We were informed that they didn't have an interest in this kind of consumer protection. I summit that they need to change the name of that office! The gentleman at the DA's office suggested we hire an attorney or take the stater-nents to a news source who may take an interest! We are an Social Security and cannot afford to even step into an attorney's office let alone hire one. like so many other senior citizens, we really have no protection from the greedy. We are naive enough to think that the law can protect us from situations such as this. We are asking only that a quick investigation take place to see if the citizens of Butte County are being treated fairly. We have no intentions of suing Rite Aid, would be nice to have them return the $31450 and to apo!agize but considering large corporations don't o that, wi[I settle with the knowledge you were able to correct a bad situation. These large retail corporations have at their discretion, a Civil Code that does not allow an accused person the opportunity to defend themselves. They simply have to turn their paper work aver to a out of state "Puppet Attorney's Organization" who asks no questions, refused to listen to any objections and who can set a dollar figure with impunity, and then threaten with further fines and criminal action if they are not paid within 24 days. When I asked how they determine what the fine should be, I was told it was none of my business! 2. This Civil Code begs to be exploited by Security Managers wishing to validate their position, look good to the company for promotions and who have very low ethics. When I asked the District Security Manager why they will not call the police when asked to, he replied that they don't because "there is a 50/50% chance that the police may not side with the store!" That should throw up a red flag that there is blatant abuse of this Civil Code. We truthfully believe that the Security Manager and the Checkout Cashier may have a scam going to enhance their positions with the Rite Aid Corporation. All we ask is that someone investigate this. Considering the violence my wife was threatened with while in the Security Managers office. His assertion #hat he didn't have to call the police, and she had no recourse but to sign the paper admitting she willingly stole store property or horrible things were going to happen to her. I suggest that this Security Manager lacks the wisdom necessary to do the fob properly. It is VERY easy to scare and intimidate a 69 year old woman, who has never been in any kind of trouble in her life, who will sign anything in order to stop the abuse . This man did not have to abuse her, he only had to write her up and turn her loose! Ne did not have to open the door to his office so that customers standing in line by the office, could hear him berating her, threaten to handcuff her in front of the Customers and charge her $544.00 if she didn't sign the paper. COME ON, she is 5'2" and weights, soaking wet, 124 Ibs. Please read her statement, if this is something your office can't handle, please pass it on to whoever you think could. If YOUR wives had been accused and treated like this, you would use ALI. your influence to put a step to it. Why should my wife not have the same attention and protection? is it not the responsibility of some organization within this county to protect the citizens of Butte County from this? This may sound like such a small issue but consider how many shoppers and how many retail stares there are in the state, that translates into lots of money being extorted by corporations without any consumer protection! By now you are asking yourselves;"what does this guy want from the county supervisors7" !would like for you to enact an ordnance in Butte County to require al! stores to involve law enforcement with any shoplifting charges. To allow the accused, the opportunity to defend themselves. am aware that an attempt to pass such a ordnance will prompt a violent re~ectian from the various retail corporations and you will have to get permission from your respective Party Headquarters but it will draw attention to a Civil Code which somehow was passed at the expense of the citizens of California by special interest money. My husband is also retired after 50 years of being an Aero Space Research and Development, Engineering Machinist. We have a comfortable retirement income. I mention this because of the following incident 1 experienced at the local Oroville Rite Aid Store. March 5, 2013 i was shopping at the local Rite Aid store when I experienced the following incident. Hereafter the term Security Manager will refer to Mr. Brad Beecham as Rite Aid AP Agent and the store clerk, cashier will refer to Ms. Tammy G. fast name not noted on incident report and Mr, Clint Congdon as AP District Security Manager. After shopping for approximately 4S minutes, I checked out at the cashiers stand, paid for the items l had in my cart and started to leave the store, As i ~~ stepped outside the door, 1 was confronted by a young rnan= He turned out to be the Security Manager. He asked me what I was stealing from his store. I had no idea what was talking about. He continued to ask me to tell him what (had stolen. I finally told him if he believed I had stolen something, he needed to tell me what he was talking about. At this time he lifted up my purse. At that point used a swear ward and started to say I had forgotten about those items. The young man would not even listen to me. He immediately told me I was lying and l came into the store with the intent of stealing. These items were in the child seat, under my purse. The total amount of these items was $17.45. I immediately offered to pay for the items and told him had I been allowed to make it to my truck, I would have seen them and come back in the store to pay for the items. This offer was instantly declined, with him stating they were evidence of my crime, i was stunned to say the least but when I tried to explain that I had simply forgotten the items, the security manager wauld only yell at me that I was a liar and thief. After he had shown me the items under the purse, he had stated that he had turned customers loose with much more merchandise than he saw under my purse and if I would ONLY tell him the truth, he would let me go. He stated that he had known I was a shoplifter from the minute I entered the stare and he had been watching me the whole time knowing 1 was going to steal from the store! He would not allow me to speak, every time i tried to explain I had forgotten about the items. He would constantly interrupt me every time 1 would open my mouth in an effort to defend myself that I had not intentionally tried to steal from the store. Again, I offered to pay for the items and again, that offer was refused. Instead, I was led inta the security office. ~At this time I would like to try to detail my time in the store as best as I remember. Entered the store, picked up one of the ads at the display rack, placed it in the child seat, check out the ads and went to the restroom at the pharmacy area. Came out of the rest roam and went to the make up area where I did pick up several~~ or 4) items and placed those items in the child seat on top of the ad 3. paper. I did this because small packages tend to fall out of the lower basket area. l then went to the ice cream counter and purchased a ice cream cone(At this time I took my purse off my shoulder and placed it in the child seat in order to pay for the ice cream cone) which 1 ate as I went back to the freezer area to obtain a gallon of ice cream. From there I had noticed large planters and I obtained one of those and a plant watering can, From there I went to the check out counter. I do move slowly as l have to walk with a cane in a stooped position so I wasn`t rushing around the store. Takes me time to look at things!} The Security Manager indicated that 1 follow him and the check out clerk into his office which l did and from there the fallowing events took place. He closed the office door and started accusing me of being a thief, a liar and never allowing meta speak stating all i could do was lie. If 1 tried to speak he would Interrupt me. Atone point in this "interview"aline of customers had formed outside the office at the photo desk and he opened the office door so the customers could hear him berating me for being a liar and thief. While I was trying to defend myself, the check out clerk stated that after l had paid for the items had taken out of the cart, she asked me if there was anything else and i had said "no". While I was checking ou#, the clerk and l were talking about the trip I was going to take to Tennessee the next day to see my new born Granddaughter so I really do not remember her asking if I had anything else. That is a common courtesy question all clerks ask when checking out, I always supposed it was to remind a customer of any other product they may have forgotten to obtain while shopping. Not to entrap a customer if she saw items in the cart which had been forgotten and could later be used to accuse the customer of shoplifting! I am certain she saw the items under my purse because it was she and the security manager who met me at the exit as I was attempting to leave the store. Why did she not simply ask about the items she could see under the purse? if she could see the items under the purse, how could it be said I was hiding those items so as not to pay for them? I had paid for everything else I had bought up to the check out counter. -~ themselves? This law also allaws the Corporation(notsomcone with legal authority} to set a fine value of any value they wish, After contacting the Law offices in 1=lorida inquiring how this $300.00 fine was determined, I was told they could make the fine any figure they wanted and I had no recourse what so ever and if not paid in 20 days could be made higher! So i am paying the fine because I have no protection from "due process" in a Caurt of law if I don't! I consider this fine to be extorkion with the blessing of the state of California. There fore, I am officially asking the Butte County District Attorneys Office to investigate the Oroville Rite Aid Store to determine if; 1. Does this store have a policy intentionally entrapping customers who mistakenly did as I did, and is Rite Aid using the Civil Code 490.5 to extort money improperly from unsuspecting customers, in particular elderly, confused customers. The elderly are easy targets due to poor eye sight, confusion and easily being distracted by stare personnel at the check out station. 2. To order all stores in Butte county to immediately call the appropriate law enforcement organization with jurisdiction to meditate between the accused customer and the store to determine if a crime has actually been purposely committed. (Example is when I asked the AP District tVlanager why the Police were not called? He stated that they don't do that because there is a 50/50% chance that the Police would have agreed with me! That statement alone should prompt an investigation and make an order far Law Enforcement be at any shoplifting accusations.) 1 ask this to discourage stores from entrapping customers who mistakenly may have covered up merchandise, the check out clerk saw the items and without bring them to the attention of the customer, allowed the customer to leave the store and then call the security manager. 1f a check out clerk can visually see items in a basket, he/she HAS the obligation to bring it to the attention of customer. I am NOT referring to customers who were seen trying tv hide items in 6, pockets, IN purses, In hollow items, in other words, intentional attempts to conceal merchandise with the intention of theft. I feel it is for the protection of Butte County residents that it be determined if a policy of entrapment, such as this, has been setup by the store security manager . am attempting to erase a false accusation of intentional shoplifting from my name. Not to bring civil action against Rite Aid. [have never been in trouble with the law in my life. Having been entrusted with large sums of money as a cashier, been entrusted in my occupation as an I.VN for 35 years, with medicine cabinets full of schedule 1 drugs and patients lives. I do not need a false claim such as this to follow me the rest of my life in order for a store security manager to justify his existence within the company organization.
