. The donation will be used for the department's Chico Adult Drop-In Center - action requested - ACCEPT DONATIONS AND APPROVE BUDGET TRANSFER (4/5 vote required) ACCEPTING AND APPROPRIATING UNANTICIPATED FUNDS AS DETAILED IN THE AGENDA REPORT. 3.02 * Medical Billing Professionals - approval is requested for a sole source agreement with Medical Billing Professionals for the provision of Behavioral Health Information System Consultation, System Configuration, and training. The term of the agreement is July 1, 2008 through June 30, 2009 with a maximum amount payable of $60,000 - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 3.03 * Youth for Change - amendment - approval is requested for an amendment to the agreement with Youth for Change for the provision of services associated with the Mental Health Services Act (MHSA) Link Program. The amendment increases the maximum amount payable by $95,973 (department budget) - action requested - APPROVE AGREEMENT AMENDMENT AND AUTHORIZE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR- CONTROLLER. The term of the agreement is July 1, 2008 through December 31, 2008 with a maximum amount payable of $40,500 (department budget) - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 3.05 * Henry Ganzler, Ph.D. - approval is requested for a sole source agreement with Henry Ganzler, Ph.D. for the provision of psychology services for youth clients. The term of the agreement is for July 1, 2008 through June 30, 2009 with a maximum amount payable of $39,377.07 - action requested - APPROVE AGREEMENT AND AUTHORIZE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 3.06 * Butte County Probation Department - amendment - approval is requested for an amendment to the agreement with Probation for the provision of the Family Bridges program which is designed to prevent juvenile criminal behavior among at-risk youth. The amendment extends the term of the agreement through September 30, 2008 in order to begin the process to reassign open cases and end the program. The amendment increases the maximum amount payable by $51,687 - action requested - APPROVE AGREEMENT AMENDMENT AND AUTHORIZE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 3.07 * Butte County Probation Department - approval is requested for an agreement with Probation for the Connecting Circles of Care program which serves severely emotionally and behaviorally disturbed children and their families. The term of the agreement is July 1, 2008 through June 30, 2009 with a maximum amount payable of $77,179 - action requested - APPROVE AGREEMENT AND AUTHORIZE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 3.08 * Skyway House - approval is requested for a sole source agreement with Skyway House for the provision of Long- Term Residential Recovery Services, Day Care Habilitative Services, and the Alcohol and Drug Free Housing for eligible residents referred by the department. The term of the agreement is July 1, 2008 through June 30, 2009 with a maximum amount payable of $108,788.93 - action requested - APPROVE AGREEMENT AND AUTHORIZE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. The term of the agreement is July 1, 2008 through June 30, 2009 with a maximum amount payable of $91,399.70 - action requested - APPROVE AGREEMENT AND AUTHORIZE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 3.10 * Youth For Change - approval is requested for a sole source agreement with Youth For Change for the provision of specialty mental health services, day treatment, medication support services, crisis intervention and case management to youth clients and their families with full scope Medi-Cal. The term of the agreement is July 1, 2008 through June 30, 2009 with a maximum amount payable of $1,989,172.89 (department budget) - action requested - APPROVE AGREEMENT AND AUTHORIZE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 3.11 * Counseling Solutions - amendment - approval is requested for an amendment to this agreement for the provision of mental health services to children with full scope Medi-Cal from Butte County who meet the criteria of medical necessity. The amendment increases the maximum amount payable by $23,287.60 - action requested - APPROVE AGREEMENT AMENDMENT AND AUTHORIZE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 3.12 * Windsor Healthcare, LLC - approval is requested for a sole source agreement with Windsor Healthcare, LLC for the provision of meals for patients at the Psychiatric Health Facility. The term of the agreement is July 1, 2008 through June 30, 2009 with a maximum amount payable of $51,254 - action requested - APPROVE AGREEMENT AND AUTHORIZE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 3.13 * Feather River Tribal Health, Inc.- approval is requested for a sole source agreement with Feather River Tribal Health, Inc. They provide mental health services to full scope Medi-Cal children from Butte County who meet the criteria of medical necessity. The term of the agreement is July 1, 2008 through June 30, 2009 with a maximum amount payable of $359,567.61 (department budget) - action requested - APPROVE AGREEMENT AND AUTHORIZE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. PAGE 3 JULY 22, 2008 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA -JULY 22, 2008 CHIEF ADMINISTRATIVE OFFICE 3.14 * Resolution Recognizing the Continuing Existence of Local Emergency Declarations - approval is requested for a resolution recognizing the continuance of the local emergency declarations for the June 2008 Firestorm (Ophir-Humboldt fires) which began on June 10, 2008, and the June 2008 Butte Lightning Complex which began on June 21, 2008 - action requested - ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. 3.15 * Northern Valley Claims and Investigative Services - approval is requested for a sole source agreement with Northern Valley Claims and Investigative Services for the provision of investigating liability claims filed against the County. The term of the agreement is July 1, 2008 through July 1, 2009 with a maximum amount payable of $33,000 - action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. 3.16 * Ratify Letter in Support of Senate Bill (SB) 1407 - approval is requested for ratification of a letter sent to State Senator Perata supporting SB 1407 which would provide $5 billion over the next four years to build court facilities in California - action requested - RATIFY LETTER. CLERK-RECORDER ELECTIONS 3.17 * Requests for Consolidation - Various Community Colleges and School Districts - resolutions and notices have been submitted ordering general district elections and requesting consolidation of the elections with the statewide General Election to be held November 4, 2008 for the following districts: Butte-Glenn Community College District, Yuba Community College District, Biggs Unified School District, Chico Unified School District, Durham Unified School District, Gridley Unified School District, Marysville Joint Unified School District, Paradise Unified School District, Oroville Union High School District, Bangor Union Elementary School District, Feather Falls Union Elementary School District, Golden Feather Union Elementary School District, Manzanita Elementary School District, Oroville City Elementary School District, Palermo Union School District, Pioneer Union Elementary School District, and Thermalito Union Elementary School District - action requested - APPROVE CONSOLIDATIONS. PAGE 4 JULY 22, 2008 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA -JULY 22, 2008 3.18 * Requests for Consolidation - Cities of Biggs, Chico, Gridley, and Oroville and Town of Paradise - resolutions have been submitted by the cities and town requesting consolidation of the General Municipal Election with the statewide General Election to be held on November 4, 2008 for the purpose of electing the following: 1) City of Biggs - three Councilmembers to serve 4-year terms and one Councilmember to serve a 2- year term; 2) City of Chico - four Councilmembers to serve 4-year terms; 3) City of Gridley - three Councilmembers to serve 4-year terms; 4) City of Oroville - three Councilmembers to serve 4-year terms; and 5) Town of Paradise - three Councilmembers to serve 4-year terms - action requested - APPROVE CONSOLIDATIONS. 3.19 * Requests for Consolidation - Special Districts - resolutions and notices have been submitted ordering general district elections and requesting consolidation of the elections with the statewide General Election to be held November 4, 2008 for the following Special Districts: El Medio Fire Protection District, Durham Irrigation District, Paradise Irrigation District, South Feather Water and Power Agency, Thermalito Water and Sewer District, Lake Oroville Area Public Utility District, Chico Area Recreation and Park District, Durham Recreation and Park District, Feather River Recreation and Park District, Paradise Recreation and Park District, and Richvale Recreation and Park District - action requested - APPROVE CONSOLIDATIONS. 3.20 * Request for Consolidation - Marysville Unified School District School Bond Measure - the District has submitted Resolution No. 2007-08/54 ordering a school bond election, establishing specifications of the election order, and requesting consolidation of the election with the statewide General Election to be held November 4, 2008 - action requested - APPROVE CONSOLIDATIONS. COUNTY COUNSEL 3.21 * David W. Kennedy - amendment - approval is requested for an amendment to the agreement with David W. Kennedy for the provision of specialized legal services to the Children's Services Division of the Department of Employment and Social Services. The amendment extends the term of the agreement through June 30, 2009 - action requested - APPROVE AGREEMENT AMENDMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. Chaffin (Martin Marietta) - On January 23, 2007, the Board approved the tentative cancellation of the LCA agreement on a portion of the contracted area subject to meeting certain conditions. These conditions have been satisfied - action requested - FIND THAT THE FIVE REQUIRED CONDITIONS HAVE BEEN SATISFIED; AND AUTHORIZE THE CLERK OF THE BOARD TO SIGN AND RECORD THE FINAL CERTIFICATE OF CANCELLATION FOR A 175-ACRE PORTION OF THE LCA AGREEMENT. DISTRICT ATTORNEY 3.23 * Anderson and Associates - amendment - approval is requested for an amendment to the agreement with Anderson and Associates for the provision of temporary clerical workers. The amendment extends the term of the agreement to June 30, 2009 and increases the maximum amount payable by $20,000 (department budget) - action requested -APPROVE AGREEMENT AMENDMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. (Contract No. X15746) EMPLOYMENT AND SOCIAL SERVICES 3.24 * Addus Healthcare, Inc. - amendment - approval is requested for an amendment with Addus Healthcare, Inc. for the provision of In-Home Supportive Services to Butte County clients. The amendment extends the term of the agreement through June 30, 2009 and increases the maximum amount payable by $2,859,628.80 (department budget) - action requested - APPROVE AGREEMENT AMENDMENT AND AUTHORIZE THE CHAIR TO SIGN SUBJECT TO REVIEW BY COUNTY COUNSEL AND THE AUDITOR-CONTROLLER. (Contract X17119). 3.25 * Butte-Glenn Community College District - amendment - approval is requested for an amendment with Butte-Glenn Community College District for the provision of Vocational English as a Second Language Program (VESL) for CalWORKS welfare-to-work participants. DEVELOPMENT SERVICES - The Development Services Department is requesting to delete the following vacant positions: two (2) positions of Office Specialist, Senior or Office Specialist or Office Assistant (Class Codes 1055/1056/1057), two (2) positions of Planner, Assistant or Planner, Associate or Planner, Senior (Class Codes 3106/3105/3104), one (1) position of Building Inspector, Senior or Building Inspector (Class Codes 3309/3308), one (1) position of Building Plans Examiner or Building Inspector (Class Codes 3306/3308). These changes to be effective July 1, 2008. PROBATION - The Probation Department is requesting to delete one (1) vacant position of Probation Officer I, II, III (Class Codes 5515/5514/5513) with a sunset date of June 30, 2008, one (1) vacant position of Probation Officer I, II, III PAGE to JULY 22, 2008 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA -JULY 22, 2008 (Class Codes 5515/5514/5513) and one (1) vacant position of Accountant (Class Code 1043) with a sunset date of June 30, 2008. Meetings start at 9:00 a.m. and are held in the Board of Supervisors Chambers, County Administration Building, 25 County Center Drive, Oroville. At the end of each year the Board adopts a meeting schedule for the upcoming year. Meeting dates can be changed as a result of holidays or other events so please check the meeting calendar to be certain. Agenda Information: The agenda for every meeting of the Board is posted in front of the County Administration Building at least 72 hours before each meeting, and is available by mail subscription, e-mail subscription, or at the Clerk of the Board website. Agenda Format and Meeting Order: The agenda is usually organized into the following areas and meetings generally proceed in the following order: 1. If you wish to discuss any item on the Consent Agenda you can either fill out a speaker card (located in the back of the board room) and give it to the Clerk of the Board (sitting to the right of the Board) or, when the Chair asks if there is anything anyone would like to remove from the ConsentAgenda, stand and approach the podium and request the item be removed. The removed items are discussed at the end of the Regular Agenda. 2. Regular Agenda: this is where presentations to the Board and items that require full discussion are heard. Items removed from the Consent Agenda are discussed under this section. 3. Public Hearing and Timed Items: this is where items that are required by law to be heard as a public hearing are set. This is the section where appeals before the Board are usually discussed. Hearings may start after the time listed, but will never start before the time listed. 4. Public Comment: this is the area of the agenda where members of the audience may address the Board on any matter not listed on the agenda. The Board, by law, cannot take action on any matter not listed on the agenda, but may respond to statements or questions and provide staff direction. 5. Closed Session: the Board is authorized, by law, to meet in a closed session in certain circumstances. This area ofthe agenda identifies those items that will be discussed during the closed session. Public Participation: It is the policy of the Board of Supervisors, and a requirement of the California Open Meetings Law, to allow members of the public the opportunity to comment on all matters before the Board.
