HomeMy WebLinkAboutLetter re_Public Hearing for Conditional Use Permit_Verizon January 22, 2015 sow of supwa(ft BUTTE COUNTY &DMINISIRSTIGN, Tim S,nellings AN 2 6 2015 JAN 2 6 2015 Director of Development Services 0WAIE,CAUFORNIA OROVILLE,CALIFORMA Butte County Planning Commission Subject: Public Hearing for Conditional Use Permit UP14-0008 Verizon Dear Mr. Snellings: any husband and myself,attended the meeting today of the Butte County Planning Commission , regarding the application of the firm, "ON AIR", located at 8230 Finisterre Court, Fair Oaks, Ca. 95628- 7613.The firms Project Manager,Alan Heine, representing Verizon, in a Conditional Use Permit UP14- 008 request. Please see the attached copy of my letter of January 6, 2015 to you, listing our concerns with the project.The Verizon request was,approved by the Commission after some discussion. The Commission did question the location of the project, due to the sub-standard parcel size 1.5 acre, with an existing home and additional structure already in place,the area is currently zoned RR5. They were informed by the "On-AIR" representative,that after extensive search,that it was,the only suitable site available high enough to provide adequate service to the community. Butte Planning Division Representative made no comment. When we question Mr. Heine, after the meeting, about other possible more appropriate locations in the immediate area, i.e.The Paradise Pines Home Assoc. administration offices,The Upper Ridge Volunteer Fire Station located on Skyway, he said he was not familiar with the locations, possibly due to his not living in the area. The Butte Legal Council Representative informed the new Planning commission members that they could request additional site research be done before making their decision,they opted to approve the Verizon request with,a few small aesthetics requirements, gravel,some landscaping. We feel that not enough research was done by"ON-AIR",a "WIRELESS SITE ACQUISITION & CONSTRUCTION MANAGEMENT"firm to locate and secure a more appropriate location for the 85-foot tall tower in our small community of homes. Any help you may be able to provide in having this Mitigated Negative Declaration approval revisited and further investigated, would be greatly appreciated. Howard and Joyce Simmons, jsflume@sbcgio,bal.net cc Mark Michelena, Senior Planner, Doug Teeter, Butte County Supervisor Ief ( YJ hulltk_lk`(d� A", January 6,2015 Tim Snellings Director of Development Services Butte County Planning Commission Subject:Conditional Use Permit UP14-0008 VERIZON We received notice from the County of the proposed development of an 85- foot tall'monopine'communication tower,with 6 antennae,Equipment shelter,a 168 gallon,30kw diesel generator,6 foot chain link,top with barb wire,security fence in our immediate neighborhood,we are strongly opposed to the project. The proposed site,Assessor's Parcel Number:064650-030,zoning RRS,Rural Residential 5-acre minimum,is in fact only 1.5-acre,with a home and outbuilding already on site.The parcel has access off of a private gravel road,Smokey Way, which serves a total of 6 parcels,all with homes and all under the 5-acre minimum.This area is already in conflict with the newly adapted Butte County general plan,which was recently completed. The Upper Centerville Canal is located approximately 200 feet north of the communication facility. With such a concentration of homes in the area,some as close as 128 feet, three homes within 240 feet,within direct view of the ground equipment we feel this project is ill conceived.The Mitigation Measure#1 states"Landscaping plan shall be submitted",however,there is no plan for water to sustain the planting. Wireless cornmunication systems emit non-ionizing,electromagnetic energy. The perceived health risk of this emission has been identified as a potential public health and safety issue.People living near the proposed communications facility have the potential to be exposed to radio-frequency(RF)emission from the antennas mounted on the monopine. We understand the need for an additional tower site in Magalia to improve wireless communication service for emergency and residential users.We would suggest possible the DeSabla PGE camp facility,or the Cal Fire camp off Steiffer road.They are at a higher elevation but within a close distance of Magalia and would provide a more appropriate location as opposed to a residential back yard.
