Governor Brown signed bill SB229 and AB494 obligating counties to allow 2nd dwellings on properties unless it has been deemed a safety or health hazard. The above mentioned project has more than ample room to accommodate a larger sewer system however the developer and engineer have intentionally designed their system to circumvent possible 2nd units being created. Their intention to restrict 2"d dwellings appears to be a decision to reduce development costs rather than to provide adequate systems to address the potential for those units. The following is a quote from Staff at Butte County: "Findings to restrict Second Dwellings/Accessory Dwelling Units to protect public health and safety. • The wastewater disposal area as designed and proposed on the map will not accommodate the increase of wastewater flow that would occur if more than one equivalent dwelling unit(FD U)per lot were allowed and still be in compliance with the Onsite Wastewater Manual and Butte County Code Chapter 19(On-Site Wastewater Systems). •Section 19-17(A.)declares that "all violations of Butte County Code Chapter 19 and the Onsite Wastewater Manual are determined to be unlawful and declared to be detrimental to public health,safety and welfare, and are public nuisances." Since the current design won't accommodate the increase of wastewater with 2r,d units as designed,then why isn't the developer being made to provide a sewer system that will. Perhaps the developer, engineer and Staff are more concerned with how much more this will cost instead of how it will affect those residents or the neighborhood.
