IS..jS BOTANICALS Dear Butte County Supervisors, I am most grateful for your recent unanimous support of my plans for an industrial hemp research pilot project here in Butte County. I have since been advised that there is an impediment to moving forward due to the way that Butte County code Chapter 34A and 34B are written. Specifically, there is no language that allows for industrial hemp to be distinguished from, and therefore excluded from, the same rules as those applying to cannabis cultivated for medicinal or adult use. I ask that you consider adding this one line to the language of both 34A and 34C so that I can assure potential partners and research institutions that we are not at risk of being prosecuted under the cannabis rules. "For the purpose of this chapter, "marijuana" or "cannabis" does not mean industrial hemp as that term is defined by Section 81000 of the California Food and Agricultural Code or Section 11018.5 of the California Health and Safety Code." For your reference, here is that definition: HEALTH AND SAFETY CODE - HSC DIVISION 10. UNIFORM CONTROLLED SUBSTANCES ACT [11000 - 116511 (DIVISION 10 REPEALED AND ADDED BY STATS. 1972, CH. 1407. ) CHAPTER 1. General Provisions and Definitions [11000 - 110331 ( Chapter 1 added by Stats. 1972, Ch. 1407. ) 11018.5. (a) "Industrial hemp" means a fiber or oilseed crop, or both, that is limited to types of the plant Cannabis sativa L. having no more than three-tenths of 1 percent tetrahydrocannabinol (THC) contained in the dried flowering tops, whether growing or not; the seeds of the plant; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds or resin produced therefrom.
