The original notice is posted on the Commission's website at www.fgc.ca.gov and is available upon request by contacting the Commission office at the letterhead address, phone number, facsimile number, or e-mail address. During the regulatory process to amend Section 632, changes were made in the originally proposed regulatory language, which is scheduled for adoption at the Commission's August 5, 2009, meeting. Two options now exist within the Integrated Preferred Alternative (IPA) regarding Sea Lion Cove State Marine Conservation Area (SMCA): Option 1 includes Sea Lion Cove as originally proposed, and Option 2 removes Sea Lion Cove from the proposed IPA network. In addition, within the revised proposal, a correction to the southern boundary has been made to Salt Point SMCA in both the IPA and Alternative 3. The southern boundary has been adjusted by one half minute (0.5) northward. No other changes have been made to the proposed regulatory language.. The revisions are found on pages 2, 3, and 41 of the attached revised proposed regulatory language. Because these regulations are different from, yet sufficiently related to, the originally proposed regulations, the Administrative Procedure Act requires that we make these changes available to you for at least a 15-day written comment period. This is also to provide you with the notice of availability of the revised Initial Statement of Reasons Attachment 2: "Detailed description, objectives and maps of the preferred alternative (IPA)"and the revised Economic and Fiscal Impact Statement (Std. 399) for this rulemaking. Please note the date and location of the public hearing related to this matter and associated deadlines for receipt of written comments. Based on direction from the Commission at its May 14, 2009 meeting, the revised proposal adds an option within the Commission's Preferred Alternative to remove Sea Lion Cove SMCA. In addition the revised proposal corrects an error in the southern boundary of Salt Point SMCA in the Preferred Alternative and Alternative 3 and moves its boundary northward by 0.5' latitude to align with the Salt Point State Park land boundary. No other changes to the originally noticed regulatory text have been made. Special restrictions on boating and access apply to Point Resistance Rock as follows: A A special closure is designated in all areas closer than 300 feet from the mean lower low tide line of any shoreline of Point Resistance Rock located in the vicini of 37° 59.92' N. lat. 122° 49.75' W. long. B No person except de artment employees or employees of the United States Fish and Wildlife Service National Park Service or United States Coast Guard in performing their official duties, or unless permission is granted by the department, shall enter this area at any time. 26 Double Point/Stormy Stack Rock Special Closure. Special restrictions on boating and access apply to Stormy Stack Rock as follows. A A special closure is designated in all areas closer than 300 feet from the mean lower low tide line of any shoreline of Stormy Stack Rock located in the vicinity of 37° 56.83' N. lat. 122° 47.14' W. (B) Except as permitted by federal law or emergency caused by hazardous weather, no vessel shall be operated or anchored at any time from the mean high tide line to a distance of 1000 feet seaward of the mean lower low tide line of any shoreline of North Farallon Island or to a distance of 300 feet seaward of the mean lower low tide line of any shoreline of the remaining three islets including the Island of St. James in the vicinity of 37° 46' N. lat. 123° 06'W. lam_ (C) No person except department employees or employees of the United States Fish and Wildlife Service, National Oceanic and Atmospheric Administration, or United States Coast Guard in performing their official duties or unless permission is granted by the department shall enter the area defined in subsection 632(b)(28)(B)_ (D) All vessels shall observe a five (8) nautical mile per hour speed limit within 1,000 feet of any shoreline of the three southern islets in subsection 632 b 28 B . All commercial diving vessels operating in the defined area shall terminate their vessel engine exhaust system either through a muffler for dry exhaust systems, or below the vessel waterline for wet exhausts stems. 2. All commercial diving vessels equipped with an open, deck-mounted air compressor system, while operating in the defined area, shall have the air compressor's engine exhausts stem terminate below the vessel waterline. Iona.: 37° 40.50' N. lat. 123° 2.00' W. long,: and 370 42.60' N. lat. 923° 2.00' W. long_ B Take of all living marine resources is prohibited except: 1. The recreational take of salmon by trolling subsection 27.80 a 3 onl is allowed. 2. The commercial take of salmon with troll fishing gear [subsection 182.1(1)] only is allowed. 36 Southeast Farallon Island Special Closure. Special regulations on boatin and access a i 'to the Southeast Farallon Island as follows. A A special closure is established at the Southeast Farallon Island. B Except as permifted by federal law or emergengy emergencycaused by hazardous weather, no vessel shall be operated or anchored at any time from the mean high tide line to a distance of 300 feet seaward of the mean lower low tide line of an shoreline EXCEPT at Fisherman's Bay between a line extending due west from 370 42.26' N. lat. 123° 01.16' W. long. and a line extending due east from 37° 42.05' N. lat. 1230 00.07' W. long., and at East Landing, between a line extending due east from 37° 41.83' N. lat. 1220 59.98' W. long. and a line extendingfrom 370 41.72' N. lat. 1230 00.05' W. long. to 370 41.68' N. lat. 1230 00.07' W. long. This closure exists year round except that the southeast side of Saddle Seal Rock between a line extending from 37° 41.76' N. lat. 123° 00.16' W. long, to 37° 41.64' N. lat. 123° 00.16' W. long. and a line extending from 37° 41.60'--N. lat. 1230 00.26' W. long. to 370 41.60' N. lat. 1230 00.32' W. iong., is closed only from December 1 through September 14 of each ,year. 50 C No-person except department employees or employees of the United States _ Fish and Wildlife Service National Oceanic and Atmospheric Administration, or United States Coast Guard, in performing their official duties, or unless permission is granted by the department, shall enter the area defined in subsection 632(b)(36)(B). (D) All vessels shall observe a five (5) nautical mile per hour speed limit within 1.000 feet of any shoreline of the Southeast Farallon Island. (E) In an area bounded by the mean high tide line and a distance of one nautical mile offshore any of the islands and islets comprising the Southeast Farallon Island the following restrictions apply- 1. (C) Only lightweight, hand-carried boats may be launched or operated within the park. { 38Peytonia Slough State Marine Park. (A) This area consists of waters below the mean high.tide line within the Peytonia Slough Ecological Reserve. (B) Take of all living marine resources is prohibited except the recreational nook and line take of species other than marine aquatic plants. (C) Only lightweight, hand-carried boats may be launched or operated within the park. (29) 39 Corte Madera Marsh State Marine Park. (A)This area.consists of waters below the mean high tide line within the Corte Madera Marsh Ecological Reserve. (B) Take of all living marine resources is prohibited except the recreational hook and line take of species other than marine aquatic plants from shore only. (C) Only lightweight, hand-carried boats may be launched or operated within the park. (D) Swimming, wading, and diving are prohibited within the park. 40Marin Islands State Marine Park. (A) This area consists of waters below the mean high tide line within the Marin Islands Ecological Reserve. (B) Take of all living marine resources is prohibited except the recreational hook and line take of species other than marine aquatic plants from shore only. (C) Boating, swimming, wading, and diving are prohibited within the park. (M 41 Albany Mudflats State Marine Park. 51 (A) This area consists of waters below the mean high tide line within the Albany Mudflats Ecological Reserve. (B) Take of all living marine resources is prohibited except the recreational hook and line take of species other than marine aquatic plants from shore only. (C) Boating, swimming, wading, and diving are prohibited within the park. (2-3,)L4,2j Robert W. Crown State Marine Conservation Area. (A) This area is bounded by the mean high tide line and a distance of 150 feet seaward of mean lower low water, between the following points: 37° 45.97' N. lat. 122° 16.84' W. long.; and 37° 45.95' N. lat. 1220 16.52' W. long. (B) Take of all living marine resources is prohibited except: 1. Finfish may be taken recreationally by hook and line only. 2. Finfish and kelp may be taken commercially. 43 Redwood Shores State Marine Park. (A)This area consists of waters below the mean high tide line within the Redwood Shores Ecological Reserve. (B) Take of all living marine resources is prohibited except the recreational hook and line take of species other than marine aquatic plants. (C) Only lightweight, hand-carried boats may be launched or operated in within the park. { } 44Bair Island State Marine Park. (A)This area consists of waters below the mean high tide line within the Bair Island Ecological Reserve. (B) Take of all living marine resources is prohibited except the recreational hook and line take of species other than kelp from shore only. (C) Boating, swimming, wading, and diving are prohibited within the park. (D) No person, except state and local law enforcement officers, fire suppression agencies and employees of the department in the performance of their official duties or persons possessing written permission from the department, shall enter this park during the period February 15 through May 20. (E) Waterfowl may be taken in accordance with the general waterfowl regulations (Sections 502, 650, 551, and 552). 45 E Devil's Slide Rock S ecial Closure. Special restrictions on boating and access apply to Egg (Devil's Slide) Rock as follows. (A)A special closure is designated at Egga (Devil's Slide) Rocks from the-mean hi- h tide line to a distance of 1000 feet seaward of the mean lower low tide line of any shoreline of the three rocks that comprise E Devil's Slide Rock located in the vicinity of 37° 34.65' N. lat. 1220 31.29' W. long., 370 34.66' N. lat. 122° 31.32' W. long.: and 370 34.63' N. lat. 1220 31.29' W. long. (B) No person except department employees or employees of the United States Fish and Wildlife Service U.S. Bureau of Land Management, National Oceanic and Atmospheric Administration or United States Coast Guard in performing their official duties or unless permission is granted by the department, shall enter this area.
