Thank you for your letter of November 17, 2010, concerning the Butte County Fire Department's
award (EMW-2009-FH-00535} from the fiscal year (F'Y~ 2009 Staffing for Adequate Fire and
Emergency Response (SAFER) Grant Program. Your letter clearly described the organization and
structure of the Butte County Fire Department and clarified the roles of the Butte County Board of
Supervisors and the California Department of Forestry and Fire Protection (CAL FIRE}.
As you know, the Federal Emergency Management Agency (FEMA) received inquiries about the
eligibility of subcontracts under the Butte County Fire Department's SAFER grant. FEMA's
Office of the Chief Counsel reviewed the information and determined that there are na legal
concerns with Butte County's SAFER grant as long as the Department maintains oversight
of the employees contracted to work on it. The Grant Programs Directorate has consequently
determined that Butte County is free to proceed with its SAFER grant.
