~.~~~ 1 2 3 4 5 B 7 8 9 ~o 11 1.2 13 14 15 16 17 18 19 20 21 22 23 24 '~ 25 26 27 28 29 30 51 BOARD OF SUPERVISORS COUNTY OF BUTTE, STATE OF CALIFORNIA RESOLUTION AUTHORISING EXECUTION OF AGREEMENT BETWEEN THE DIVISION OF HIGHWAYS AND COUNTY OF BUTTE FOR LIGHTING WHEREAS, there has been presented to the COUNTY OF BUTTE an Agreement entitled, "Agreement Far Maintenance of Traffic Signals and Intersection Lighting on State Highways in the County of Butte", which said Agreement is dated the 27th day of June, 196D; and W.E~REAS, said Agreement is a revised agreement of the agreemen now in effect, and has been revised to economize on time and ex- pense incurred in the maintenance of lighting facilities, which further necessitates a change in the billing procedures of De- partment, all of which meets with the approval of County; NOWT THEREFORE, BE IT RESOLVED by the BOARD OF SUPERVISORS of the COUNTY OF BUTTE, STATE OF CALIFORNIA, as follows: 1o That the Chairman of this Board is hereby authorized to execute and enter into said contract on behalf of the COUNTY OF BUTTE. 2, That the Clerk of this Board is hereby authorized to append to the original and each executed copy of said contract, a certified copy of this Resolution. The 1imi~~~~ so fixed shall not be exceeded by reason of the cross-examination o nesses. The Board may, by order, require or permit the applicant to supplement his evidence by verified written statements by maps or photographs, and by written argument, but only if time before the adjournment of the Board is adequate to permit a like reply thereto by the County Assessor, and if copies of such writings and other evidence be served on the Assessor, by the appli- cant, and copies of the Assessor's reply thereto be served on the applicant. 6. An applicant may support his application by the affidavits of his witnesses in lieu of direct testimony by them, provided he attaches such affidavits, together with copies for the Assessor, the Gounty Counsels and for the City Attorney, if-the property is within a city, to his application at the time~of filing. The affiant witnesses shall be present at the hearing of the application and subject to cross-examination. The Assessor may follow a like procedure if the applicant has done so. If the Assessor files affi- davits he must likewise serve notice upon the applicant and the County Counsel before the hearing. In order to expedite. the hearing of an application for equalization the Board may direct that the method prescribed in this rule be followed by both the applicant and the Assessor. 7. No applicant for reduction of assessment shall be heard when the showing in support thereof at said hearing is made by an agent of the owner unless said owner is either absent from the county. or by reason of his health he is unable to appears make his application and urge his claim in person; provided howeverz that a husband may appear for~his wife or a wife for her husbands sons or daughters for parents or vice versa. $. Each application shall be heard by not less than a quorum of the Board and throughout by the same members of said Boardy provided, however if the applica-tion is heard by less than a full board, and less than three members agree upon the granting or denial of the application, then the matter shall be continued and tried de navoa Provided further that the applicant may agree that any absent member or members may read or otherwise inform themselves regarding the record and thereupon participate in the dec.isian with or without additional evidence. 9o Tf any application or assessment thereon is referred by the Board to the Assessor for checking and report thereon, further hearing is waived in the absence of request therefore If further hearing is requested, the time far submission of such report and such further hearing shall be speci- fied and no further notice of the continued hearing is necessary, and the application shall be considered at the time specified or as soon thereafter as the matter may be heard. When further hearing is waived or requestedy the applicant consents, in the absence of objection thereto, to the con- sideration of the application and the determination of the matter by add- itional or different members of the Boards provided the latter read or otherwise inform themselves regarding the record. Objection to consider- ation and determination of the matter by additional or different members of the Board must be asserted at the time of waiver of or request for a further hearin . l0. M . ; and WHEREAS, the COUNTY OF BUTTE, and the residents of said County, are furnished gas service by said PACIFIC GAS AND ELECTRIC COMPANY; and WHEREAS, COUNTY does not feel justified in spending public monies to present oral and written evidence -fa~::the_~.Commission's consideration, nevertheless, the Board of Supervisors of said County feels that the general sentiment of the residents of said County is against such increase; NOW, THEREFORE, BE IT RESOLVED by the BOARD OF SUPERVISORS of the COUNTY OF BUTTE, STATE OF CALIFQRNIA, as follows: 1. R~ BOARD OF UPERVISORS COUNTY OF BUTTE, TATE OF CALIFORNIA RESOLUTION SETTINGr FOR H VIEWS OF THE COUNTY OF BUTTE 71V RELATrON TO ST TE WATER BOND PROPOSAL (SENATE B L 1.06) WHEREAS, the Board of Directors of the County Supervisors Association ~ of California, at its meeting on Decex~ber 4, 1959, requested a reaction from each County Board of Supervisors to ~ Development Bond Act;, and proposed California Water Resources WHEREAS, Butte County realiae~ the urgent need far the development of the water resources adequate to meet the growth and expansion of the State of f California, and WHEREAS, Butte County realises the need for effective flood control on ~ streams which have caused the loss of lives and great property damages, and WHEREAS, Senate Bill 1106 provides a method of financing the features necessary to deliver this much needed water to the central and southern portion of the State, and provides for the effective flood control on streanns which have caused the loss of lives and great property damage, and also provides for the development of water resources in mountain areas where this development wou not be feasible without State assistance; and WHEREAS, from the standpoint of Butte County, however, such development 'is not an unmixed blessing, in that it involves immediate development of the waters of the Feather River which is the main source of water for future agri- ~ ', cultural, domestic and industrial use in Butte County, and WHEREAS, the water supply, reservoir sites, and power potential of the Feather River are such that if Butte County and the water agencies in Butte County were permitted to make their own development of these resources with-- ', out interference by the State or Nation, it would be possible to do so and thus m et'', the ultimate water needs of Butte County, and pay most, if not all of the cost ~ ', thereof by power revenues, and thereby provide water at the points of diversion from the river at little if anv cost; and f~._~~~ 1 2 3 4 5 s 7 8 9 10 11 12 13 Z4 ].5 16 j 7.7 Z8 19 I 20 21 22 :; 23 24 25 26 27 ~8 i 29 of this potential unless consideration is given to compensating for such loss through the contract principles and pricing of water which the State project can provide Butte County, and WHEREAS, the Byrne Act, being Chapter 2019 of Statute and Codes Amend meats of 1959, being Sections 65000 and 65011, declares it to be the responsi- bility of the State of California to assist local governments in providing certain essential services and facilities where water resource construction projects financed in whole or in part by the State, or by the State faintly with the Feder Government, create an undue burden on a local area4s ability to provide these services and facilities; and WHEREAS, the relocation of County Roads necessitated by the Oroville Dam will entail a construction of bridges, o£ a size far beyond Caunty~s financ ~abilzty to maintain, and that it is contemplated that there will be increased traffic on said relacated County Roads, occasioned by recreation and tourist travel, by persons, a majority of whom will be non_residents of County, and ', that said increased traffic will require that the standards of said relocated road ~be immediately increased, and that such increased standards would require a financial expenditure beyond Countyls ability to make; NOW, THEREFORE, BE lT RESOLVED that the BOARD OF SUPERVISORS of the COUNTY OF BUTTE approves the development principles of Senate Bill 1106, such approval, however, is conditioned upon the following; 1. That the State of California adopt a policy of contract principles in pricing of water from the project to Butte and other counties of origin that wo not limit the amount of water needed for the ultimate development of these counties, nor provide water at a greater cast, than that which could be provided by local development, if the State project were not constructed. 2.
