Thank you for this opportunity #o have my concerns considered.
I have been a home owner in Oroville #or over 2D years. l five in a residential neighborhood with four
neighboring schools, Las Plumas High School, !-!elan Witcox Elm School, Golden Hi115 Eim School, and
Oakdale ~Im School. This area is also home to two very large community churches, The Mormon church
of Later Day Saints and the Nazarene Church that serve hundreds.
The neighborhood has always has pride in their families and hanles. In the recent years, because of the
Marijuana growers the neighborhood has diminished terribly. As you already know, with the economy and
the housing markek the way it is, you Can't just pack up and ga if you don't like what's happening in your
neighborhood. There seems to be little hope when we make Call after call to law enforcement and
nothing can be done. What abou# the Law abiding citizens?????

besides the smell it's a safety hazard.
I am now nervous and keep a loaded gun, becausa ! am scared of anyone who might choose to rob from
the gardens next to me, and violence might occur at anytime, even resulting In my home being broken
into yet again.
Another serious concern is the seasonal traffic that occurs at the marijuana growers homes. Obviously
this becomes an opportunity far them to make additional income as there are sales going on all times of
the day and night. I thought with schools, farniiies that don't choose this life style, and churches,
marijuana regulations would be in place far them as well.
It appears that medical marijuana can be comforting for khase that are seriously ill. This should be
purchased 'from a regulated distributor as other prescriptions are. The key word here is.. seriously i11...1t
seems as though people are approved for medical marijuana cards for things as simple as an ingrown tae
nail...to be funny. _
My main concern here is not to impose on the need of the seriously ill medical marijuana user- It is Simply
how myself and ethers in my neighborhood and cpmrr~unity are imposed On by not having appropriate
regulations.,
I just want to be free to feet safe, enjoy my Name and neighborhood.

Dear Supervisor Bill Connelly,
I must admit I' do not understand all the laws and f
requirements for the growth of Medical Marijuana but I have many
concerns about its regulation. I am a grandmother who with my
husband raised our seven children in this county. We love this
county and have felt very safe here. We have loved the people here
and their family values. We want the same for oux grandchildren,
but as I listen their conversations about our community I realize it
is not the safe ox innocent community it once was.
I rea11X encourage you not to approve the Medical Marijuana
Cultivation Ordinance as it is written. We need strong regulation
and no pooling of permits to put in large gardens. I would not like
to see people take advantage of these permits to our endangerment.
I am sure they will be hard enough to monitor with just individual
gardens: , .
Please do what you can to make our homes a safe and
pleasant place to be. So much appreciate your service to -our
county. I am sure it is not an easy task.

Dear Supervisor ,
Thank you fer year caring patriotic service on behalf of the citizens of Butte County. !truly appreciate a!I your
time and energy devoted to deciding extremely critics! issues that des! with the health, safety and constitutional
privileges we enjoy in this wonderful place that i call "home".
I have learned recently that the agenda for the May 4, 2011 Board of Supervisors meeting includes the
potential adoption and enactment of a Medical Marijuana Cultivation Ordinance (MMCO}, drafted by County
Staff: I believe the intentions of the Board have the good of the citizens in mind, however, I am writing to
respectfully and sincerely request that the ordinance NOT be approved as written. My reasons are as follows:
1. Butte County is much better than the drafted ordinance represents. We, the citizens of Butte County can
do better than this. As it stands now, the ordinance ion ua a is so weak that there ma as welt be no
ordinance at all.
2: The ex ressed u -ose and intent of the MMGO is to balance the needs of atients AND the health
safet and welfare of residents and businesses of Count .The proposed regulations heavily favor patients
and do NOT protect the interests of the rest of the citizens of our county.
3. The ex ressed ur ose and intent of the MMCO states that it does not allow non-medicinal or ille ai
cultivation distribution or consum tion of marijuana. The land use allowances granted by the current language
in fact enables marijuana production to become a huge illegal business venture, reaching well beyond easing
the bodily pain suffered by legitimately ill citizens.
4. Section 34-A5 describes the re istratinn and documentation re uirements of persons who wish to
produce marijuana. Then item (c} of the same section declares that persons cultivating certain numbers of
mature and or immature plants are NOT to be required to meet these requirements! This is a direct
contradiction of the proposed requirements_
5. Section 34A-18 states that nothin in the MMCO will re wire the enforcement of any provision of the
ordinance dealing with unlawful cultivation of marijuana. It makes no sense to have an ordinance that is not
meant to be enforced)
In my opinion, the ordinance proposed to strengthen the County`s position in controlling the use of marijuana
does the exact opposite: It enables more people #o take advantage of the County's weakened ability to control
it. This ordinance is actually unenforceable. Butte County will find the production of marijuana mushrooming
out ofi control with the acceptance of this ordinance.
I sincerely hope that more time will be granted to strengthen the proposed ordinance before it is adopted.

1 would like to express my absolute support far adoption of the Draft Medical Marijuana Cultivation Ordinance.
Medical marijuana cultivation is destroying entire neighborhoods and it is essential that it be brought into control
immediately. I believe this ordinance is the best method to achieve a balance between the true medical needs of
the community while controlling those elements that are in this enterprise for financial reasons only. This draft
ordinance appears to strike a very fair balance. Please consider making one very important change to the
ordinance as proposed. I request that you consider not allowing AIRY marijuana plants, mature or immature,
within 1,000 feet of places where children wiU congregate, including schools, parks, churches, BUS STOPS, etc.

Having attended the meeting at the Durham branch library last Wednesday evening, I
fully intend to attend the meeting on May 4~". However, I would like to make some
comments on the draft of the Medical Marijuana Cultivation Ordinance for your
contemplation prior to that meeting date.
I think on page 4, the fourth bullet should include bus stops along with the
areas/buildings mentioned and require the 1,000 foot setback for ANY size garden - do
not allow the 100 foot setback for small gardens with premises 115 acres in size or less.
understand we have a garden close to the adobe church right in town which would meet
the 100 but not the 1000, so it would be forced to close and rightfully so, since it_is also
very close to our school campuses.
I do think there should be some kind of registration fee imposed on all growers,
regardless of the number of plants, so that everyone in the county will have access to that
information for purposes of buying a home, seeing how close growers are to schools, etc.
and to prevent retaliation from neighbors having to report on neighbors. If you are not
familiar with it, please look up the video of Red Skelton and the Pledge; of Allegiance on
the Internet and pay particular attention to his words that the Pledge gives us the right of
power to live our own life without threat of fear or some sort of retaliation. Several
people have told me they are truly afraid of these growers and therefore are afraid to take
back our community from these growers by standing up in public. What a shame.
I ask that each of you consider passing this ordinance, if only to get something on the
books to keep people from migrating to Butte County from other counties that are in the
process of developing and implementing similar ordinances.

My 80 year old mother and I will be at the meeting on Wednesday night in support of the Draft Medical
Marijuana Cultivation Ordinance. I am sure the room will be full and I may not get a chance to speak so
I want you to know our position. It is very sad what has happened to our once safe neighborhood since
prop 215. (We live on Stanford Lane near Sycamore).
We may not be able to stay to the end, Mom gets tired, but we do want you to know that we hope you
will vote in favor of this Ordinance on Wednesday night. We also hope you will consider not allowing

I am writing to you tv convey a few of my thoughts regarding the proposed Marijuana Ordinance for Butte
County.
Living in Durham, I know that many of our neighborhoods are impacted greatly by the growing of marijuana. The
smell, the guns, the security presence of firearms as growers guard their crops-these are a few of the concerns
we hear about or have directly experienced. Other areas of rural Butte County are experiencing similar problems.
The innocent residents of Butte County, including the children, seniors, and families deserve an ordinance that
will help protect them in the enjoyment of their lives as well as property.
I urge you to adapt the proposed ordinance with the following TWO changes:
1) Require that f~0 GROWTH (regardless of size) be allowed within 1000 feet of a church, daycare center,
preschool, or any legitimate, recognized gathering place for children such as a recreation facility. I would suggest
also that the Ordinance specify that the distance should be from the property boundary of said entity. i.e. "not
within 1000 feet of the property boundary of a church, daycare center, preschool or recreation facility." The
stated 100 foot distance from a church as stated in the ordinance is totally unacceptable.
2) Require that ALL GROWERS register. Even the small growers should register so as to provide a more accurate
list of those properties allowed to grow. Allowing small growers to avoid registering or securing a permit may
provide an attractive and tempting loophole far forger growers that results in placing the continuing burden of
enforcement upon neighbors to police by reporting to authorities. Having an accurate list of all growers would
best serve the land use needs of Butte County and at the same time it would hold all growers accountable for
their growing levels. The reality is that in most marijuana growing instances neighbors are afraid to report
suspected illegal activities, This is a rea! fear based upon their personal encounters with growers and often is
echoed by law enforcement officials who well recognize the dangers existing in "grower" neighborhoods.
This ordinance is an important first step and hopefully, it will result in safer, more secure neighborhoods while
allowing the legal growth of marijuana for medical needs. Rural residents need some protection and this
ordinance, with the suggested alterations above, appears to be a reasonable way to help provide that protection.
Doing nothing allows conditions to worsen and exposes an increasing number of innocent Butte County
residents to even greater risk.

l am writing to support the draft on Medical Marijuana cultivation Ordinance. Why
should a few growers ruin the County we live in. We should be able to use our yards
and let our children and grandchildren enjoy what we had at one time. The smell in

Dear Mr. Connelly,
I am a concerned citizen of Butte County and want to pass on my support for the current Ordinance regarding medical
marijuana growth. {Although I would have preferred to have the ordinance that was 1•irst presented that was much more
strict version.) I am requesting that you and your fellow Board members da the right thing and approve the current
Ordinance that will be brought before you on Wednesday.
I live in a portion of Butte County that is literally infested with pot growers and gardens. I would [ove to be able to come
to a meeting of the Board of Supervisors and express my Opinion. However, in doing so, I feel that my safety and the
security of my home and belongings would be jeopardized. These people are ruthless and vengeful I am a woman and
would definitely feel intimidated, to say the least.
Mast of the growers in my area live in campers/trailers. These people pay little property tax (if at all} and rarely vote. I
can assure you I have voted in EVERY election and definitely pay my share of property/sales tax in Butte County.
Most of the homes/campers trailers that the growers reside in do not even have running water and most would be
considered uninhabitable under County Building Codes. They water their grows from the local streams and creeks and
actually pump water from the different lakes, resevoirs and irrigation district in the area. The continuous stream of
trucks/trailers with waters tanks that run up and down the roads is unbelievable.
I contacted your office personally today to express my support of this ordinance and request that you support it, as well.
I was informed by your staff that if I sent an email you would share it with the other Board Supervisors. Please do sa!
As you probably are aware, I will not give you my name or address. I absolutely cannot risk the fact that the information
may fall into the hands of the growers that are against this ordinance.
Again, Mr. Connelly, I am begging you to please do what's right for this County and save our property values!!! Vote YES
an the ordinance governing the cultivation of medical marijuana in unincorporated Butte County.

I am writing out of concern for our county. The issue of the marijuana growing in this county is totally out of
control. I live in Durham and the smell is terrible. I can't even open my home up for fresh air because of it.
Property value has dropped. Besides the element this activity brings in is not a good thing. That's all we, the
citizens, of Butte need is a bunch of "pot heads" out driving. I think the medical issue is a joke. It has been
inconclusive as to whether it truly works. The entire problem is about money. I was appalled to learn that truck
after truck are coming into our area from Texas.
I strongly urge you and the other supervisors to vote far the ordinance. This problem has to be faced and that is
one step in the right direction.

The Proposal from February 22, 2011, is above and beyond sufficient for any person that truly feels they "need" so called
"medical" marijuana to help them with the effects of their iNness.
Have you experienced living next door to someone growing marijuana? 1T STINKS! Literally, it stinks. Not only does it
smell like you've got a family of skunks living next door it creates unbelieveable traffic and parties and they laugh in the
faces of those that "have" to put up with "their" illegal behavior.
People are "NOT" using this drug for medicinal purposes they are using it as a means of making a great deak of money.
Illegal money. The drug is being sold to our children and a good part of the teenagers and young adults know which
houses are the "pot" houses. People that are allowed to grow "medical marijuana" SHOULD have restrictions and
accountability. The fees imposed should be at a level to cover the costs of providing this accountability.
With all due respect, you know just as well as I that it's wrong. It's not us, it's them that have the wrong frame of mind.
I plead with you to stand up and do the right thing. Don't give the pot growers another leg to stand on.

I am a long-time resident of our Durham, and I am writing to express my full support for the
proposed land use ordinance regarding the cultivation of medical marijuana, or the addition of
Article 1 to Chapter 34A.
I think that regardless of your personal feelings regarding the use of marijuana, be it
recreationally or far medicinal purposes, it cannot be argued that the quasi-legalization of
marijuana cultivation in large quantities has led to an increase in crime rates and a decrease in
property values for those properties surrounding a sizeable grow operation. This is due, of
course, to the fact that while the State of California has determined that the cultivation and
medicinal use of marijuana is legal, the Federal government does not share this opinion. As a
result, the value of marijuana has remained unchanged, and regardless of the grower's true
intentions, criminals still see these operations as a target and a potential windfall.
As I'm sure you have been made aware, many of these growers operate as a cooperative and can
have dozens of "recommendations" from physicians making it not at all uncommon for several
dozen or even hundreds of plants to be grown on a relatively small piece of land. I'm not talking
about land located in the more remote portions of our county either, but instead in neighborhoods
with large gardens mere yazds from neighboring houses. This causes people to be fearful for their
own safety and more importantly, the well-being of their children, not to mention the unappealing
odor experienced for two to three months out of the year.
I think that the allowance of six mature plants for a single piece of property is more than generous
and while still nat ideal in my opinion, is a reasonable compromise and hopefully not lucrative
enough to attract the criminal element that dozens of plants representing potentially hundreds of
thousands of dollars surely does.
I will be in attendance at the meeting on May 4 and I know the opposition to this proposed
ordinance will be well represented armed with their repetitive and ill-informed arguments. I also
know that many of the citizens I've spoken with that support the ordinance are afraid to speak
their opinions at the meeting far fear of retribution from those opposed. No so coincidentally
enough, Supervisor Steve Lambert informed the group at the Durham meeting on April 27 that
the day following the last public discussion, the gates on his property had been removed and his
cattle ran loose, so I don't think these concerns are unfounded.
T would encourage you to consider how you would feel if you had one of these operations next
door to you and vote to rein in this type activity, while still remaining compassionate to those

I have owned my 35 acre property in Yankee Hill for almost 20 years, My wife and I
used to come and hike and ride quads on the property. I used to bring my grandchildren
who loved being able to go out and ride in the woods and roads in our development, and
see all the deer and wildlife everywhere.
Now, I can not let my grandchildren or my wife go for a ride anywhere and will not bring
my trailer up, with the six pot grows surrounding my land, and most of the forest cut
down the animals run off, it is no longer a safe or nice place to visit.
For the last two years Mr. Davis has cut down so many trees and graded so many
properties to nothing but dirt and roads, including a road last year and now another this
year across my land.
To keep the road from washing off and eroding this winter, the first estimate to repair the
damage is $5000. Plus permits and EPA and Water erosion study costs.
To replace the corner section marker of myself and two others it will cost around $2000.
I was shown this marker by the surveyor in 1991 when lower gulch road was widened on
my land.
My thought in solving a problem has always look at who will benef t, and usually that's
the guilty party, Since Mr. Davis is the only one who had a reason or would benef t from
removal of the marker, leaves us with only one suspect.

The action by this defendant are intentional and deliberate. The only thing this kind of
person understands, your honor is JAIL TIME, because they are making so much money

My name is Cheryl Turnbough and I am one of your constituents. I was unable to attend the discussion at the Nazarene
Church, but I do want to weigh-in on this matter. Please hold the line as much as you can on marijuana growers, sellers,
medicinal or not. Please only allow the minimum we are being forced to put up with under the law. f have fined in Oroville
for 30 years, and I see the mess that comes from drugs, marijuana being part of that problem. Those people who really
do have a need far medicinal marijuana (small percentage of users) have access to what they need. People say that the
facts are with expansion of marijuana, that it is a harmless drug. Statistics as you know can lie. Most people know
someone who is a marijuana user and can see the "facts" about how it destroys lives, makes people using it leaches on
society, or forces them to sell it to supplement the money that they obtain from the government coffers (aka taxpayers).
Butte County is broke along with every other county in California. We need producers (not of marijuana) not takers, the
piggy bank is EMPTY! We don't need more of a drain on the already stressed social services (police, fire, hospital etc).

I, Patricia Vance, was served a subpoena by the DA's Office the others came and ask to
speak to the judge at trial. there will be a couple more letters from the people that
testif ed in court and there letters describing to the court what they have gone through.

The only word T have to describe Mr. Davis is DESTROY. He has taken a peaceful,
friendly, safe, healthy, beautiful, community and torn it apart.
The reason I have become the loudest voice for our community is most people are afraid
of the element that has came inta our community, as they should be since the few of us
who have spoken out, have been threatened many times. Many of them thank me for
trying to do something. I am afraid, my family is afraid for me.
Our heath problems and our neighbors complain of the same problems. Knowing our
wells, creeks, and lake are being contaminated by the fertilizers and pesticides and
herbicides, people living in tents and trailers with no facilities, to protect there pot from
people coming with guns to steal it. Having the code enforcement come time after time
and smell toilet, from my front door and can not do anything but send letters, telling me
and Deputy Freeman he can not make them move the trailers or tents.
Mr. Davis has been involved in the grading and cutting down of entire mountain sides of
trees, Cutting roads across others property and when confronted the second time he did it,
says well no body did anything about it last year, so I thought it was ok. Even though
people did confront him the first time.
Mr. Davis has stolen water from neighbors well and our creeks, then says its just the cost
of doing business when he gets caught. Ask why he did not get an attorney he said why
should I pay an attorney too.
The Double trailer semi dump truck, that Mr. Davis owns, coming in and out every day
hauling tap soil and fertilizer, towing his big backhoe, tears up our roads. We spent
$50,000 crowning and graveling and $x,200 this spring getting ready for summer. This
was totally destroyed, gravel in ditch, gravel on road pulverized and the dust is horrible,
ask about this happening to our roads„ because of the trucks some times 10 in one day,

One of our families with two small boys, last year, walked away from there home after 14
yrs. When the view from there deck was almost a hundred plants of marijuana, and
people living in tent and trailers, with no toilets. To protect the health of there boys and
themselves when they watched the growers spraying and there eyes would burn and
water and knowing what we had gone throw with our growers next door, with no help
from the county and knowing they could never sell there home with the smells and view,
they gave up everything and started over in a rented apartment.
~ have talked to over 16 of my neighbors who do not want to live here anymore, most of
which hoped they would never have to leave. Everyone used to walk the roads and hike
and ride quads with there grand kids, no one except the pot growers, feel safe to walk the
roads now. 7 and several others don't even feel safe in our own homes.
All of what has been described Mr. Davis has been involved, he has shown to us in over
the past three years he has no regards for anyone's well being or property.
Far these reasons and to help the District Attorney and Sheriff office in there efforts to
help all of us in Butte County .Task the court to send a strong message to Mr. Davis and
the others described by deputy Freeman, during his testimony in court, that this kind of
behavior will not be tolerated, by giving the strongest punishment and fine possible.

My experience with Dear Peak Lake Estates in the past was of my husband, who past away, he
came to this peaceful place he loved and I never was worried about his safety, or the trailers and
things left on the property, even though we lived over three hours away.
Now in the past three years my property has been broken into.
Mr. Davis has trespassed on my land and tack water from my well, the black pipe hooked to my
faucet, went across my property then across Mr. Davis's property to two large water holding
tanks that were being filled with my small 5 gallon a minute well. The well pump would have
been running day and night, I am lucky it did not burn it out and run my well dry with that
amount of aver usage.
I would have had a very large electric bill, except for some reason, my meter wheel was not
turning at all. I reported it to the PGE and they changed my meter and now we have the PGE
box locked and the well turned off.
Last summer Mr. Davis cut down trees and made a single lane raad across the back of my land.
This year Mr. Davis has cut a two lane road and cut down mare trees on my land. I understand
the bids are over $5004.44 to repair the damage.
Also the property survey marker has been removed, this will cost $1944. to replace it.
I am speaking up because it seems that unless we do, we all will not only have our properties
and environment damaged, but the over use of the water supply, will drop the water table so low
none of us will have water for our homes.
I would ask the court to consider these actions of Mr. Davis as an indication of his lack of
respect for others and there property.
