Presson, MMC City Clerk Enclosures cc: Candace Grubbs, Butte County Elections - w/certified copy of resolutions City Manager City Attorney Barker File: 2012 General Municipal Election 1 2 3 4 5 G 7 8 9 10 11 12 13 14 15 lb 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 29-12 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHICO CALLING A GENERAL MUNICIPAL ELECTION ON TUESDAY, NOVEMBER 6, 2012, TO CONSIDER AN ORDINANCE TO MODERNIZE THE CITY'S TELEPHONE USERS' TAX WHEREAS, residents of the City of Chico currently pay a telephone users' tax (UUT}; and WHEREAS, the City uses the revenue from this tax to provide important and essential public services; and WHEREAS, communications technology has advanced significantly over the years since the UUT was unposed, and the City must update its WT ordinance to match current technology, including definitions for new commmunications technologies, to ensure all taxpayers are treated alike regardless of the type of telecommunications technology that they choose to use; and WHEREAS, the amendments would provide for a reduction in the tax rate from 5% to 4.5%, provide teclu~ical changes that reflect the changes in tech~~ology and billing practices that have occurred in the provision of telephone and telecommunications services: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF k CHICO AS FOLLOWS: 1. Pursuant to Section 500 of the City Charter and Elections Code ~ 9222 a general municipal election is hereby called to beheld on November 6, 201'2, to submit to the voters a proposed amendment to the Chico Municipal Code as set forth below: Measure A Shall an ordinance be adopted to amend the City's Yes Telephone User's Tax in order to: 1) reduce the tax rate ^ from 5% to 4.5%; 2} modernize the definition of telephone communication services subject to the tax to include new technologies such as wireless and voice over Internet No services; 3) apply the tax to all telephone communications services regardless of the type of technology used; and 4} reflect changes to federal and state law? 2. The text of the proposed amendment is set forth in the Ordinance attached hereto as Exhibit «A „ 3. Pursuant to Elections Code § 10002, the Board of Supervisors of the County of Butte is requested to authorize the County Clerk to cause all necessary ballots to be printed, prepare and distribute all sample ballot pamphlets and all absentee ballots, appoint all necessary election officials, make arrangements for precinct polls, procure and furnish to election officials all necessary supplies and equipment, and perform all other acts required to conduct this election on behalf of the City of Chico. 5. Pursuant to Elections Code § 10411, the Board of Supervisors of the County of Butte is further requested and authorized to canvass the returns of the election. 6. The City Cleric is directed to set a date for the submission of arguments for and against the measure, pursuant to the Elections Code, and to transmit a certified copy of this resolution to the Board of Supervisors and the County Clerk of the County of Butte. PRESSON, MMC, City Clerk Page 2 of 2 1 RESOLUTION NO. 32-~2 2 RESOLUTION' OF THE CITY COUNCIL OF THE CITY OF CHICO CALLING A 3 GENERAL MUNICIPAL ELECTION ON NOVEMBER 6, 201.2, FOR THE PURPOSE OF ELECTING FOUR MEMEERS TO THE CITY COUNCIL AND 4 REQUESTING CONSOLIDATION OF THAT ELECTION WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON NOVEMBER 5, 2032 S b WHEREAS, the City Council of the City of Chico hereby calls a General Municipal 7 Election to be held on November 6, 2012, for the purpose of electing four members to the City 8 Council, each serving for afour-year term ending in 2016; and 9 WHEREAS, it is desirable that the General Municipal Election be consolidated with the 10 Statewide General election to beheld on the same date and that within the city the precincts, 11 polling places and election officers of the two elections be the same, and that the county election 12 department of the County of Butte canvass the returns of the General Municipal Election and that 13 the election be held in all respects as if there were only one election; 14 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHICO DOES 15 RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: 16 1. Pursuant to Elections Code §10403, the Board of Supervisors of the County of Butte is 17 requested to order consolidation of this General Municipal Election with the Statewide 18 General Election to beheld on November 6, 2012, in all precincts of the County of Butte 19 within the incorporated territory of the City of Chico, and to authorize the County Clerk 20 to cause all necessary ballots to be printed, appoint all necessary election officials, make 21 arrangements for precinct polls, procure and furnish to election officials all necessary 22 supplies and equipment, and perform all other acts required to conduct this election on 23 behalf of the City of Chico. 24 2. B cer, ttorney S:1Electian12012 ElectionlReso calling for 2012 election.wpd Page 2 of 2 RESOLUTION NO. 33-12 2 4 6 7 8 9 10 11 12 13 14 15 1G 17 18 19 20 21 22 23 24 25 26 27 2$ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHICO CALLING A GENERAL MUNICIPAL ELECTION ON TUESDAY, NOVEMBER 6, 2012, TO CONSIDER A RESOLUTION SUPPORTING A CONSTITUTIONAL AMENDMENT STATING THAT CORPORATIONS ARE NOT ENTITLED TO A CONSTITUTIONAL RIGHT TO POLITICAL FREE SPEECH WHEREAS, the City Council has adopted a resolution finding that the ability of corporations to expe3~d money on political campaigns should be regulated and, to the extent that such regulation is impermissible, that the United States Constitution should be aanended to allow such regulation and to establish that corporations are not entitled to a constitutional right to political free speech and that the expenditure of money by corporations to support or oppose political campaigns is not entitled to the free speech protections of the First Amendment and should be regulated, limited and clearly disclosed; and WHEREAS, the City Council has directed that a measure 6e submitted at the November 6, 2012, election to provide the voters with the opportunity to vote on the adoption of a resolution to the same effect: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHICO AS FOLLOWS 1. RESOLUTION OF THE CITY OF CHICO SUPPORTING A CONSTITUTIONAL AMENDMENT STATING THAT CORPORATIONS ARE NOT ENTITLED TO A CONSTITUTIONAL RIGHT TO POLITICAL FREE SPEECH WHEREAS, the ability of corporatians to expend unlimited amounts of money to influence political campaigns allows corporations to unduly influence and impact those political campaigns in a manner which is detrimental to the democratic process: NOW, THEREFORE, BE IT RESOLVED by the People of the City of Chico as follows: The ability of corporations to expend money on political campaigns should be regulated and, to the extent that such regulation is currently impermissible, the United States Constitution should be amended to allow such regulation and to establish that: 1. Corporations are not entitled to a constitutional right to political free speech; and 2. The expenditure of money by corporations to support or oppose political campaigns is not entitled to the free speech protections of the First ,Amendment and should be regulated, limited and clearly disclosed.
