Subject: Board of Supervisor agenda item scheduled for December 11, 2018, regarding Stanley Avenue
development. (TSM17-0001)
The Butte County Planning Commission and Board of Supervisors have approved the clustered housing
development on Stanley Avenue (TSM17-0001). While the development has been approved (despite
the neighbor's objections),we believe there are a number of details of the project that will affect the
well-being of the neighborhood and for which we should have some input.Some of these details include
the following:
1. The County has an announced a hearing on December 11, 2018, at a time when many of us are
involved in helping and housing our Paradise neighbors. Therefore,we are asking the Board to
reschedule this agenda item for a later meeting.
2. We find that the open space management plan incomplete and inconsistent with the intent of
the clustered housing ordinance. First, it preserves no land for agricultural purposes, instead
converting its historical agricultural use to a combination of weeds and community waste water
disposal. Second, it preserves no sensitive resources unless the natural weed growth on the
property is considered a sensitive resource. Third, it does not reduce the need for park land
elsewhere as the property is to be fenced (what kind of fence and does fencing it qualify as
security preventing unauthorized use?) and no recreational use is permitted. If it is to be left in
a natural state (not a neglected state),then require the applicant to recreate the oak forest that
it was prior to the recent agricultural uses and more recent neglect. Completeness of the
management plan should require specification of ownership of Lot A, as well as a well-defined
program for protecting the property from unauthorized use that potentially results in negative
impacts on surrounding property owners. A management plan with pages"intentionally left
blank" does not constitute a complete plan. A decision on the plan must await a written
version of a complete and adequate plan with sufficient time for the public to review it. From
what was emailed to us,we can't see how that can be accomplished prior to the December 11
meeting.
3. We understand that the developer's"fair share" of the Stanley Ave. road improvements has not
been determined. County Counsel indicated that the Contractor should pay between 60 and 65
percent of all road improvement costs,while Mr. Leen's attorney believes the Contractor should
only pay 20 percent of all such costs. In addition, it has not yet been determined how best to
spend the developer's financial obligation for mitigating traffic impacts on Stanley Avenue. The
traffic engineer indicated that the priority should be to realign the intersection with Dayton
Road and then to widen Stanley as far to the east as allocated funds will allow. Yet, does that
give us the greatest increase in safety per dollar spent? Perhaps a plan that would achieve
greater benefit—one that could be 100 percent financed with available funds—would be to add
traffic calming devices (15 to 25 mph speed bumps)on Stanley Avenue,widen the road
uniformly to 18 feet(that would involve one or two small sections and minimal expense), and
there are sufficient funds,add a left turn lane on Dayton Road. Please email me road
improvement plans well in advance of the scheduled public hearing, so I can pass it on to my
neighbors.
In closing, please reschedule this agenda item for a later Board meeting. Because of the Campfire and its
impact on all County residents, we have decided not to appeal your approval of this development.
However, please give serious consideration to our concerns and allow us meaningful input where legally
appropriate. Thank you.
