Honea, Sheriff-Coroner Butte County Sheriffs Office 33 County Center Drive Oroville, CA 95965 Dear Sheriff Honea: 2014-2016 BIENNIAL INSPECTION — BUTTE COUNTY SHERIFF'SOFFICEADULT DETENTION FACILITIES (PENAL CODE SECTION 603 1) The Board of State and Community Corrections (BSCC) conducted the 2014-2016 biennial inspection of the Butte County Sheriffs Office adult detention facilities on June 27, 2016. We inspected the Butte County Jail and the Butte County Court Holding facility for compliance with the Minimum Standards for Local Detention Facilities, as outlined in Titles 15 and 24, California Code of Regulations. The inspection consisted of a pre-inspection briefing on May 12, 2016; a site visit of the Butte County Jail and the Butte County Court Holding facility; a review of applicable written policy and procedures governing the operation of the facilities; and, a review of documentation to verify your practices are following your written procedures. The complete inspection report is enclosed and it is divided into sections. It includes: this letter; a Procedures Checklist outlining applicable Title 15 sections for the Butte County Jail and a separate Procedures Checklist for the Butte County Court Holding facility-, the Physical Plant Evaluation outlining applicable Title 24 requirements for the design of each facility; and, the Living Area Space Evaluation that summarizes the rated and non-rated capacities at the Butte County Jail and the Butte County Court Holding facility. We encourage the practice of maintaining a historical file for all inspections, including documentation of corrections made following the inspection. This file should be referenced when preparing for all future inspections. We want to acknowledge members of your staff for their assistance and courtesy during the inspection process. We personally thank Captain Andy Duch, Lieutenant Jarrod Agurkis, Sergeant Robert Cooley, Sergeant Michael Hannah, and CFMG Program Manager Andrea Thompson for clarifying policy, procedures, and practices at the Butte County Jail and the court holding facility. Sheriff-Col-ober 1)aoc 2 0 Local Inspections In addition to a biennial inspection by the BSCC, annual inspections are required by the County Health Officer. and biennial inspections are required by the State hire Marshal. or their designated representative pit[-SU,1111 10 1-1calth and Saf-ety Code 5101045 and §131146.1 respectively. The BSCC' inspection report, in conjunction with the C;valuati0115 from the health department and the lire and lilt safety reports should provide you with a conlprellensive perspective of vour faci[ity. Fire Inspection The Oroville Fire Department and Butte County Fire Department inspected the Butte County .fail on November 19, 2015 and fire clearance was -ranted. The Oroville l=ire Department inspected the Butte County Court Holding facility on December 15.. 2015 and fire clearance was granted. Health Inspection The Butte County Health Department conducted the health inspections. "Phis included: a review of the medical; environmental; and nutritional health policy and procedures as well as an inspection of practices. No issues of non-compliance were noted in the health inspections. The table below includes the dates of the inspections. Inspections Butte Co Jail Butte CH Facility Medical/Mental Health 05/12/16 04/18/16 Environmental 05/19/16 04/18/16 Nutritional 05/19/16 NIA BSCC Inspection Title 15 Police and Procedures We began our inspection by reviewing the Butte County Sheriff's Office Departmental Orders for compliance with Title 15 requirements. This manual includes policy and procedures for the jail and the court holding facility. Additionally, the court holding facility has a policy and procedures manual which address court security and operations and we reviewed applicable sections. We reviewed documentation, including: required safety checks; monthly fire and life safety inspections; the use of sobering cells; use of restraints; inmate grievances; inmate discipline for compliance with Title 15 requirements, and to evaluate if practices were consistent with policy and procedures. 03400355Btittc Co]iii CH LTR 2014-16 10/31/16 Kory L. Honea, Sheriff-Coroner Page 3 During the 2012-2014 biennial inspection, we noted non-compliance issues with the policy and procedures manual. Specifically, policy and procedures were missing for civil disturbances, natural disasters, and the periodic testing of emergency equipment. These policy and procedures have been developed, implemented, and comply with Title 15 requirements. After our review of the Departmental Orders and applicable court holding policy and procedures, we did not find any policy and procedures that did not comply with applicable Title 15 regulations for the jail or the court holding facility. Detention of Juveniles (Juvenile Justice and Delinquency Prevention Act Compliance Monitoring) We conducted compliance monitoring pursuant to Welfare and Institutions Code section 209(f) for the federal Juvenile Justice Delinquency Prevention Act (JJDPA), for the separation requirements of juveniles from incarcerated adults. No juveniles are detained at the Butte County Jail or the Butte Court Holding facility. Physical Plant;Inspection. The inspection continued with site visits. We observed staff working in their assigned duties. The staff members we spoke with during the inspection were knowledgeable and demonstrated an understanding of Title 15 regulations and the Butte County Sheriff's Office Departmental Orders. Butte County Jail The Butte County Jail was completed in 1965 and it was remodeled in 1999. The facility is evaluated under the 1963 and 1994 Title 24 standards. The jail has a Board rated capacity and court ordered capacity of 614 inmates. On the date of the inspection, there were 509 male inmates and 81 female inmates in custody. Butte County was conditionally awarded $40 million in state financing (SB 863) from the BSCC in November 2015. This project will construct a new stand alone facility adjacent to the existing jail. The facility will include medical and mental health housing; medical and dental clinics; support services space; program and educational spaces; and counseling and treatment space. There were no Title 24 non-compliance issues noted during our inspection. Butte Court Holding Facility The court holding facility was completed in 1996 and it is evaluated under the 1994 and 2001 Title 24 standards.
