HomeMy WebLinkAboutAll Resolutions for 1944i RE50~UT~ON tN MlNU7~ BGOK ~o~ pqG~ BU7"T~ COwNTY wAT~R ~7cJr~ KS ...__.~..~ ~~ ~~ ~' 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 RESOLUTION ENACTING RULES AND REGULATIONS OF ADI~~INISTRATION ESTABZISI~ING FUNDS, FIbING WATER RTES AND FOR 'IIP EP~D?LO~i NT OF AGENTS TO ADMINISTER AND OPERATE BUTTE COUNTY WATER WORKS DISTRICT NUMBER ONE WHEREAS, it has become necessary to enact rules and regulations pertaining to the water service of Butte County tiYater Works District #1; to establish funds for the revenues derived therefrom; to fix water rates for said district and to provide for the employment of needful agents to administer certain affairs and look after the plant, water works and properties of said district including the collection of toll charges for water service and sundry other duties in connection with the facilities of said District. NOW, `1~REFORE, be it resolved by the Board of Supervisors of the County of Butte, State of California, as follow : RULES. AND REGULATIONS OF ADIvIINISTRATION AND 4vATER RATES Section 1. APPLICATIONS: The owner of the real property served by Butte County 'rVater Works District ~1, shall be charged with and shall be personally responsible for the water bills incurred for water services to such property. All applications far service may be made orally or in writing to the Superintendent of the District. Each applicant must state the use for which service is desired and no person will be allowed to use the water for any other purposes than is stated in their application or to supply other parties than themselves. The District will not permit water to be used on premises other than those covered by the application, and water can not be piped from one residence to another on the same premises without permission from the District. -1- 1 2 3 4 5 s 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 Section 2. INSTAT..3~ATION: The District will install upon application, service connections and lay service pipe to the curb line, in streets, and to property lines in alleys, at its own expense. The size of such service connections, however, will be determined by the District, based on the user's application. Where the distance from the mains of the District to the premises of a consumer exceeds one hundred feet, the owner of such premises is required to advance the actual cost of labor and materials for said extension over 3.00 feet, The District may refuse to install service where it is believed an adequate return will not be made in the future,. or where it is believed service will not be taken in the immediate future. Section 3.. CONTROL OF SYSTE`Pli: The distributing system, its valves gates, plant, and all appurtenant properties shall be under the control of the District at all times. Any person not so authorized who tampers with any gates, valves, service cocks, fire hydrants, or any of the Districtts property without authority shall be considered as a tresspasser. No one except an authorized agent of the District or its employees shall tap any main or lateral of the system, and no person sha11 turn water on~for any building ar premises with- out a permit of the District. Section ~.. SERVICN DISCONTINUED: Property owners must notify the District in writing when service is discontinued, and no charge will be made for disconnecting service. Until such notification the property owner will be charged with continuous use, When service is discontinued through any fault of -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 1~ 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 of the property owner, or consumer, or suspended for less than one month at the property owner's or consumerts request, the District may require payment of any outstanding water bills and the District may require a deposit of two months charges in advance. Section 5. SERVICE RESUMED: When a prior consumer wishes service, a~.new application for water service will be required. If a consumer resumes service without the knowledge or consent of the District, the consumer will become liable to a fine of one month's minimum water bill in addition to whatever has accrued Pram use. Section 6. SERVICE: These charges shall apply to a 3/~. inch service -- larger service proportionately more. Water rates are as follows: 1. For tenement or dwelling houses occupied by one family for domestic purposes only, the minimum rate shall be X2.00 per month. 2. For each family, or single person, occupying rooms on upper floors, X1.00 per month.. 3. For each apartment on an upper floor consisting of not to exceed three rooms, X1.00 per month. ~.. For boarding houses or hotels, 10 rooms or less, 5P2.50 per month; over l0 rooms and not more than 20 rooms, 20 cents additional for each room over ten. 5. Any authorized agent of the District shall be allowed 'ree access at reasonable hours, to any premises where water is erved, for the purpose of setting the rate to be charged, or for he purpose of inspecting the condition of the water pipes, or ervice. ~.. i~Tatering of lawns and gardens from an open hose is rohibited.~ A spray or nozzle must in all cases be used. 5. Irrigation of lawns or gardens is restricted to the hour; f 6 A.1~I, to 9 A.NI. and the hours of ~ P.M. to 9 F.M. Special ermission may be given by the District, upon proper showing for rrigation at other hours than above. Said permission shall be in citing. 6. The sprinkling of public streets by private property vvn.ers is prohibited. 7. All charges for water service shall be paid in advance. FUNDS There is hereby created a special fund which shah. be known as the Butte County Water Works District #~. Fund, and all revenues received for water service or monies otherwise received from said-District shall be placed to the credit of said fund, and all costs of administration of said District, maintenance, repairs, capital outlay, salaries, all other charges whatsoever shall be charged against said fund; said fund shall be established by the County Auditor, aiad he is hereby directed and authorized to ~pla.ce to the credit of said fund, all monies and revenues received ',from said District on and after the 29th day of November, 19.3, being the date of the formation of said District. There is hereby created a.speeial Revolving Fund not to exceed, however, the sum of X250.00 for the Superintendent of said District; the County Auditor of the County of Butte is hereby directed to draw a warrant in favor of the Superintendent of said District from •the funds of Butte County 14ater Works District ~l in said sera of ~2~C~.00 for the purpose of creating said Revolving Fund; before any money is withdrawn from the County Treasurer from the Butte County 1Yater Works District ~"1 Fund to be placed in such Revolving Fund, the Superintendent of the Distri t shall file with the clerk of the Board of Supervisors a bond executed by himself as principal and a Surety Company authorized to execute bonds under the laws of the State of California as surety in an amount not less than twice the amount of such Revolving Fund established for said Superintendent; said bond shall be conditioned upon the faithful administration of such fund and upon the willingness and ability of the principal on the _5_ 1 2 3 4 5 6 . 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 2~ 25 26 27 28 29 30 31 bond to account for and pay over said fund upon demand of the Board of Supervisors at any time~~a.~i( /~,,,~ c2...~~.,....._..~.~.~y a -t The Sup rintendent o~ 13is~ct entrusted wi said Revolving Fund is hereby authorised to expend any portior. thereof for services, material or labor, the securing, purchase or employment of which is a legal charge against the District. No expenditure in excess of X1.00 shall be made by said Superintendent from said Devolving fund unless a receipt is obtained therefore setting forth the date and purpose of the expenditures and the amount expended. Demand shall be made upon the Butte County 4'dater Works District 7~1 Fund for the reimburse- ment of said Revolving Fund in the same manner as other demands are made, such demand to be supported by the receipt hereinbefore referred to. All funds received in satisfaction of said demands shall be returned to the Revolving Fund and the Superintendent of the District entrusted with said :Funds shall, upon demand of the Auditor or Board of Supervisors, give account of said fund, The Board of Supervisors may at any time reduce, add to or discontinue the Revolving Fund hereby established. For ~t the proper administration 4f the affair. of said District in looking after, caring for, conducting, operatic and maintaining its water plant and other facilities including the collection of toll charges for water service, there is hereby designated an agent of the Board of Supervisors of the County of Butte who shall be known as the Superintendent of Butte County Water Works District #l, who shall be employed, named, and whose duties shall be prescribed and compensation fixed by the Board Supervisors.
