Our church has recently been ordered to obtain a quasi -public use permit. The filing fee
alone is around $7,000. We understand that under Ordinance Number 3987,E 2, 7-22-08,
these fees can be waived by the Board of Supervisors.
We qualify for the waiver because we are a non-profit religious organization. We finance
community events like a children's 5 day overnight summer camp, ongoing year-round
music programs for many local senior and adult daycare centers, an offer for water
filtration systems for every school in the Chico Unified School District costing as much
as $100.000. The maintenance, insurance and building of the 80 acre community facility
alone consumes a great deal of our funding. Our facility is unique in providing natural
environments for on-going weddings, funerals, seminars, healings and spiritual reflection.
We have enclosed some pages from Curtin's California Land Use and Planning Law.
Understanding the RLUIPA Act may assist the Board in relieving some of the fees
ordered by the burden of the use permit in the first place. We are somewhat confused by
this permit because if by one of many reasons it becomes denied, then the burden of the
County's bureaucracy would deny us the right of spiritual assembly on these sacred
grounds.
