Dear Speaker Atkins,
On behalf of the Board of Supervisors of Butte County, I regret to inform you that we are unable to support
AB1335,which would impose a$75 fee on every real estate instrument, paper,or notice that is required or
permitted excluding those recordings subject to documentary transfer tax. An estimated additional$700 million in
recording fees mould be collected each year as a result.
The Butte County Clerk-Recorder estimates that approximately$4„000,000 In additional fees would be levied each
year against real estate instruments filed in this county as a result of AB1335. The County is unable to support the
bill because those caught in the net created by AB1335 would include widows and widowers recording an affidavit
of a spouse's death, contractors recording a mechanic's lien for unpaid services rendered,and families struggling
to refinance a loan or remove a prior lien. AB1335 Imposes a significant financial burden on many of the same
citizens it intends to help and may have unintended consequences can the long-established system for providing
constructive notice of property ownership if people must choose not to record because they can't afford it.
The Butte County Supervisors understand that the State of California lacks sufficient affordable housing. A recent
study confirmed that most households are unable to afford the median-priced homes in their area. While the
need for more affordable housing is compelling,we cannot support the nexus drawn to real estate recording fees.
Those citizens paying for affordable housing through these new fees are very likely to be those least able to afford
it..
