SUBJECT: Response to Information Notice (III) 18-009 Corrective Action Plan (CAP)
Dear Mr. Kittrell:
This letter confirms receipt and approval of your CAP regarding MHSU'DS IN 18-009 and
confirms Butte County will begin providing services by September 1, 2018.
Your county has not been arranging, providing, or subcontracting for the provision of
applicable DM,C services and is therefore out of compliance with the DMC Contract. As
outlined in IN 18-009, if your county fails to implement DMC State Plan services within the
allotted timeframe, the Department will begin contracting with providers or other entities to
provide applicable DMC services to eligible Medi-Cal beneficiaries residing in your county„
and will invoice your county for all service expenditures and administrative costs associated
with the provision of these services. Pursuant to 2011 Realignment and Government Code
Section 30027.10, the Department may, at its discretion, require the diversion of your
county's Behavioral Health Subaccount funds„ and may require your county to surrender its
authority to function as the administrator of DMC serviices, (Contract, Exhibit A, Attachment
I„ Part 1, Section 2, Subsection C. Paragraph 3) Funds would be diverted from your county's
Behavioral Health Subaccount in the amount needed to perform functions and,provide
services at the level necessary to fully obtain federal funds. The funds would be deposited
into the County Intervention Support Services Subaccount for the Department's use.
