SUBJECT. Break In and Theft on July 21, 2010 at Behavioral Health—Office(at 18 County Center
Dr., Oroville)
In accordance with Government Code Section 29390, the Director of Behavioral Health will need to
submit a request for Relief from Accountability in the amount of$5,000.00 regarding the net loss/cost of
the break-in, theft, and resulting damages from the break-in of the Behavioral Health Office at 18 County
Center Dr., Oroville on July 21, 2010.
This theft was investigated by the Oroville Police Department. The total costs (loss plus damage repair)
amounted to $8,397. Of that amount, Risk Management was able to recover$3,397 (the excess above the
$5,000 insurance policy deductible) which has been returned to the Behavior Health budget and fund.
After a review by Internal Auditor Ken Wiley of the circumstance surrounding the theft and resulting
damage repair costs,we believe that discovery and prosecution of the individuals is unlikely and that any
recovery other than from our Insurance Carrier is unlikely.
There is no evidence of fraud or gross negligence as identified in Government Code 29390.
The District Attorney and Risk Management have been advised of the loss and received copies of our
report.
If your Board determines that no fraud or gross negligence exists, it would be appropriate for the Board to
approve the Request for Relief from Accountability in the amounts of$5,000.00 when it is requested by
the Director of Behavioral Health in accordance with Government Code 29390.
