At its October 24, 2013 meeting, the Board directed ARB staff to develop a number of proposed changes to the regulation that could provide fleets additional flexibility in complying with the regulation. In developing these changes, staff will evaluate them to ensure that emission levels remain similar to what would be expected under the current regulation, and do not jeopardize a region's ability to meet health-based federal air quality standards. The potential changes include: • increasing low-use vehicle thresholds; • allowing owners to newly opt-in to a number of existing flexibility provisions; • expanding the regions that meet the definition of "NOx exempt," and; • providing additional time for fleets in some areas to meet the regulation's particulate matter requirements. At these workshops, staff will be soliciting input on the proposed amendments and the analytical methodologies that will be used In the supporting technical analysis. Staff plans to present proposed regulatory amendments to the Board at Its April 2014 meeting The Board also directed staff to allow fleets the opportunity to report their intent to take advantage of the planned regulatory changes before staff presents them to the Board for approval, Staff has posted an advisory describing how fleets may report and take early advantage of the proposed changes at: http://www.arb,ca.govimsProgionrdiesel/requlation,htm. Background The regulation requires diesel truck and bus owners to take steps to reduce their engine emissions. The regulation Is a part of the State's plan to meet federal ambient air quality standards and to protect public health, particularly near roadways:and distribution centers where exposure frequently reaches unhealthy levels. Nearly all trucks and buses with a manufacturer's gross vehicle weight rating greater than 14,000 pounds that operate In California are required to be upgraded between 2012 and 2023 to reduce exhaust emissions. Most heavier trucks and buses (with a gross vehicle weight rating greater than 26,000 pounds) will be required to have a particulate matter filter by January 1, 2014, There are certain exceptions to these requirements for owners that have reported to use flexibility options allowed under the regulation, These include, but are not limited to, certain agricultural and limited-use construction trucks, low-use vehicles, and vehicles operated in certain rural areas. All Interested Parties November 14, 2013 Page 4 Additional Information The presentation, as well as any additional material, Including proposed regulatory language, will be available prior to the workshop at: http://www,arb.oa,dov/dieseltruck.
