]n a Getter of Map Revisinn {CONK) dated September 29, 201 1, you were notified of proposed modified
f[oad elevati'un determinations affecting~the Flood Insurance Rate Map (FIRM.) and I=1ood Insurance
Shady (FIS) report for Butte County, CA. These determinations were far Butte Creek Right Levee Failed -
Above Midway -from immediately upstream of the intersection of Stanford Lane and Sycamore Lane to
approximately 2,400 feet upstream of the intersection of Durl3am Dayton Highway and .lanes Avenue
along Jones Avenue, The 90-day appealperiod that was initiated on October 14, 2011, wlten the
Department of Homeland Security's Fedora[ Emerger3cy Management Agency (FI;MA) published a
notice of proposed Base Flood Clevatiorjs (LiFEs) i~~ :flte Claicn EntcF~~ri.se-ReCOj'd, has elapsed.
FEMA received nn valid requests E'er changes to tl~e modified BFES. Therefore, the modified B>~Es that
became eT'fective on .[=obruaz;~ l3. 2012, remain valid and revise the FIRM and ]vTS report that were in
effect prior to that date.
The modifications are pursuant to Section 206 of the Flood Disaster Protection Act of 1973 (Public
Law 93-234) and are in accordance; with the National Flood insurance Act o~ 1968, as amended
(Title XI11 of Ehc Housing and {Jrban Development Act of 196$, Public Law 90-448), 42 U.S.C.
40{] 1-4128, and ~l~l CIryR Part 65. Tbc cormmunity numlaer(s) and suffix code(s) are unaffected by this
revision. The community number au~d appropriate sufli~ code as shown above wit[ be used by the
Natioral Flood Tnsurance PE-agram (NFIP) for al] flood insurance policies and renewals issued for your
commEU~ity.
FkMA I~as developed criteria for floodp]ain management as required under the above-mentioned Acts of
1968 and 1973. To continue participation in the NI~ lP; your community must use tl~e modified BFES to
carry out the f7oodplain management regulations for tltc NFTT'. The modified BFES will also be used to
calctilate the al~prapriatt flood insurance prerniuzn rags for all ue~e~ buildings and thee' contents and for
the seccmd layer of insurance on existing buildings and their contents,
