Johannsen/ Board members, Please see the attached letter from I. Johannsen re: garbage pickup. This is the best scan that I could produce. I will forward hard copies to each of your offices. Because the very last line of the letter is slighty cut off on the scanned version, I will attempt to translate that entire sentence. Here is how I read it: "Can there a fine ($25) be imposed on the garbage companies when garbage is not picked up on time? (same day?)" Again, I will forward a hard copy of the letter to your District Offices. O'Brien, Assistant Director (530) 538-7fi81 Re: Trash Pick-up Dear Mr. Johannsen: (FAX) 538-7171 I am responding to your letter to the Butte County Board of Supervisors dated September 19, 2014, where you requested the Board to establish a $25.00 fine to the local garbage companies if they missed picking up your garbage on its scheduled day. The County is in the process of negotiating franchise agreements with the three local waste haulers that serve the County. If we are successful, and enter into the franchise agreements, the agreements will require your waste hauler to provide a special pick up or other corrective action acceptable to you within 24 hours ofr the missed pick up as well as a potential fine if they consistently have this problem. Below I have attached the proposed Franchise Agreement section on Missed Collection for your information. If you have any questions, please don't hesitate to give me a call at (530)538-7681. ASSince Mike Crump Director of Public Works cc: Butte County Board of Supervisors 4.2.7 Missed Collection The Contractor will provide a special pickup, or other corrective action acceptable to a Customer, within twenty- four (24) hours (Saturdays, Sundays and holidays excepted) of oral or written notice to the Contractor of a missed scheduled collection at no charge to the Customer. If the Contractor does not provide corrective action in a timely manner, the County may perform the collection or cause the collection to be performed by a third party, and the Contractor shall reimburse the County for its costs for such collection. In cases where the Contractor has documented that the Customer's Container was not set out at the normal service time, the following conditions apply: (I) for the first occurrence each year the Contractor shall pick up the Container, within twenty-four (24) hours of oral or written notice, at no charge to the Customer, and (2) for each subsequent occurrence that year, the Contractor can charge the Customer a "return trip charge" if the Customer requests collection prior to the next scheduled service day for that Customer. 9.
