Bryan Haddix Clerk of the Board,Administration Dept. 25 County Center Drive Oroville, CA 95965 RE:New Era Mine, Mining Permit# 81-135 Dear Board of Supervisors, We,the Casa Del Rey Board of Directors,represent the Casa Del Rey Owners' Association, made up 56 homeowners who reside off Pentz Road and overlook the canyon just beyond the New Era Mine. One of the Association's chief responsibilities is protect property values of our owners. We have received an overwhelming amount of correspondence in the last few weeks from our owner, in opposition to the mine's expansion. Here are some of our owner's chief concerns: 1. Scope of mining operation is not in compliance with permit issued in 1982 (questionable validity). -2. Planning Commission found the mine to be in violation of Special Condition 21 or Permit 81-135,yet allowed to proceed with operations. 3. It is our understanding that the property owned by Dennis & Lisa Hughes,which has an easement across our property,may be sold to the New Era Mining Corporation. Potentially,this sale would potentially bring significant commercial traffic within 100 feet of our homes. Current use is only a few vehicles per week. 4. Noise&Negative Environmental Impact on Casa Del Rey, and surrounding communities. Cleanly,the expanded operation of the mine and potential commercial use of this easement would have a significant impact on the quality of life,the environment, and the property values of Casa Del Rey's 56 homeowners, and the owners in surrounding communities. Our Board of Directors and members STRONGLY OPPOSE the expansion of mining operations beyond the scope of the permit granted in 1982. We would respectfully request that the Board of Supervisors take action to oppose expansion in light of the above mentioned concerns. In my opinion, Resolution 08-24 is somewhat flawed but directs the course to the proper due process of this issue. With the applied wisdom of you, the Board of Supervisors, going through the amendment process of the original permit as ordered by Resolution 08-24 will shine the light of today's regulations and laws on the allowable limits under which the New Era Mine should operate in the future. Only then can we the residents of Dry Creek know that the County has risen to its primary responsibility of protecting the rights and well-being of its individual citizens.
