CONSENT AGENDA MEMBERS OF THE BOARD STEVE LAMBERT, CHAIR, DISTRICT 4 BILL CONNELLY, DISTRICT 1 DEBRA LUCERO, DISTRICT 2 TAM RITTER, DISTRICT DOUG TEETER, VICE CHAIR, DISTRICT 5 BRUCE ALPERT, COUNTY COUNSEL 3.01 Resolutions Establishing Appropriation Limit for Fiscal Year WY) 2019-20— In November of 1979, California voters passed Proposition 4, which added Article XIIIB to the State Constitution. This Article establishes limits on the appropriation of proceeds of taxes. Proposition 4 establishes and defines annual appropriation limits on State and local governmental entities based on annual appropriations for the prior fiscal year, adjusted for changes in cost of living and population. Revenues received in excess of appropriations permitted by this measure are required to be returned by revision of tax rates or fee schedules within the next two subsequent fiscal years, and appropriation limits may be established or temporarily changed by the electorate. The legislation, which implemented Proposition 4 (Government Code section 7910), requires that a jurisdiction's governing body establish, by resolution, its appropriation limit for the following fiscal year no sooner than 15 days after documentation used to determine the limit is available to the public. Due to the documentation not being available until July 17, 2019, the appropriation limits were unable to be set until after the FY 2019-20 Budget was adopted. In the event the Adopted Budget is not compliant with the limit, the Board would be presented with budget adjustments. County of Butte appropriations are compliant with Proposition 4 limitations. The FY 2019-20 appropriations limit is $205,897,301 and the FY 2019-20 total adjusted appropriations subject to the limit is $50,636,911. The Auditor -Controller recommends the Board of Supervisors adopt resolutions confirming Proposition 4 appropriation limit calculations for the County of Butte and all special districts under the control of the Board of Supervisors for FY 2019-20 — action requested - ADOPT RESOLUTIONS (2) AND AUTHORIZE THE CHAIR TO SIGN. (Auditor -Controller) 3.02 Resolution Recognizing September 2019 as National Preparedness Month - The Office of Emergency Management and the Sheriff's Office recommend the Board of Supervisors adopt a resolution recognizing the month of September 2019 as "National Preparedness Month" — action requested - ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. (County Administration / Sheriff -Coroner) Page 1 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA -SEPTEMBER 24, 2019 3.03 Relief from Accountability for a Housing Rehabilitation Loan -The County assists low to moderate income homeowners rehabilitate their homes and create safe, healthy living conditions by providing low or no interest Housing Rehabilitation Loans. The County funds the Housing Rehabilitation Assistance Program through Community Development Block Grant (CDBG) grant funds. The Housing Rehabilitation Assistance Program operates according to the Program Guidelines, which are adopted by the Board of Supervisors and amended on September 10, 2019. County Administration recommends Relief from Accountability for a loan that is considered uncollectible based on the condition and value of the property and the fact that the loan client has abandoned the property. The total balance of the loan is $18,143.39 — action requested - APPROVE RELIEF FROM ACCOUNTABILITY. (County Administration) 3.04 Contract with Stephana Femino for Indigent Defense Services - The County is required by law to provide criminal defense representation for indigent defendants. The County provides this service through contracts with a consortium of local attorneys. The current monthly rate of an attorney is $13,212. One of the consortium attorneys, Mark Stapleton has recently resigned effective August 31, 2019. The Public Defender Consortium has nominated Stephana Femino to join the consortium effective September 1, 2019. The term of the contract is September 1, 2019 through June 30, 2021, not to exceed $292,259. Ms. Femino has practiced in the area of criminal defense law in Butte County for the past ten years, and is well known in the local justice system. The nomination is supported by the Court and the District Attorney — action requested - APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. (County Administration) 3.05 FY 2018-19 Year -End Budget Adjustments and Ratify Capital Asset Purchase — Each year, as part of the year-end process, an analysis is completed to identify budget adjustments to address deficit budget balances from the previous year. The recommended budget adjustments include increased appropriations of $1,529,268 in various funds, offset by $1,016,862 in unanticipated revenues, and $512,406 in use of fund balances. The adjustments do not require the use of General Fund Appropriation for Contingencies. This year in addition to budget adjustments, it is recommended that the Board of Supervisors ratify and provide Capital Asset purchase authority for the final payment on a fire engine. The purchase of the fire engine was initiated with approval from the Board of Supervisors in FY 2017-18, but not completed until FY 2018-19. Due to an administrative error, the purchase was not reauthorized in FY 2018-19. The Fourth Quarter Financial Report, typically presented to the Board of Supervisors in November, will provide greater detail and analysis of FY 2018-19 expenditures and revenues — action requested - APPROVE BUDGET ADJUSTMENTS AND RATIFY CAPITAL ASSET PURCHASE (4/5 VOTE REQUIRED). (County Administration) 3.06 Consolidated FY 2019-20 Budget Adiustments and Capital Asset Purchase Authoritv - Each fall County Administration coordinates a consolidated budget adjustment for multiple departments containing routine budget adjustments that are needed in transitioning to the new fiscal year. Staff have updated revenue estimates, as well as more precise cost estimates for projects and purchases spanning fiscal years that need to be rebudgeted in FY 2019-20, and have identified a number of recommended budget clean-up actions. The adjustments include Capital Asset purchase authority for a rebudgeted fire engine, a patrol vehicle, and parts and equipment for patrol vehicles. The adjustments total $7,106,842 in additional appropriations, including transfers between funds and a $104,851 transfer from General Fund Appropriation for Contingencies as detailed in the staff report. The remaining adjustments are offset by the use of fund balances or increased revenue — action requested - APPROVE BUDGET ADJUSTMENTS AND REAUTHORIZE CAPITAL ASSET PURCHASES (4/5 VOTE REQUIRED). (County Administration) Page 2 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA -SEPTEMBER 24, 2019 3.07 Board of Supervisors Regular Meeting Minutes - Submitted for approval are the minutes for the September 10, 2019, Board of Supervisors Regular Meeting — action requested - APPROVE THE SEPTEMBER 10, 2019, BOARD OF SUPERVISORS REGULAR MEETING MINUTES AND AUTHORIZE THE CHAIR TO SIGN. (County Administration) 3.08 Contracts Related to Homeless Emergency Aid Program (HEAP) Funding - The Butte Countywide Continuum of Care (CoC) has awarded HEAP funding to address the homelessness crisis in Butte County. The remaining HEAP funds, totaling $450,000, have been awarded for the following contracts: 1) Oroville Rescue Mission, Inc., Food Storage: $45,000 2) Oroville Rescue Mission, Inc., Emergency Shelter Operations: $105,000 3) True North Housing Alliance, Inc., Safe Space Winter Shelter: $189,877 4) True North Housing Alliance, Inc., Aurora North Family Shelter: $110,123 These projects were selected and approved by the CoC Council on July 15, 2019. The CoC has sole discretion over how HEAP funding is spent and who receives the funding. The Department of Employment and Social Services serves as the Administrative Entity for the CoC and will be monitoring the contracts and distributing the funding based on the CoC Council's recommendation and the terms set forth by the State of California — action requested - APPROVE CONTRACTS (4) AND AUTHORIZE THE CHAIR TO SIGN. (Employment and Social Services) 3.09 Resolution Adopting a Standard of Aid for General Assistance (GA) and Amendments to the GA Manual, and Related Budget Adjustment— GA is a State -mandated program providing temporary monthly support to indigent adults who are not supported by their own means, other public funds, or assistance programs. Butte County currently has approximately 400 eligible clinets in the program. GA is a loan program, and participants are required to pay back support received from the program. All recipients are required, as a condition of eligibility, to sign a repayment agreement to the County for all GA payments received based on their ability to pay. Those applying as disabled and unable to work are required to apply for Supplemental Security Income as a condition of eligibility. Able-bodied clients are provided job search services designed to help them obtain employment and reach self-sufficiency. The Department of Employment and Social Services recommends that the Board approve a resolution setting the GA rate at $520 per month for a single individual effective October 1, 2019. This is an increase of 41%, changing the GA amount from $369 per month. The Department estimates the increase to be $540,000 through the remainder of FY 2019-20. The rate increase is in accordance with the changes made by Senate Bill 80 (Human Services Omnibus) and conforms to the State Welfare and Institution Code section 17000.5, which links any adjustment made in the CalWORKs program to a corresponding increase in the GA program. The Department also recommends approval of a budget adjustment increasing GA payments using General Fund Appropriation for Contingencies. The recommended budget increase is $216,000 since the Department anticipates recouping approximately 60% of GA costs - action requested - 1) ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN; AND 2) APPROVE BUDGET ADJUSTMENT FROM THE GENERAL FUND APPROPRIATION FOR CONTINGENCIES (4/5 VOTE REQUIRED). (Employment and Social Services) Page 3 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA -SEPTEMBER 24, 2019 3.10 Resolution to Amend the Salary Ordinance - The Department of Human Resources recommends the Board of Supervisors adopt a resolution amending the Salary Ordinance for the following departments: HUMAN RESOURCES: On August 27, 2019 the Board of Supervisors approved the new classification of Housing Navigator. The classification was inadvertently added to the "General Unit" section of the Salary Ordinance instead of the "Social Services Workers' Unit." The Department recommends correcting this error and adding the classification of Housing Navigator to the "Social Services Workers' Unit" by amending Section 28 Reference D of the Ordinance No. 4149 of the County of Butte entitled "Social Services Workers' Unit." PROBATION: Add 1 Assistant Chief Probation Officer position and delete 2 vacant Chief Deputy Probation Officer positions. The Department recommends a reorganization that would allow for greater efficiency of operations, while creating budget savings by consolidation. This change will better meet the needs of the Department by having two Assistant Chief Probation Officers (one existing) and each position will oversee a major component, either the Juvenile or Adult division. Total allocations to decrease by one. There is no impact to the General Fund Budget. PUBLIC WORKS: Delete 1 vacant term Manager, Program Development (term to end 3/31/2021) position and add 1 flexibly staffed Civil Engineer position. This change will better meet the needs of the Department. Flexibly staff 1 vacant Vehicle Services Worker position up to Heavy Equipment Mechanic, Senior, to allow the Department more flexibility in filling the allocation. Delete 1 vacant Supervisor, Support Services position and delete 1 vacant flexibly staffed Accountant position following internal Departmental promotions. Flexibly staff one Administrative Assistant position in anticipation of an upcoming retirement to allow the Department more flexibility in filling the allocation. Total allocations to decrease by two. There is no impact to the General Fund Budget. Action requested — ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. (Human Resources) 3.11 Grant Agreement with State of California Office of Traffic Safety (OTS) for Child Passenger Safety Program - The Department of Public Health recommends entering into a grant agreement with the State of California OTS for the provision of a Child Passenger Safety Program. The goal of the program is to reduce the number of persons killed or injured in crashes involving children under the age of eight years old. The Department will perform community outreach, conduct child safety seat check-ups, attend community events, and provide presentations and trainings. Efforts will focus in underserved communities and coordinated in collaboration with community- based organizations. The term of the grant agreement is October 1, 2019 through September 30, 2020, with a maximum amount receivable of $115,000—action requested -APPROVE GRANT AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Public Health) Page 4 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA -SEPTEMBER 24, 2019 3.12 Contract Change Order (CCO) for Decommissioning of the Primary Septage Pond at the Neal Road Recycling and Waste Facility (NRRWF) Project - On June 26, 2018, Myers and Sons Construction, LLC, of Sacramento was awarded the Decommissioning of the Primary Septage Impoundment Project at the NRRWF. The project scope of work includes the pumping, trucking, and disposal of the liquid in the pond, removal and drying of the accumulated bio -solids and sludge, and removal of the 4.4 acre pond liner system. The contract award amount was $2,391,916. Three contract change orders have already been negotiated and approved. CCO No. 1, in the amount of $26,183, adjusted the compensation for hauling to alternate facilities. CCO No. 2, in the amount of $267,600, adjusted compensation for increased haul route length. CCO No. 3, in the amount of $200,000, increased the amount of liquid hauled due to rain volume. The volume of bio -solids stated in the bid documents was based upon approximate field measurements made using a boat, which led to an inherent degree of inaccuracy. Additionally, after the final measurement of the pond depth, additional septage material continued to be delivered into the pond, up to the date of final conversion and activation of the transfer facility. The engineer's estimated volume of bio -solids was 1,500 dry tons, at completion of construction, a total of 2,898 tons were removed and processed. This was a substantial increase above the engineer's estimate, and the price per ton was renegotiated with Myers and Sons Construction, LLC, and reduced from $400 per ton down to $358 per dry ton. CCO No. 4, in the amount of $436,471, provides for a revised contract unit price for removal of bio -solids and increases the engineer's estimate for the quantity of bio -solids to be removed. All water and bio -solids have now been removed, and all work on this project is complete except for final testing and clearance of the soil beneath the liner system, which is in progress — action requested - APPROVE CONTRACT CHANGE ORDER AND AUTHORIZE THE CHAIR TO SIGN. (Public Works) 3.13 Budget Adjustment, Capital Asset Purchase, and Capital Asset Surplus — Vehicles - The Sheriff's Office recommends the Board approve the purchase of seven additional vehicles in FY 2019-20, and declare four vehicles surplus to the needs of the County. Four Sheriff vehicles were destroyed beyond repair by the Camp Fire. The purchase of four vehicles will replace the destroyed vehicles, which will be surplussed. Funding for the replacement of the four vehicles is covered through insurance reimbursement. Additionally, two vehicles will replace vehicles currently used for front line law enforcement, plus one vehicle for Coroner transport services. Funding for the purchase of the three vehicles will come from existing appropriations and program savings — action requested - 1) APPROVE BUDGET ADJUSTMENT (4/5 VOTE REQUIRED); 2) APPROVE CAPITAL ASSET PURCHASES (7); AND 3) DECLARE CAPITAL ASSETS (4) SURPLUS TO THE NEEDS OF THE COUNTY. (Sheriff -Coroner) 3.14 Resolution Terminating the Tax Collector Central Collections Revolving Fund — The Board of Supervisors adopted Resolution No. 06-166 on December 12, 2006, establishing the Treasurer - Tax Collector Central Collections Revolving Fund (the Fund) in the amount of $2,000 for the purpose of complying with California Government Code Section 29320 et seq. The Auditor - Controller's Office has analyzed the Fund and determined that it is no longer needed for efficient operations in the Treasurer -Tax Collector's Office. The Fund and associated checking account was mainly used to purchase postage stamps and to pay fees to law enforcement agencies for serving Earnings Withholding Orders (EWOs) for delinquent court fines. The Department now uses a CalCard for postage stamp purchases and no longer handles the EWO process internally. The Treasurer -Tax Collector's Office recommends that the Board adopt a resolution terminating the Fund and directing the County Treasurer to deposit the balance of $1,956 into the General Fund —action requested - ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. Appointments to the Butte County Children and Families Commission (First 5) - First 5 is part of a Statewide effort to create a seamless system of integrated and comprehensive programs and services by establishing community-based programs to provide parental education and family support services relevant to effective childhood development; encouraging pregnant women and parents of young children to quit smoking; and educating the public on the importance and the benefits of nurturing, health care, family support, and child care. First 5 is a nine -member commission comprised of the following: one member of the Board of Supervisors, the Director of the Department of Public Health, the Director of the Department of Employment and Social Services, and six members appointed by the Board of Supervisors chosen from the following groups: recipients of project services as set forth in the County strategic plan; educators specializing in early childhood development; representatives of a local group for prevention or intervention for families at risk; representatives of community-based organizations that have a goal of promoting nurturing and early childhood development; representatives of local school districts; representatives of local medical, pediatric, or obstetric associations or societies; County health officer; representatives of a local child care resource or referral agency; a local child care coordinating group; or an elected official of local government. First 5 recommends the Board appoint the following as regular Commissioners: Shelley Hart and Seng Yang, each with terms ending June 30, 2021, and Scott Kennelly, with a term ending June 30. 2020. First 5 further recommends appointing Holly Kralj as an alternate Commissioner, with a term ending June 30, 2021— action requested - 1) APPOINT SHELLEY HART AS A REGULAR COMMISSIONER, WITH A TERM ENDING JUNE 30, 2021; 2) APPOINT SCOTT KENNELLY AS A REGULAR COMMISSIONER, WITH A TERM ENDING JUNE 30, 2020; 3) APPOINT SENG YANG AS A REGULAR COMMISSIONER, WITH A TERM ENDING JUNE 30, 2021; AND 4) APPOINT HOLLY KRAU AS AN ALTERNATE COMMISSIONER, WITH ATERM ENDING JUNE 30, 2021. Board Member/ Committee Reports and Board Member Comments (Pursuant to California State law, the Board is prohibited from taking action on any item not listed on the agenda) 4.02 Update of Budget, Legislative, and Other Current Issues by the Chief Administrative Officer 4.03 Employment Contract for Human Resources Director — County Administration recommends entering into an employment contract with Sheri Waters, Human Resources Director. The term of the contract is from September 24, 2019 through September 23, 2022. The proposed annual salary is $148,425, which represents approximately a 1.2% increase from her current salary — action requested - APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. (County Administration) Page 6 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA -SEPTEMBER 24, 2019 4.04 2020 Board of Supervisors Regular Meeting Calendar (2020 Meeting Calendar) - Pursuant to Butte County Code section 2-13, Board Meetings are held on the second and fourth Tuesday of each month, with the ability to alter the schedule by a majority vote. Typically, the meeting dates in July, November, and December are adjusted to accommodate the California State Association of Counties (CSAC) Annual Conference, vacation, and the holiday schedule. County Administration submits two versions of the 2020 Meeting Calendar for consideration and adoption. In Version 1, all meetings are held on the second and fourth Tuesday of the month, with the following exceptions: July, in which there is only one meeting; September, in which the meetings are held on the third and fifth Tuesday of the month; and November and December, which only have one meeting per month. In Version 2, all meetings are held on the second and fourth Tuesday of the month, with the following exceptions: July, in which there is only one meeting; October and November, in which the meetings are held on the first and third Tuesday of each month; and December, which only has one meeting — action requested - 1) ADOPT VERSION 1 OF THE 2020 BOARD OF SUPERVISORS REGULAR MEETING CALENDAR; OR 2) ADOPT VERSION 2 OF THE 2020 BOARD OF SUPERVISORS REGULAR MEETING CALENDAR. (County Administration) 4.05 Agreement Between the Groundwater Sustainability Agencies (GSA) in the Butte Subbasin for Implementation of the Sustainable Groundwater Management Act (SGMA) - The SGMA provides local public agencies with land use, water management, or water supply the opportunity to be a GSA with the responsibility of developing and implementing Groundwater Sustainability Plans (GSP). GSPs must evaluate the sustainability of the basin and identify projects and actions that will be implemented to achieve sustainability over a 20 year period. Each subbasin must be covered by one or more GSPs by January 30, 2022. SGMA allows for more than one GSP for each subbasin, subject to Coordination Agreements and other requirements. Butte County is a GSA in the Butte subbasin along with Glenn County, Colusa County, Reclamation District No. 1004, Reclamation District No. 2106, City of Gridley, City of Biggs, Butte Water District, Biggs West Gridley Water District, Richvale Irrigation District and Western Canal Water District. The GSA managers developed a mutually acceptable agreement for the purpose of developing a single GSP for the Butte subbasin and other SGMA implementation requirements. The purpose of the agreement is to: 1) develop, adopt, and implement a legally sufficient GSP in order to implement SGMA requirements and achieve the sustainability goals outlined in SGMA; 2) cooperatively carry out the purposes of SGMA; 3) coordinate subbasin-wide public involvement and stakeholder outreach and engagement in developing and implementing the Butte subbasin GSP; and 4) maintain mutual respect for the autonomy of each agency and preserve each agency's legal authorities, powers, duties and rights as separate public agencies and GSAs. The agreement is being considered for approval by each agency in September 2019. The Department of Water and Resource Conservation recommends that the Board of Supervisors approve the agreement — action requested - APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Water and Resource Conservation) Page 7 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA -SEPTEMBER 24, 2019 4.06 Introduction of an Ordinance Amending Article XIII.5, Entitled "Children and Families Commission," of Chapter 2, Entitled, "Administration," to update Membership Requirements and add Alternate Members - In 1998, California Voters approved Proposition 10, which applied a tax on tobacco products to fund improved outcomes for young children. First 5 Butte County Children and Families Commission (Commission) uses these tax dollars to fund local programs and services for young children to enhance their health and early growth experiences. First 5 is part of a Statewide effort to create a seamless system of integrated and comprehensive programs and services by establishing community-based programs to provide parental education and family support services relevant to effective childhood development; encouraging pregnant women and parents of young children to quit smoking; and educating the public on the importance and the benefits of nurturing, health care, family support, and child care. The Commission is comprised of nine voting members and two alternates. All commissioners must be representative of a designated community category. In an effort to expand the number of members of the community on the Commission, the body voted to increase the number of alternates from two to five. Alternates serve with all rights and benefits of voting members, and are utilized to vote when a quorum of voting members cannot be reached — action requested - WAIVE THE FIRST READING OF THE ORDINANCE ENTITLED, "AN ORDINANCE OF THE COUNTY OF BUTTE AMENDING ARTICLE XIII.5, ENTITLED "CHILDREN AND FAMILIES COMMISSION," OF CHAPTER 2, ENTITLED, "ADMINISTRATION," TO UPDATE MEMBERSHIP REQUIREMENTS AND ADD ALTERNATE MEMBERS." (Other — Butte County Children and Families Commission) 4.07 Items Removed from the Consent Agenda for Board Consideration and Action 4.08 Letter of Surmort - HR 2838 - Enhancing the Strength and Caoacitv of America's Primar Evacuation routes Act (ESCAPE) - Per direction from the Board of Supervisors at the September 10, 2019 meeting, staff have prepared a letter of support for HR 2838 - Enhancing the Strength and Capacity of America's Primary Evacuation routes Act (ESCAPE), which would establish a grant program for projects that strengthen or expand existing evacuation routes; or construct new evacuation routes — action requested - APPROVE LETTER AND AUTHORIZE THE CHAIR TO SIGN. PUBLIC HEARINGS AND TIMED ITEMS 5.01 10:30 am — Camp Fire Update — The Camp Fire burned unincorporated communities in Butte County and the Town of Paradise on November 8, 2018, taking the lives of 86 people, leaving nearly 19,000 structures destroyed and displacing more than 14,000 families. The Camp Fire recovery is an ongoing effort in coordination with local jurisdictions and organizations, as well as State and federal agencies. Staff from the County, the Governor's Office of Emergency Services, and the Federal Emergency Management Agency will be available to answer questions about recovery activities. (County Administration) Page 8 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA—SEPTEMBER 24, 2019 5.02 11:05 am - Resolution Adopting Service Charges in the County of Butte for FY 2019-20—A County Service Area (CSA) or Permanent Road Division (PRD) is a type of dependent special district governed by the Board of Supervisors. Some CSAs and PRDs are funded by service charges to property owners within the district. These service charges are set annually by the Board based on need as anticipated in the adopted CSA and PRD budgets. The process for setting these charges is laid out in Government Code section 25215.5 for CSAs and Streets and Highway Code section 1178 for PRDs. Annually the Departments that manage the service areas funded with service charges prepare a budget for anticipated expenses in that given year, which is part of the FY 2019-20 Adopted Budget. In the County of Butte, those Departments are Public Works, Public Health, and General Services. Each of these Departments calculate the requested parcel charges not to exceed the maximum voter approved amount previously established pursuant to Proposition 218, the Right to Vote on Taxes Act. These charges may fluctuate year by year depending on the anticipated funding needs as approved in the Adopted Budget, number of parcels in the area and other available resources. Staff recommends the Board of Supervisors adopt the proposed per parcel service charges as laid out in Exhibit A of the resolution. (Auditor -Controller) 5.03 11:15 am - 2019 Building Code Adoption Update - The California Code of Regulations Title 24 is updated and adopted Statewide every three years by the California Building Standards Commission. The standards are the minimum codes to be enforced by all city and county jurisdictions throughout the State. The 2019 codes have been published and will be in effect January 1, 2020. The staff report provides a brief overview of the process at the State and local levels and discusses the benefits of adopting codes locally. The Board of Supervisors will consider code adoption in October — action requested - ACCEPT FOR INFORMATION. (Development Services) 5.04 1:00 pm — Update on Butte County's Local Hazard Mitigation Plan (LHMP) — On January 9, 2018, the Board of Supervisors authorized the Emergency Services Officer to apply for grant funding to update the County's LHMP. Through the LHMP, State and local governments identify and evaluate the risks from natural hazards and develop long term strategies to reduce the impacts of disaster on people, property, and environment. The Local Hazard Mitigation Plan must be updated every five years so that the County and participating jurisdictions are eligible for disaster grant funding and other hazard mitigation grant funding. Our current plan was approved by the Federal Emergency Management Agency (FEMA) in November 2014 and set to expire in November 2019. The County's contractor, Foster Morrison Consulting, which has been assisting the County to update its LHMP, will provide an overview of the draft plan and the status the planning process. The final plan will be brought back for Board consideration upon its approval by FEMA— action requested - ACCEPT FOR INFORMATION. (County Administration) 6.
