3.01Paradise Irrigation District Request for January 24, 2017 Special Recall Election - Paradise
Irrigation District Board of Directors submits Resolution No. 2016-19, ordering a Special Recall
Election to be held on January 24, 2017, for Larry Duncan, Director-Division No. 3, and Sep Carola,
Director-Division No. 4. The election will be held by all mail ballot; there will be no polling place
locations for this election. The District requests that the Board of Supervisors permit the County
Clerk-Recorder to render specified services to the District relating to conducting the election,
and canvassing of the results of said election. The estimated cost to conduct the all mail ballot
is approximately $65,000 and will be paid by the District under the County special election pre-
payment policy action requested 1) APPROVE THE REQUEST BY PARADISE IRRIGATION
DISTRICT AUTHORIZING THE COUNTY CLERK-RECORDER TO CONDUCT SPECIAL RECALL ELECTION
BY ALL MAIL BALLOT ON JANUARY 24, 2017; AND, 2) APPROVE THE BUDGET ADJUSTMENT (4/5

3.02Amendment No. 1 to Contract with RUSH Personnel Services, Inc. - The County Clerk-
Recorder/Registrar of Voters currently uses RUSH Personnel Services, Inc. to provide seasonal
election workers who are required to work on a part-time basis, for limited durations of time,
based upon department needs. Due to an increased use of services for the June 2016 Primary
Election and the anticipated extra help needs for the November 8, 2016, General Presidential
Election, the January 2017 recall election for Paradise Irrigation District, and petition processing,
the Department requests an amendment to the existing contract. The amendment will increase
the not-to-exceed price by $150,000 to a maximum of $400,000. All other terms and conditions
will remain the same action requested APPROVE THE CONTRACT AMENDMENT AND

3.03Appointment of Nominees in Lieu of Election - Various Special Districts Under the provisions of
California Elections Code section 10500 et al., a General District Election shall be held on
November 8, 2016, for the purpose of electing Directors to various special district boards whose
terms of office expire on December 2, 2016. An election is held when the number of qualified
candidates exceed the number of positions that have terms expiring, or when a petition is filed
requesting that an election be held. No petitions requesting an election were received and
nominees did not outnumber the positions that have terms expiring. In the districts where
candidate(s) filed a Declaration of Candidacy for an office that did not exceed the number of
positions to be filled, California Elections Code § 10515 (a), provides that the Board of Supervisors
appoint the nominees who filed a Declaration of Candidacy, rather than requiring an election.
Nominees who are appointed will take office at noon on December 2, 2016, and serve exactly as
if elected. After the appointment is made, the County Clerk-Recorder/Registrar of Voters will
issue the Certificate of Appointment in Lieu of Election and Oath of Office to each appointee.

3.04Appointment of Nominees in Lieu of Election - Various Special Districts Under the provisions of
California Elections Code § 10500 et al., a General District Election shall be held on November 8,
2016, for the purpose of electing directors to various special district boards whose terms of office
expire on December 2, 2016. The last day to file a Declaration of Candidacy was August 12, 2016.
In those districts where an incumbent did not file a Declaration of Candidacy, this period was
extended to the 83 rd day before the election (August 17, 2016). California Elections Code sections
10515(a), (b), provides that the Board of Supervisors appoint a qualified person, no later than
the November 22, 2016 meeting. The Clerk of the Board of Supervisors shall issue the Certificate
of Appointment and Oath of Office to the appointee(s). The appointee shall take office at noon,
December 2, 2016, and serve exactly as if elected. In the event that the Board of Supervisors
does not make appointment(s) by November 22, 2016, a vacancy will occur, and the District
Board will fill the vacancy as provided in Section 1780 of the Government Code. Candace J.

3.06Amendment to Contract with Shaw, Yoder, Antwih, Inc. for State Legislative Advocacy Services -
Prior to 2014, the County contracted with Strategic Local Government Services, LLC (SLGS) for
state legislative advocacy services. Beginning in 2014, the County contracted with Shaw, Yoder,
Antwih, Inc., the successor firm to SLGS. Paul Yoder remains the County's principal contact for
state advocacy services. An amendment is recommended to extend the terms of the existing
contract an additional two years, through September 30, 2018, at the current rate of $40,000
per year and increase the not-to-exceed price from $80,000 to $160,000 for the four-year period

3.07Financing of Capital Asset Purchases - Neal Road Recycling and Waste Facility - The Board
approved the capital asset purchases of a Caterpillar 950M Loader and Caterpillar 730C2 Haul
Truck for the Neal Road Recycling and Waste Facility (NRRWF) in the FY 2016-17 Budget. Board
approval is now being requested for the financing of the purchases, through an addendum to
the County's 2012 Master Lease-Purchase Agreement with JPMorgan Chase Bank (Bank). The
costs for the loader and haul truck are $345,078.23 and $471,314.40, respectively. Staff has
negotiated lease-purchase financing with the Bank for a term of five years at a fixed interest rate
of approximately 1.53% (the rate will lock upon Board and County Counsel approval) for a total
financing of $816,393.23. Financing instead of cash outlay is recommended while interest rates
are very low, to reserve cash for future equipment replacement that will be required to meet
California Air Quality Board regulations. NRRWF will make annual payments of approximately
$170,849. There are no other costs associated with this financing. The equipment will serve as
security for the financing. The Butte County Debt Advisory Committee has determined the
subject financing complies with the requirements of the County of Butte Debt Management
Guidelines and Procedures. All financing documents submitted to the Board are substantially
complete, except for information to be inserted just prior to closing action requested

3.12Housing Support Program Funding - The Department of Employment and Social Services (DESS)
applied for additional funding from the State's Housing Support Program (HSP) to assist homeless
CalWORKs families in securing safe and stable housing. The funding allows families to receive
assistance for rental subsidies, temporary shelter costs, moving related expenses, utility deposits
and payments. On September 26, 2016, the State notified DESS that the application for special
HSP funding was accepted. The allocation for fiscal year (FY) 2016-17 is $1,151,100. In the FY
2016-17 budget process, DESS budgeted $612,681 for the HSP, so a budget adjustment is
necessary to appropriate the additional funding action requested 1) ACCEPT ALLOCATION OF
HOUSING SUPPORT PROGRAM FUNDING; AND, 2) APPROVE THE BUDGET ADJUSTMENT (4/5

3.13Lease Renewal of Sunset Hill Communication Site lease with South Feather Water and Power
Agency - As an integral part of the County's radio communication system upgrade, and in
cooperation with South Feather Water and Power Agency, staff recommends renewal of the
existing Sunset Hill communication site lease due to expire December 31, 2016. The terms of
the renewal lease will remain the same as the current lease, with the additional provision that
allows the County to add heating, ventilation, and cooling systems to the equipment vault as
needed. The new lease will take effect January 1, 2017, and has a planned termination date of
December 31, 2021, with the option to extend the term for an additional 60 months. The annual
rent payment of $738 is fixed for the term of the agreement with funding contained in the budget
action requested APPROVE THE LEASE AND AUTHORIZE THE CHAIR TO SIGN. (General

3.14Contract with Nichols, Melburg and Rossetto for Design and Construction Management at 560
Cohasset in Chico - The FY 2016-17 Budget includes funding for modifications to 560 Cohasset.
The Behavioral Health Department holds a long term lease on the facility and the project is
funded with restricted revenues received by the department. Modifications include new offices
and a data center. Staff recommends approval of a $27,100 contract with Nichols, Melburg and
Rossetto, a Chico based firm, for design and construction management services required for the
project action requested 1) APPROVE THE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN;
AND, 2) APPOINT THE GENERAL SERVICES DIRECTOR AS OFFICER OF THE PROJECT. (General

3.15Amendment to Janitorial Contracts for Leased Facilities - On October 21, 2014, the Board of
Supervisors awarded contracts to Clean King by DeHart, Inc. (Clean King) and Peerless Building
Maintenance (Peerless), two local firms, to provide janitorial services spreading across eighteen
leased facilities for four departments for a period of two years, with the option to renew for
three one-year periods. Staff recommends that the Board approve an amendment to extend
each contract until October 31, 2017, in addition to an increase to the monthly rate for Peerless,
beginning January 1, 2017, due to the State minimum wage increase. The contract with Clean
King also includes amendments to the locations serviced. The $84,276 amendment to the
$153,507.70 Clean King contract brings the total not-to-exceed price to $237,783.70; and the
$368,446.46 amendment to the $686,185.30 Peerless contract brings the total not-to-exceed
contract price to $1,072,631.76 action requested APPROVE THE CONTRACT AMENDMENTS
AND AUTHORIZE THE CHAIR TO SIGN. (General Services)
3.16Resolution to Amend the Salary Ordinance - The Department of Human Resources has prepared
a resolution to amend the Salary Ordinance for the following departments:
CHILD SUPPORT: The Department of Child Support Services requests to delete one (1) vacant
Accountant position and add one (1) Personnel Operations Specialist position. This change will
better suit the administrative needs of the department. The department also requests to add
one (1) flexibly staffed Administrative Analyst position and one (1) Administrative Analyst,
Senior. This will initially increase the allocated positions by two (2), however the positions will
be filled with internal recruitments and the resulting vacancies will be eliminated at a future
Board meeting. The new Administrative Analyst positions will provide for a broader scope of
work and provide more flexibility. Additionally, the department requests to delete one (1)
flexibly staffed Child Support Attorney due to the shared services agreements with other Child
Support agencies. Finally, the department requests to flexibly staff another Child Support
Attorney position from I to IV to provide more operational flexibility and succession planning
s allocations by
one (1). There will be no impact on the General Fund.

COUNTY COUNSEL: County Counsel recently added an Administrative Analyst, Associate position
and an internal recruitment was conducted which resulted in one (1) vacant Supervisor, Support
Services position. The department requests to delete the vacant position. This will decrease the
total allocations by one (1). There is no impact on the General Fund Budget.
DISTRICT ATTORNEYeight (8) flexibly staffed
legal/clerical positions in the department. The Office Assistant classification will be eliminated
in the near future in order to comply with California minimum wage laws. The department is
requesting to remove the Office Assistant classification in eight (8) of their flexibly staffed
positions. The Office Assistant classification is not currently occupied by an incumbent. The eight
(8) positions will be staffed flexibly as Legal Office Specialist/Legal Clerk/Office Specialist. The
Dfour (4) Legal Secretary positions. This
change will provide greater flexibility and a career advancement path. This will leave total
allocations in the department unchanged and will have no impact on the General Fund Budget.
HUMAN RESOURCES: In response to salary range of the newly appointed Director, Human
Resources, the department requests to change the salary range for Assistant Director, Human
Resources Section 28, Reference L (Effective 1/2/16-2% and Effective 12/31/16-2%) of the Salary
-Represented Classificationsin accordance with resolution 15-180
section 1.6 a. The updated salary range shall be set at 77 and effective 10/22/2016 action
requested ADOPT THE RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. (Human Resources)
3.17Contract with Compact-It, Inc., for Trash Compactor Services - The Sheriff's Office completed a
Request for Proposal (RFP) for the lease of two pieces of equipment, a trash compactor and a
cardboard baler, for the Sheriff's complex. The jail generates the majority of the cardboard that
is baled and recycled, and generates most of the trash that is deposited into the trash compactor.
Recognizing the value and useful life of these two large pieces of equipment, the RFP was
designed to locate the best cost savings, thus requested a lease price for a term of three, four or
five years. The five-year term was the best deal for the County. The RFP process resulted in one
response from the current provider, Compact-It, Inc. The monthly lease amount is $195 for the
baler, and $450 for the trash compactor, which results in a total annual cost less tax, of $7,740.
The total five-year term of the contract is $38,700 for the term of October 25, 2016, through
October 24, 2021. This is an annual cost savings of $900 over the current lease agreement

3.18Contract Amendment with Airbus DS Communications, Inc., for Emergency Notification System
- The Sheriff's Office currently contracts with Airbus DS Communications, Inc., for the Emergency
Notification System utilized in the dispatch centers of the Sheriff, Chico Police Department and
Paradise Police Department. The Emergency Notification System is commonly referred to as
"Reverse 911", and allows the cities and county to send mass notifications to many affected
citizens with emergent public safety information. The Sheriff's Office is requesting a seven-
month extension through April 30, 2017, to allow for development and publication of a Request
for Proposal for these services. The proposed amendment is a term of September 30, 2016
through April 30, 2017, for a total cost of $21,790. Half of the total is funded by the Office of
Emergency Management ($10,895), and the balance is split evenly between the three law
enforcement agencies ($3,631.67 per agency). The Sheriff's Office will assume the lead to
develop a new Request for Proposal and include the cities and the Office of Emergency
Management action requested APPROVE THE CONTRACT AMENDMENT AND AUTHORIZE THE

3.19Contract with GEI Consultants, Inc., for Evaluation of Groundwater Basins of Butte County - The
Sustainable Groundwater Management Act of 2014 requires the Department of Water
Resources (DWR) to provide technical and financial assistance to local agencies for sustainable
groundwater management. DWR awarded Butte County with a Counties with Stressed Basins
Grant under the Sustainable Groundwater Planning Grant Program, pursuant to the Water
Quality, Supply, and Infrastructure Improvement Act of 2014 (Proposition 1). On June 28, 2016,
the Board of Supervisors approved a grant agreement with DWR for the Evaluation of
Restoration and Recharge Potential Within Groundwater Basins of Butte County project. The
project will produce a map of areas conducive to groundwater recharge, evaluate opportunities
to recharge portions of the basin, and evaluate the costs and benefits of utilizing surface water
to irrigate orchards where it is available. Professional services are necessary to complete the
project. A competitive solicitation process was conducted. The review committee unanimously
recommends Butte County enter into a contract with GEI Consultants, Inc. (GEI) to conduct
specific tasks associated with the project. The contract with GEI would begin upon approval by
the Board of Supervisors, and will end on January 1, 2018. The total cost of the agreement is
$200,420, and expenses will be funded by the Proposition 1 grant. The contract expenses were
not included in the FY 2016-17 Budget. The Department recommends a budget adjustment to
appropriate $130,000 for expenses related to the contract with GEI in FY 2016-17 action

4.04Ordinance Amending Butte County Code, Chapter 26 "Buildings" to Adopt the 2016 California
Building Standards Code - The Department of Development Services requests adoption of the
2016 California Building Standards Code. The State of California officially adopted the 2016
California Building Standards Code in July 2016 and made the code adoption mandatory at the
local level by January 1, 2017. The building codes are updated every three years. This allows for
the codes to improve and adjust to the newest materials, methods of construction, technological
advances in the industry and in response to natural disasters. Compliance with the State building
codes is mandatory. The fundamental purpose of building codes is to ensure structures are
constructed to an appropriate minimum standard and are safe for the uses intended. Building
codes exist in order to protect the life, health and safety of the public who will inhabit the
state law, to provide administrative exceptions to accommodate existing local procedures and
to avoid conflicts with state law. Adoption of the proposed amendments is considered exempt
from the California Environmental Quality Act under CEQA Guidelines 15061(b)(3) action

4.05Successor Memorandum of Understanding - Butte County Correction Officers Association-
Supervisory Unit; and Resolution Amending the Salary Ordinance - Over the past several months,
the County and the bargaining team for the Butte County Correctional Officers Association-
Supervisory Unit (BCCOA-Sup) have met and conferred over a successor Memorandum of
Understanding (MOU). BCCOA-Sup has ratified the terms of the County's offer for a successor
MOU that will supersede and replace the current MOU that expired on May 19, 2016.

5.019:30 am Consideration of a Resolution Approving Participation in the Statewide
Community Infrastructure Program - The Butte County Regional Economic Development Strategy
notes the importance of identifying funding sources to support infrastructure development for
the growth and development of local businesses. One potential financing tool to assist with
financing of both development impact fees and infrastructure capital costs is the Statewide
Community Infrastructure Program (SCIP), which is offered through the California Statewide
Communities Development Authority (CSCDA), a joint powers authority sponsored by the League
of California Cities and the California State Association of Counties, which the County is currently
a member of. SCIP provides a pooled, tax-exempt bond financing program for development
impact fees and public infrastructure improvements that are requirements of local development
projects (commercial, industrial, and residential). Eligible property owners apply for financing
directly through CSCDA. If approved, CSCDA then works to finance the project through the
issuance of tax-exempt bonds. CSCDA would impose a special assessment on the owner's
property to repay the portion of the bonds issued to finance the public capital improvements
and/or development impact fees. Participation in the SCIP program is voluntary. In order to
offer the SCIP program in Butte County, the Board of Supervisors is required to pass a resolution
approving program participation action requested ADOPT THE RESOLUTION AND AUTHORIZE

5.029:40 am County-Initiated Amendments to General Plan and Zoning Ordinance for Compliance
with SB-5, 200 Year Flood Protection State legislation (SB-5, 2007 as amended) requires the
County update the General Plan, Health and Safety Element and related documents with new
flood information, policies, and regulations, and requires consistency with the Central Valley
Flood Protection Plan.

In early 2016, the County initiated amendments to the Health and Safety Element, Land Use
Element, Building Code, and Zoning Ordinance to reflect State requirements and provide better
protection from such a potential extreme flooding event, characterized as a 200-year flood. The
proposed changes to the Health and Safety Element provide mapping and more detailed
information regarding flood risk to Butte County in an extreme storm event or from a levee or
dam failure, based on model analysis. Health and Safety Element policies and new Code
requirements would prohibit new buildings in urban areas that are subject to a 200-year flood,
unless certain findings are made supporting an urban level of flood protection. The criteria for
adequate levels of flood protection in the 200-year flood zone are established by the California
Department of Water Resources. A new Urban Flood Protection Overlay Zone would be added
to the Zoning Ordinance that identifies areas subject to a 200-year flood. Related requirements
shall be established in the Building Code for the issuance of building permits in a 200-year flood
zone and are proposed to be adopted under a separate agenda item. An Addendum to the
previously certified General Plan Environmental Impact Report (EIR) and Supplemental
Environmental Impact Report (GPA and Zoning Ordinance EIR) was prepared and is
recommended for approval to address the environmental effects associated with the proposed
amendments action requested 1) APPROVE AN EIR ADDENDUM PURSUANT TO THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA), AS SET FORTH IN THE RESOLUTION, AND
AUTHORIZE THE CHAIR TO SIGN; AND, 2) ADOPT AMENDMENTS TO THE BUTTE COUNTY
GENERAL PLAN LAND USE ELEMENT, HEALTH AND SAFETY ELEMENT, AND LAND USE MAP, AS
SET FORTH IN THE RESOLUTION, AND AUTHORIZE THE CHAIR TO SIGN; AND, 3) ADOPT AN
ORDINANCE AMENDING BUTTE COUNTY CODE CHAPTER 24 ZONING ORDINANCE AND
