Dear Butte Supervisors,
Regarding funding Community Action Agency, our hope was that at the very least, you could demand that
agencies receiving funding from our County follow the State laws they are under. Granted there has been,
some debate as to whether CAA must follow the Brown Act and California Public Records Act, but that is
irrelevant now that we know the Freedom of information Act (FOIA) applies.
Yesterday, we again provided all the information that your county counsel needed to see the legal basis for
the laws governing California CAA's. It is a bit strange, since FOIA usually only applies to government agencies.
However, CAA's in California are an exception to this. Makes sense because they receive billions of taxpayer
dollars.
But perhaps imost convincing is the fact that the FOIA had been in the Butte CAA by-laws for decades,
because it was the law) only just now "disappearing" in 2016. This was a deliberate act, unbeknownst to the
CAA board members at the time it was done. Why?
The reality is, Butte CAA is breaking the law. They are also in violatiion of the their own by-laws in several
areas. There is a reason for this, or why risk it? This is simply unacceptable to us, and while it is unfortunate
that we will now have to continue with our attorney, we feel it is the right thing to do.
