3.01 Agreement Amendment with Aurora Behavioral Healthcare for Managed Care Inpatient Hospital
Placement-Aurora Behavioral Healthcare provides inpatient psychiatric hospitalization services.
The State mandates contracting with managed care hospitals based on a county's historical
utilization. The Department of Behavioral Health recommends amending the agreement with
Aurora Behavioral Healthcare to cover an unanticipated increase of client referrals. The
amendment increases the maximum payable amount by $350,000, not-to-exceed $1,050,000
($700,000 for fiscal year(FY) 2017-18, and$350,000 for FY 2018-19). All other terms remain the
same—APPROVE AGREEMENT AMENDMENT AND AUTHORIZE THE CHAIR TO SIGN. (Behavioral

3.02 Grant Agreement with Department of Housing and Urban Development (HUD) for LINK
Permanent Housing Bonus Program -The Department of Behavioral Health has been awarded
the LINK Permanent Housing Bonus Grant from HUD for FY 2018-19. Funds from this grant will
be used to contract with the Housing Authority of the County of Butte to lease three units of
housing for chronically homeless individuals diagnosed as being mentally ill and/or having a
substance use disorder.This housing will assist their transition from homelessness to permanent
housing and enable them to live as independently as possible. The Department recommends
entering into an agreement with HUD to receive the grant funding. The term of the agreement
is July 1, 2018 through June 30, 2019, not-to-exceed $27,591 — action requested - APPROVE

3.03 Grant Agreement with Department of Housing and Urban Development (HUD) for SEARCH
Samaritan Bonus Housing Program —The Department of Behavioral Health has been awarded
the SEARCH Samaritan Bonus Housing Program grant from HUD for FY 2018-19. Funds from this
grant will be used to contract with the Housing Authority of the County of Butte to lease four
units of housing for chronically homeless individuals diagnosed as being mentally ill and/or
having a substance use disorder. This housing will assist their transition from homelessness to
permanent housing and enable them to live as independently as possible. The Department
recommends entering into an agreement with HUD to receive the grant funding.The term of the
agreement is July 1, 2018 through June 30, 2019, not-to-exceed $36,617 — action requested -

3.07 Agreement Amendment with Mountain Valley Child and Family Services, Inc. (Mountain Valley
CFS) for Mental Health Services - Mountain Valley Child and Family Services, Inc. is a residential
treatment facility that has been serving children and adolescents since 1968.The Department of
Behavioral Health recommends amending the agreement with Mountain Valley CFS to cover an
unanticipated increase in services.The amendment increases the maximum payable amount by
$39,524, not-to-exceed$79,502.All other terms remain the same—action requested—APPROVE

3.08 Resolution Recognizing August 2018 as Child Support Awareness Month - The Department of
Child Support Services recommends the Board of Supervisors adopt a resolution recognizing

3.09 City of Oroville Requests Consolidation of General Municipal Election with the November 6, 2018
General Election - The Oroville City Council submits Resolution No. 8720 calling for a General
Municipal Election and requesting the Board of Supervisors to consolidate said election with the
November 6, 2018 Statewide General Election. The purpose of consolidating this municipal
election is to elect one (1) Mayor, three (3) Members of the City Council, and one (1) City
Treasurer each serving a term of four Years — action requested - APPROVE CONSOLIDATION.

3.10 Marysville Joint Unified School District Requests Consolidation of Measure on Ballot - The
Marysville Joint Unified School District Board of Education submits Resolution No. 2018-19/07
ordering a special school bond election, establishing specifications of the election order, and
requesting consolidation of the election with the Statewide General Election to be held on
November 6, 2018, within the boundaries of the school district in Butte and Yuba Counties.The
special election calls for a school bond measure to be placed on the ballot. If approved by 55%
or more of the votes cast on the measure,the District shall be authorized to issue and sell bonds
in the amount of$74,000,000 to provide financing for specific school facilities projects—action

3.11 Approval of Minutes for Board of Supervisors Meeting-Submitted for approval are the minutes
for the JuIY 24, 2018 Board of Supervisors regular meeting—action requested—APPROVE BOARD
MINUTES FOR JULY 24, 2018 AND AUTHORIZE THE CHAIR TO SIGN. (County Administration)
3.12 Resolution for the Continuation of Local Disaster Proclamation Due to the Cherokee and La Porte
Fires-A local emergency presently exists in Butte County due to the Cherokee and La Porte fires
in accordance with the proclamation made by the Chief Administrative Officer on October 9,
2017, and reaffirmed and ratified by the Board of Supervisors on October 10, 2017. The local
disaster proclamation enables the County to obtain State and federal dollars to help with the
recovery.The local emergency resulting from conditions of the Cherokee and La Porte fires is still
in effect as clean-up of the hazardous debris has not Yet been completed and a local health
emergency is in effect. State law requires that the Board of Supervisors review the need for
continuing the local emergency every 30 days. At this point, the final duration of the emergency
has not Yet been determined—action requested—1)CONFIRM THE NEED FOR CONTINUING THE
PROCLAMATION OF LOCAL CHEROKEE AND LA PORTE FIRE INCIDENT EMERGENCIES; AND 2)

3.13 Agency Response to Grand Jury -To comply with Penal Code sections 933 and 933.05, staff has
prepared a response on behalf of the Board of Supervisors to the findings and recommendations
contained in the 2017-18 Grand Jury Report. Staff recommends that the Board approve the
response provided in the staff report for submittal to the Presiding Judge of the Superior Court
of California,County of Butte.Alternatively,the Board can direct staff to make specified changes
to the response, and a revised response can be submitted to the Presiding Judge — action

3.14 Accept 2018 Local Agency Conflict of Interest Code Biennial Notices for Agencies that File Form
700s with the Clerk of the Board-The following agencies have reviewed their Conflict of Interest
Codes pursuant to California Government Code section 87306.5(b) and have determined that
their agency's code is current and in no need of revision. County Counsel has reviewed the 2018
Local Agency Biennial Notices provided in the staff report and believes them to be proper:
Housing Authority of the County of Butte, Butte County Indian Gaming Local Benefit Committee,
Gridley Biggs Cemetery District, Butte County Law Library Board of Trustees, Kimshew Cemetery
District, Butte County Parole Board, Oroville Cemetery District, Butte Creek Drainage District,
Paradise Charter Middle School, Durham Mosquito Abatement District, Sacramento River
Reclamation District, First 5 Butte County Children and Families Commission, and Thermalito

3.15 Federal Equitable Sharing Agreement and Certification - The District Attorney's Office
participates in the Federal Equitable Sharing Program, which is designed to supplement and
enhance local agency resources from the proceeds of forfeited assets. An Equitable Sharing
Agreement and Certification is required annually to be filed with the U.S. Department of Justice.
The report for FY 2017-18 has been prepared and summarizes program revenues and
distributions. In FY 2017-18,funds were used to purchase computer software and equipment for
the Department's case management system — action requested - APPROVE THE EQUITABLE

3.16 Capital Asset Purchase - Type VI Fire Engines - The Fire Department recommends approval to
purchase two Type VI engines for Company 21 Cohasset Volunteer Fire Company and Company
52 Feather Falls Volunteer Fire Company. Fire stations located in the foothills are often
dispatched into the more remote areas of the County,where larger fire apparatus have difficulty
reaching. Type VI fire engines are built on pickup truck chassis, and hold 300 gallons of water.
This purchase is funded with Community Cost Share Fund (funds from the rental of County fire
engines by the State on wildland fires), and the Water Tender Fund (funds from the rental of
water tenders by the State on wildland fires). The total cost of the two Type VI is $456,485 —
action requested — 1) APPROVE CAPITAL ASSET PURCHASES (2); AND 2) APPROVE BUDGET
ADJUSTMENT(4/5 VOTE REQUIRED). (Fire)
3.17 Contract with Scott Gibson Architect, Inc. for Tenant Improvement Design for Behavioral Health
in Paradise—The General Services Department recommends entering into a contract with Scott
Gibson Architect, Inc. for the design of tenant improvements at 7126 Skyway in Paradise. The
term of the contract is upon notice to proceed through 180 days, not-to-exceed $38,300. The
Department is currently negotiating the lease of 7126 Skyway in Paradise for the Department of
Behavioral Health for the provision of Adult Services. Funding is included in the budget—action
requested—1)APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN; AND 2)APPOINT THE
GENERAL SERVICES DIRECTOR AS THE OFFICER OF THE PROJECT. (General Services)

3.18 Resolution to Amend the Salary Ordinance -On July 24, 2018, the Board of Supervisors adopted
the FY 2018-19 budget. Included in the budget were a number of position changes. The
Department of Human Resources has prepared a resolution to amend the Salary Ordinance to
make the changes identified in the Adopted Budget.The following are the sections of the Salary
Ordinance to be amended:
• DEPARTMENT OF AGRICULTURE: Add 1 flexibly staffed Agriculture Biologist/Weights and
Measures Inspector.
• ASSESSOR'S OFFICE: Delete 1 Assessment Clerk.
• DEPARTMENT OF BEHAVIORAL HEALTH: Delete a 0.50 flexibly staffed Behavioral Health
Clinician and add 1 flexibly staffed Information Systems Analyst.
• DEPARTMENT OF CHILD SUPPORT SERVICES: Delete 1 Supervisor, Support Services.
• DEPARTMENT OF DEVELOPMENT SERVICES: Delete 1 Planner, Principal.
• DISTRICT ATTORNEY'S OFFICE: Delete 1 flexibly staffed Legal Secretary.
• DEPARTMENT OF EMPLOYMENT AND SOCIAL SERVICES: Delete 27 Employment and
Eligibility Specialists, 1 flexibly staffed Employment Case Manager, 1 Employment and
Eligibility Program Specialist, 1 Employment and Eligibility Program Specialist (delete
effective October 1, 2018), 4 flexibly staffed Office Specialists, and 1 flexibly staffed
Revenue and Recovery Specialist.
• GENERAL SERVICES DEPARTMENT: Delete 1 flexibly staffed Administrative Analyst and 1
Courier.
• DEPARTMENT OF HUMAN RESOURCES: Delete 1 flexibly staffed Administrative Assistant-C
and 2 flexibly staffed Human Resources Technicians.
• PROBATION DEPARTMENT: Delete 1 flexibly staffed Inventory Warehouse Specialist and 1
vacant flexibly staffed Office Specialist.Add 1 flexibly staffed Probation Officer.
• PUBLIC HEALTH DEPARTMENT: Delete 1 Clinic Manager, 1.5 flexibly staffed Administrative
Assistants, and 3 flexibly staffed Public Health Nurses.
• SHERIFF'S OFFICE: Delete 1 Community Relations Coordinator, 1 Sheriff's Warrant Officer,
2 flexibly staffed Sheriff's Clerk positions, 1 flexibly staffed Cook, and 1 Cook.

3.19 Contract Amendment with Accela, Inc. for EnvisionConnect Software - The Public Health
Department has a contract with Accela, Inc. for the licensed use, support and maintenance of
the EnvisionConnect Suite software. The software is utilized by the Environmental Health
Division for billing and project tracking. The software meets the requirements of California
environmental health agencies by staying in compliance with State regulations and laws. The
Department recommends amending the contract with Accela, Inc. to extend the term by five
years through May 31, 2023, and increase the maximum payable amount by $232,177, not-to-
exceed $380,454. All other terms remain the same — action requested —APPROVE CONTRACT
AMENDMENT AND AUTHORIZE THE CHAIR TO SIGN. (Public Health)
3.20 Grant Agreement with the California Department of Public Health for Tobacco Control Education
Funding-The California Department of Public Health has awarded grant funding in the amount
of$371,934 for the Tobacco Control Education Program. Funding for this program comes from
Proposition 99(the Tobacco Tax and Health Promotion Act of 1988)and Proposition 56(Cigarette
Tax to Fund Healthcare,Tobacco Use Prevention, Research and Law Enforcement).This funding
will allow the Public Health Department to continue to provide tobacco related education to the
community. The term of the funding is July 1, 2018 through June 30, 2019—action requested—
APPROVE GRANT AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Public Health)
3.21 Capital Asset Approval and Budget Adjustment to Purchase a Truck and Equipment for the
Material Lab -The Board of Supervisors approved the capital asset purchase of a 1/2 ton crew
truck in FY 2017-18. The truck that was originally received did not meet the specifications and
was returned.The new truck assembly was not completed prior to the end of FY 2017-18, and is
now anticipated to be delivered in August 2018. In addition,the Public Works material lab needs
a new 6-tray gradation shaker. The current device used by the Department is over 16 years old
and needs to be replaced. This device is used to perform gradation analysis for aggregate
material as part of the Department's quality control process. The Department recommends
approval of capital asset purchases for one 1/2 ton crew truck for $34,000 and one 6-tray
gradation shaker for$7,200—action requested— 1) AUTHORIZE CAPITAL ASSET PURCHASES (2);
AND 2)APPROVE A BUDGET ADJUSTMENT(4/5 VOTE REQUIRED). (Public Works)
3.22 Resolution and Cost Sharing Agreement with State of California Department of Transportation
for State Highway Electrical Facilities-Butte County has historically had cost sharing agreements
with the State of California Department of Transportation (Caltrans) to reimburse for their
operational and maintenance(O&M)expenditures that are attributable to County roadways that
intersect State highways at Caltrans operated intersections. For example, Richvale Highway at
Highway 99 has four roadways coming into the intersection, three are owned by Caltrans, and
one is owned by the County. In this case, the County has a 25% cost share for the signal O&M
costs. This agreement was approved by the Board of Supervisors on September 12, 2017.
However, after returning the agreement to Caltrans for final signatures, the State determined
the agreement had terms and conditions that were no longer required and revised the
agreement to reflect the current State contract language. There are a number of changes
including the removal of Prevailing Wage and changes in insurance requirements. The term of
the agreement is August 14, 2018 until the agreement is amended or terminated. The
Department of Public Works recommends approval of the new agreement. Approval of a

3.23 Resolution Affirming Butte County's Commitment to Implement Key Provisions of the
Sustainable Groundwater Management Act - Under the Sustainable Groundwater Management
Act(SGMA), groundwater sustainability agencies are required to develop and implement one or
more groundwater sustainability plans. Butte County and other groundwater sustainability
agencies have been developing mutually agreeable governance structures in order to develop
and implement one groundwater sustainability plan in each subbasin.The governance structures
are being developed through a public process with the assistance of a facilitator. Through the
public process,the groundwater sustainability agencies have been requested by stakeholders to
affirm their commitment to: 1) being an inclusive and transparent public process, 2) utilizing the
same data and methodologies, and 3) identifying and analyzing feasible recharge and water
supply projects. These commitments are requirements of SGMA and are consistent with the
actions taken by Butte County as a groundwater sustainability agency — action requested -
ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. (Water and Resource Conservation)
3.24 Contract with Davids Engineering, Inc for Development of the Basin Setting for Groundwater
Sustainability Plans - The California Department of Water Resources (DWR) awarded Butte
County a Proposition 1 grant to develop Groundwater Sustainability Plans (GSP) for four
subbasins (Vina, East Butte, West Butte, and Wyandotte Creek) to comply with the Sustainable
Groundwater Management Act of 2014. On July 24, 2018, the Board of Supervisors authorized
the Department of Water and Resource Conservation to submit applications to DWR to modify
the current basin boundaries which will result in three subbasins in Butte County: Vina, Butte,
and Wyandotte Creek Subbasins. When DWR finalizes the basin boundary modifications, this
project will reflect those changes. The project will produce the Basin Setting portion of the GSPs
including water budgets, hydrogeologic conceptual models, and groundwater conditions to lay
the groundwork for future establishment of sustainable criteria and minimum thresholds for
each of the subbasins. The Department solicited for professional services to perform the work.
The solicitation review committee unanimously recommends the Board approve a contract with
Davids Engineering, Inc. of Davis. The term of the contract is August 14, 2018 through June 30,
2020, not-to-exceed $475,000—action requested —APPROVE CONTRACT AND AUTHORIZE THE

County Children and Families Commission submits the FY 2018-19 budget which was adopted by

A. Letter to the State Legislature Regarding State Compact with the Mechoopda Indian Tribe of
Chico Rancheria—Approval of a letter to the State Legislature stating that the County has no
objection to the proposed compact with the Mechoopda Indian Tribe of Chico Rancheria,
provided the provisions of the compact are similar to recently approved compacts.The letter
also states that the County will, in good faith, negotiate a Memorandum of Understanding
with the Tribe to provide reasonable mitigation of off-reservation impacts of the Tribe's
construction and operation of a contemplated Class III gaming facility— action requested —

4.04 Letter of Support for Senate Bill 71 - Solid Waste: Disposal - Recology, a County franchise
agreement holder with the County, reports that there is an increasing problem throughout the
State with the theft of recyclables that have been placed at the curb for collection; as well as the
presence of unauthorized haulers providing illegal services. Such activities have resulted in the
loss of franchise fees due to the diminished waste and recycling revenue; higher rates to cover
the loss of recycling revenue; and an increase in litter and neighborhood disturbances.
Supervisor Connelly has requested that the Board of Supervisors consider a letter of support for
Senate Bill 71, which would allow haulers to recover reasonable attorney fees and costs related
to pursuing civil action against recycling theft and illegal services—action requested -APPROVE

4.05 Resolution Designating Butte County Jail as a Treatment Facility - The Sheriff's Office is in the
process of developing an agreement with the California State Department of Hospitals to provide
treatment to felony inmates deemed by the Butte County Superior Court to be Incompetent to
Stand Trial (IST) as a result of a mental disorder. Currently, felony IST inmates must be sent to a
State Hospital to either be restored to competency or deemed unable to be restored to
competency before their criminal proceeding can continue. Due to a lack of bed space in the
State Hospitals, it is common for these inmates to remain many months in a county jail waiting
for a State Hospital bed to become available. In order to assist with this bed shortage and the
length of time an inmate must wait before receiving IST treatment, the State has sought
contracts with local jails to provide these services in lieu of going to a State Hospital.The intent
of providing local IST treatment is to assist IST inmates with more timely treatment for their
mental health condition and to provide expediency of their legal proceedings.The Sheriff's Office
intends to provide these services through its health and mental health care provider, California
Forensic Medical Group. To provide these services, the jail must be designated as a treatment
facility under Penal Code section 1369.1, which states; "Upon the concurrence of the county
board of supervisors, the county mental health director, and the county sheriff, the jail may be
designated to provide medically approved medication to defendants found to be mentally
incompetent and unable to provide informed consent due to a mental disorder."This designation
is for the treatment of the IST inmate population only, and it does not classify the jail as a 5150
Welfare and Institutions Code designated facility. The Sheriff and the Director of Behavioral
Health recommend adopting a resolution designating the Butte County Jail as a treatment facility
— action requested — ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. (Behavioral
