It is most interesting and enlightening. He points out some of the errors that accompanied the planning commissions decision to deny the subdivision and their subsequent findings. He also makes the case that there is no legal reason this subdivision shouldn't be approved. The way I read his letter and analysis, it will be difficult for the supervisors and county attorneys to make findings that can be defended, if the subdivision is denied. Staff is recommending approval. I would like to point out ONE very critical point. There is only ONE neighbor in this whole area of the STANLEY AVE. NEIGHBORHOOD, that could be potentially affected or impacted by the supervisors approval of this subdivision, and that is Mr. George Nicolaus, the walnut farmer to the south. Under the county's RIGHT to FARM provision, that should be protection enough, but we are willing to take it one step further. We are offering to record a deed restriction that will consist of a waiver of all the lot owners rights to legally contest any properly conducted farming practices. This waiver shall include, but shall not be limited to, any dusts, sprays, noise or additionally, anything that may become an annoyance or inconvenience to the lot owners. We hope this helps.
