The enclosed report is submitted pursuant to Health and Safety Code Section 25180.7
(Proposition 65). The report documents information regarding the illegal discharge (or
threatened illegal discharge) of hazardous waste, which could cause substantial injury to
the public health or safety. The report is being submitted on behalf of all designated employees
of the Department of California Highway Patrol.

1 Sequence of Events

3 On May 25, 2018, at approximately 0650 hours, Mr. Arturo Villavicencio was driving his 1988
4 Freightliner while towing two empty flatbed trailers. He was southbound on SR-99 in the
5 number two lane approaching East Avenue at approximately 50 mph. Due to the heavy rain, Mr.
6 Villavicencio hit a large puddle in the roadway and felt his vehicle start to fishtail. He lost
7 control of his vehicle and left the roadway to the west and traveled onto the dirt shoulder/median
8 area. He continued across the dirt median area and across the East Avenue on ramp to 8R-99
9 southbound. At the same time, Ms. Haley Ward was entering SR-99 from East Avenue using the
10 on ramp. As Mr. Villavicencio's vehicle crossed the on ramp, Ms. Ward struck the right side of
11 his vehicle, rupturing the fuel tank. Mr. Villavicencio's vehicle continued and came to rest on
12 the shoulder next to the on ramp. Due to the location at the vehicles point of rest, the fuel
13 rupture was unnoticed until the vehicle was being removed from the scene. The leak was also
14 small in nature. Chico Communications Center was notified of the collision via 911 calls.
15 Officers Kurt Powell and Nick Powell responded to the scene. Officer Kurt Powell was the one
16 to handle the collision investigation.

18 The result of the collision with Ms. Ward cracked fuel tank which resulted in approximately 60-
19 70 gallons of diesel fuel to seep out onto the dirt under the fuel tank. Cal Trans personnel was
20 also summoned to the scene when the collision occurred. They are facilitating the cleanup of
21 contaminated soil.

29 Cal Trans Supervisor Chris Alpers was on scene along with other Cal Trans personnel.
30 Supervisor Alpers is handling the cleanup procedures of the contaminated soil.

41 The tractor trailer combination came to rest blocking the southbound on ramp from East Avenue.
42 Due to the blockage, the on ramp was closed until the vehicle was removed.

3 Environmental impact was Iow and Cal Tans is working with Patriot Environmental to perform
4 the necessary cleanup and removal of contaminated soil.

6 Actions of other agencies

8 On scene CHP personnel made all the necessary notifications and notified OES of the spill and
9 were given an OES control number of 18-3374. Cal Trans officials were also notified and
10 responded to the scene.

12 Other information

14 A Site Safety Plan (SSP) and an Incident Action Plan (IAP)was prepared by Sergeant D. Canalia
15 and CHP Officer In Charge Kurt Powell. Valley Division Commercial Officer Forrest Baker was
16 deemed as Safety Officer.
