Attached is a letter submitted by Mr. Marold Galliett,lr. This will be included in Board correspondence.
!n this Fetter, Mr. Galliett indicates that he wants to "formally protest" the conditional use permit for the Power House
Aggregate Project. This was an action of the Planning Commission which was appealable to the Board of Supervisor.
The public appeal period ended on Monday, November 5.
Since M r. Galliett did not specifically request an appeal in his letter, nor did he pay the appeal fee, we contacted him by
phone Tuesday, Nov. 6 to clarify if it had been his intent to file an appeal. hle stated that it was not his intent to formally
appeal the action. Ne indicated that he just wanted to goon record regarding his protest by providing this letter to the
Board.

Power House Aggregate
Project
Dear Members of the Butte County Board of Supervisors:
This letter is my formal protest of the proposed granting of a
conditional use permit to the Granite Construction Company for the
Power House Aggregate Project.
I cite as my reasons for this formal protest all of the unmitigated
impacts of this project set forth in my letter to the Butte County
Planning Commission dated Aprii 12, 2012 and May 2Z, 201.
I also note as reasons for this protest the following:
1. Failure of Granite Construction Company to apply for and obtain a
permit from the Central Valley Flood Control Board for a proposed
levee in the floodway of the Feather River.
2. Proposed 50~year extension of the invasion and occupation of the
Oroville Wildlife Area by the proposed heavy truck haul operation
of Granite Construction.
Twelve years ago, local residents objected to the granting of a
temporary permit granted Robinson Construction for heavy truck
haul through the Oroviile Wildlife Area. This permit at least had
the merit that it was probably the only practical route to haul
dredge tailings to the Robinson Plant, However, no such
justification now continues for the presently proposed haul
through the Oroville Wildlife Area.
Highway 70 offers a state owned and maintained haul route from
the proposed Granite Aggregate Pit to the Granite Plant. The haul
distance would be practically the same as the haul distance
through the Oroville Wildlife Area. Highway 70 is being improved
to a four-lane highway.
I object to the unpaid-for misappropriation of public lands in the
Oroville Wildlife Area by aprofit-making entity.
