Dear Secretary Bose,
The Califomia Department of Water Resources (DWR.) filed with the Federal Energy Regulatory
Commission (FERC) an application for new license to operate the Oroville Facilities
0 V%roj I FR. P -ect No. 2100 (Project). Consequently, under its Clean Water
Hydroelectric Ir "ect,, r0i
Act authorities the State of Caliform'a's Water Resources Control. Board (Board) issued a Water
Quality Certification Order (WQ 2010 -0016) for the proposed Project. Because the Board s
Water Quality Certification Order requires material changes to the proposed Project, NMFS now
requests that FERC clarify the status and scope of the proposed action (issuing, a new Project
