For the Rule of Law to achieve these ends, equal access to the courts of justice and equal access to the laws and to the materials that explain the rules of evidence, the rules of procedure, and the relationship of laws to other law is essential. County Law Libraries, in California, are Public Libraries, free and open to the judiciary, to state and county officials, to members of the State Bar, and to all residents and nonresidents of the State of California, for the examination of books and other printed materials, for provision of access to photocopiers and printers, and to online resources. Our Mission is to make the Rule of Law equally accessible to all people. 2 Organization of California County Law Libraries STATUTORY HISTORY The law governing California's system of free, public, county law libraries is contained in Chapter 5 of Division 3 of the Business and Professions Code (sections 6300-6364). California's County Law Libraries have been in existence since Statehood. The statutory provisions that established the law libraries of today appeared shortly thereafter: Statutes of 1872, chapter 278 enacted the Political Code, the antecedent of today's Government Code, which revised the 1850 organization of State government - and provided for uniformity of county government. Pursuant thereto, and in amendment thereof, in 1891 , the Legislature established county law libraries, and in 1907, the Legislature established the Judicial Department of county government - containing the county Law Library together with the Superior Court, the Clerk of the Superior Court, the District Attorney, the Sheriff, the County Clerk, the Official Reporter, the Public Administrator, the Justice's Court, and the Constable. The provisions for county law libraries were codified in Article X of Chapter VI of Title II of the Government of Counties (Former Pol. Code §§ 4190-4204, now Bus. & Prof. Code §§ 6300-6364). Butte County Public Law Library was established by Resolution of the Butte County Board of Supervisors, who ordained to adopt chapter 282 of the Political Code, December 2, 1907. MAINTENANCE AND SUPPORT By statute, responsibility for providing suitable quarters for county law libraries and maintenance of physical plant was made the responsibility of counties (Former Pol. Code § 4198, now Bus. & Prof. Code § 6361 ). Responsibility for stocking county law libraries with each report of the decisions of the [state] supreme court, district courts of appeal, and of the statutes of this state, and also a copy of all such reports and statutes heretofore published was made the responsibility of the state (Former Pol. Code § 4201 , subsequently Bus. & Prof. Code § 6362, 1-01-1942 to 12-31-1967). Responsibility for all other operations was made the responsibility of boards of law library trustees (Former Pol. Code §§ 4191-4195, now Bus. & Prof. Code §§ 6300, 6340- 6350). LAW LIBRARY FUNDS Former sections 4190 of the Political Code (as codified in 1907) and 6321 and 6322 of the Business and Professions Code (as codified in 1941 ) provided for a Law Library Fund of one dollar ($1 ) from every first paper filing fee charged to plaintiff/petitioners 3 and defendant/respondents filing first appearance fees in the Superior Court. In counties with small populations, filing fee revenues together with the free state publications were insufficient to maintain a law library. The 1941 statute authorized county boards of supervisors to augment these funds by appropriating from the county treasury for law library purposes such sums as may in their discretion appear proper. When so paid, those sums became a part of the law library fund (Bus. & Prof. Code § 6324). Board of supervisors' support allowed the counties with small populations to maintain their law libraries in the decade of the 1940s - forward. In the years since then, since 1941 , the law library portion of the filing fee, producing the law library fund, was periodically increased by the Legislature: to not more than two dollars ($2) in 1947 (Stats. 1947, Ch. 932, § 1 ); to not more-than three dollars ($3) in 1957 (Stats. 1957, Ch. 86, § 1 ); to not more-than five dollars ($5) in 1968 (Stats 1968, Ch. 199, § 1 ); to not more-than seven dollars ($7) in 1972 (Stats. 1972, Ch. 890, § 1 ); to not more-than twelve dollars ($12) in 1980 (Stats. 1980, Ch. 64, §1 ); to not more-than twenty dollars ($20) in 1990 - with an exception, created in 1990, for claims made by "assignees" (Stats. 1990, Ch. 56, § 1 ). (The steepness of the 1990 increase followed from a period of steep inflation in the prices of legal publications. The period also witnessed the advent of electronic legal research and the disappearance of card catalogs. The costs were high: Government agencies, universities, large law firms, and publicly-supported county law libraries could access the online material.) LEGISLATIVE INTENT In 1990 the Legislature approved a long term solution to the Legislature's need to adjust the law library's share of the first-paper fee to defray the expenses of the library by allowing county boards of supervisors to add a local fee of up-to three dollars ($3) per year to the statutory base. (This power lasted until 2005.) Thus, it was stated in Statutes 1990, chapter 56, sections 1 and 7: "After January 1, 1995, the board of supervisors of the county may increase those costs to an amount over twenty dollars ($20) but in no case may this increase in any year be greater than three dollars ($3)." "It is the intent of the Legislature for California to continue its century old tradition of making legal materials available to all its citizens via adequately funded, staffed, and maintained county law libraries. ...County boards of supervisors are charged with the responsibility of monitoring the needs of the county law library within their respective jurisdictions and adjusting filing fees as permitted by the provisions of that chapter to enable the county law library to fulfill its defined mission." 4 THE LOCAL RESPONSES The rate of steep inflation in the prices of legal publications that began in the second half of the decade of the 1980s continued in the 1990s. Small publishers were acquired by larger publishers. Prices increased, at times, by 15 to 20 percent per year. In response to this inflation, forty-four (44) county boards of supervisors, that included the Butte County Board of Supervisors, imposed local fees to keep their law libraries viable. The Butte County Board of Supervisors added Section 3-90 to the Butte County Code in 1996, establishing a local fee of three dollars ($3) in 1996, six dollars ($6) in 2000, and nine dollars ($9) in 2003 in furtherance thereof. ALL BECAME PART OF SUBSEQUENT STATE LAW The statewide effect of local law library fees and other local charges that supported other local programs pursuant to State Law made for differing filing fees from county- to-county; this led to the call for legislation to standardize filing fees, statewide, and to the Uniform Civil Fee and Standard Fee Schedule Act of 2005. The Act (Stats. 2005, ch. 75 (AB 145)) established a uniform schedule of filing fees and other civil fees, of $320, $300, $180, and $165 for filings in the Superior Court, effective 1-01-2006. These fees contained the law library fees of twenty dollars ($20) plus nine dollars ($9), and twelve dollars ($12), established by existing law. Local law library fee ordinances were abrogated by the 2005 legislation: Section 3-90 of the Butte County Code was made inapplicable. Retained, however, in Sections 7 and 10 of the Act, was the authority of county boards of supervisors to direct an increase in the law library's portion of the filing fee, for a limited time: to direct that for every first- paper filed in a Civil, Family or Probate proceeding, by other-than an assignee, that the Administrative office of the Courts would allocate up to an additional three dollars ($3) per year to the law library fund - but without any increase in any fee. The request could be made annually, in 2005 and in 2006. Thereafter, thirty-six (36) county boards of supervisors, that included the Butte County Board of Supervisors, received the increased allocations provided-for in the Act. Butte County Public Law Library's portion of the filing fee increased from $29 and $12, I Also established by the Act was a first-time graduated fee structure of$30, $50, and $75 for filings in Small Claims. For Small Claims filings at the lower levels, no allocations for the support of law libraries were made; for Small Claims filings at the highest level, two dollars ($2) from each new seventy-five dollar ($75) fee collected would be added to the law library fund. 5 in 2005, to $32, $12 and $2, in 2006, and from $32, $12 and $2, in 2006, to $35, $12 and $2, in 2007. Pursuant to these actions, revenues to the Butte County Public Law Library fund increased from $180,588 in 2006-'07 to $208,306 in 2007-'08. Revenues fell thereafter owing to a decrease in paid filings. INCREASED FILING FEES, LEADING TO A DECLINE IN FILINGS AND/OR TO AN INCREASE IN IN FORMA PAUPERIS FILINGS, CAUSED LAW LIBRARY RECEIPTS TO FALL Statutes 2008, chapter 311 (SB 1407) increased the superior court filing fees established at $320, $300, $180, and $165, to $355, $330, $205, and $181 , respectively - to pay for renovation and construction of courthouses; no part of any supplemental fee provided-for in that chapter was allocated to the law library fund. This law, at section 9.3 thereof, and two subsequent trial court funding measures, Statutes 2009- 2010 4th Extra Session, chapter 22, at section 10 thereof, and Statutes 2010, chapter 720, at section 17 thereof, imposed moratoriums on adjustments to, or increases, in fees, other-than as specified by statute, for the five-year period 2008-2013. First-paper filings declined and applications for initial waivers of court fees and costs increased during the Great Recession. Statutes 2010, chapter 720 (SB 857), section 18, effective October 19, 2010, increased the first-paper filing fees established at $355, $330, $205, and $181 in 2008 to $395, $370, $225, and $181 , respectively; no part of any supplemental fee provided-for in that Section was allocated to the law library fund. Statutes 2012, chapter 41 (SB 1021 ) increased the first-paper filing fees established at $395, $370, $225, and $181 in 2010 to $435, $370, $225 and $181 ; no part of any supplemental fee provided-for in that Section was allocated to the law library fund. STATEWIDE, AND LOCAL, EFFECTS OF THE DECLINE IN PAID FILINGS From 2009 to 2013, due in part to reduced filings and due in part to increased fee waivers, law library revenues, statewide, declined to 751/2 percent of what law library revenues had been in 2008-'09. (Council of CA County Law Librarians Report) Butte County Public Law Library's fund revenues fared better than the statewide average: From levels of $198,679 received in 2009-10 and $210,650 received in 2010- ' 11 , filing fee revenues declined to $182,472 in 2011-'12 and $172,710 in 2012-' 13, amounting to a 17% percent decline compared to the 241/2 percent statewide decline. Statewide, many county law libraries reduced their hours of service. Hardest- 6 hit were Merced, Stanislaus, and San Joaquin Counties —who experienced four-year revenue declines of 36 percent, 35 percent, and 34 percent respectively. We, in Butte County, are weathering the storm: Our budget is trimmed; we have lost some ground in preserving our reserves, but there has been no reduction in service. A SOLUTION IS AT HAND Urgent legislation is needed to shore-up the Statewide system: to restore reference services, to restore library hours, and to restore subscriptions necessary to having meaningful access to the law, to the rules of procedure and evidence, and to the texts necessary to understanding and resolving interpersonal issues and governmental issues as they affect governments and people. The Council of California County Law Librarians is working with the Administrative Office of the Courts and with the Legislature to restore a measure of health to law library funding. At the top of the list is a movement to eliminate the reduced filing fee exception for "assignees:" collection agencies that pay the Courts one hundred eighty-one dollars ($181 ) instead of two hundred twenty-five dollars ($225). Also on the table is the imposition of a requirement that California's official publisher provide printed case reports, and maintain one copy of California's annotated codes for each county law library, at no expense to that law library. Eliminating the reduced filing fee exception will restore lost revenues. 7 2012-2013 Board of Trustees The Board of Law Library Trustees is composed of Judges of the Superior Court, or their designees, and County Supervisors, or their designees. Please copy the Excel file to your Desktop We show members of the general reading public materials that will be useful for their issue; we show them how to use the material, how it is organized, where to find the topic of interest; we show and tell them what other resources we have that would address the topic; we help them find the sections or topics within the resource that may be applicable; we provide form resources; we provide information regarding court procedure. Additionally, we collaborate with legal services and with the Butte, Lake and Tehama County Superior Courts' SHARP Program in developing material for self-represented litigants. 9 Resolution Approving the Annual Report RESOLUTION APPROVING THE 2011-12 ANNUAL REPORT AND AUTHORIZING AND DIRECTING THE PRESIDENT TO FORWARD THE ANNUAL REPORT, SO APPROVED, TO THE BUTTE COUNTY BOARD OF SUPERVISORS AS REQUIRED BY STATE LAW Upon a motion duly made, seconded, and carried unanimously, RESOLVED that the Annual Report as required by California Business and Professions Code Sections 6349 and 6350 is deemed to consist of the following, attached hereto: 1 . Report of the number of books added, number lost or missing, and summary, by publisher, of the physical subscriptions and archival materials held - mandated by Section 6349 of the Code; 2. Financial Report submitted by the Secretary to the Butte County Board of Law Library Trustees - mandated by Section 6350 of the Code; BE IT FURTHER RESOLVED that the President of the Butte County Board of Law Library Trustees is hereby authorized and directed to forward a copy of this RESOLUTION with the appropriate attachments to the Butte County Board of Supervisors with a copy of the same to the Butte County Auditor as required by law.
