The Energy Commission will also consider the proposed and supplemental initial Study and Negative Declaration. Concurrent with this notice, the Energy Commission has also published modifications to the proposed Standards that were previously made mailable for public comment, and identified additional documents it will rely upon for adoption of these Standards. The modifications to the proposed Standards are known as the "15-Day Language" and are the proposed revisions to the California Energy Code and CaiGreen that the Energy Commission will consider adopting. Regulations, Title 24, Part 6, associated administrative regulations in Part 1(collectively also known'as the California Energy Code), and portions of the Green Building Code, Part 11 (also known as CalGreen), of the California Building Code. The proposed amended standards are called the "2013 Building Energy Efficiency Standards" and would go into effect on January 1, 20'14. The Energy Commission will also consider approving the proposed and supplemental Initial Study and adopting the Negative Declaration, pursuant to the California Environmental Quality Act, Public Resources Code section 21000 et seq. (CEQA). Background in February 2012, the Energy Commission published a Notice of Proposed Action ~NOPA) regarding these proposed revisions to the California Energy Code and CalGreen. In the NOPA, the Energy Commission listed April 11, 2012, as a potential adoption date for the proposed language, which was made available for public comment for 45 days as required by law. The proposed language is also known as the "45-Day Language" or "45-Day Express Terms". The NOPA also stated that: The hearing before the full Energy Commission for final adoption of the 45-Day Language Express Terms will be held on the date below [April 11, 2012] unless the Energy Commission decides to make substantive changes to the Express Terms through 15-Day Language, in which case the public hearing will be continued to a later noticed date. If the Energy Commission decides to propose 15-Day Language madificatians to the Express Terms, separate notice of the adoption hearing for the 15-Day Language will be provided. This Notice of Hearing serves as-the "separate notice of the adoption hearing for the 15-Day Language." 2 The 15-Day language and related documents can be obtained from the contact persons designated below or from the Energy Commission website at: httpalwww.eneray.ca.aov/title24/2013standardslrulemakin~l. As described further below, the "15-Day" language and additional documents relied upon are being made available for public comment from May 15, 2012, through 4:00 p.m. on May 30, 2012. Should the Energy Commission determine that substantial changes to the 15-Day Language are needed, this item will be continued to a future public hearing, a revised set of 15-Day Language documents will be prepared, and the future public hearing will be noticed separately. kn addition, Energy Commission staff has analyzed the potential environmental impacts of these proposed standards, as required by CEQA. Energy Commission staff estimates that implementing the 2013 Building Energy Efficiency Standards will significantly reduce statewide annual electricity and natural gas consumption. This will significantly reduce criteria air pollutant and greenhouse gas emissions. In addition to air emissions, staff considered onsite water use, indoor air pollution, and changes in materials use, including mercury, lead, copper, steel, plastic, silicon, gold, aluminum, fiberglass, titanium, glass, and wood. Staff concluded that adop#ing the proposed Standards will not result in any signifcant environmental impacts, pursuant to the California Environmental Quality Act. A public comment period for this Initial Study and Proposed Negatlve Declaration was held from March 26; 2012, through 10:00 a.m. on April 26, 2012. Staff prepared a Supplemental Initial Study and Proposed Negative Declaration of the 15-Day language, dated May 2012, and concluded that the changes to the proposed regulatory language did not result in any significant environmental impacts, such that recirculation of the proposed knitial Study and Negative Declaration was not required. (14 Cal. Code Regs., section 15073.5.} Public Commend The public comment period for the 15-Day Language and additional documents relied upon is from May 15, 2012, through 4:00 p.m. on May 30, 2012. Written comments should be submitted to the Dockets Unit by 4:00 p.m. on May 30, 2012. Written comments will be also accepted at the hearing, but are encouraged to be submitted in advance. All written comments will become part of the public record of this proceeding. Additionally, written comments may be posted to the Energy Commission's website for the proceeding.
