Present: Supervisors Lemke, Madigan, Moseley, Winston and Chairman Richter. Clif Mickelson, Administrative Officer, Dan Blackstock, County Counsel, and Clark A. Nelson, County Clerk, by Margie Catf, Clerk of the Board of Supervisors ', Pledge of allegiance to the Flag of the United States of America 77-1 itF-ORGANIZATION OF THE BOARD e meeting was ca a to order for the purpose of re-organization of the Board. The Vice-Chairman declared nominations in order for Chairman for the ensuing year. Supervisor Madigan nominated Supervisor R~~chter as chairman. The motion was seconded by Supervisor Lemke. The Chairman asked if there were any further nominations; there being na further nominations the nominations were closed. The Clerk was instructed to call the roll. The Clerk was instructed to cast a unanimous ballot for Supervisor Richter as Chairman far the ensuing year. Supervisor Madigan moved and it was seconded by Supervisor Lemke that Supervisor Winston be Vice Chairman for the ensuing year. He states he has a packet of ten letters from Paradise residents requesting additional police protec~ian up on the ridge, As a :result, he talked to the Sheriff about the police protection services for that area. Letter discussed. Letter to be sent to Attorney General. 77-7 13ARTRAM REZONE REFERRED BACK TO PLANNING COMMISSION Letter from County Counse regarding t e $artram rezone discussed. The letter contained a recommendation that this matter should be refQ~red back to Planning Commission and that a negatitra declaration be filed. On motion of Supervisor Madigan, seconded by Supervisor Winston and unanimously carried, the Batram rezone was referred back to Planning Commission with a recommendation thaF there be a negative declaration filed, 77-13 APPROVE INTERIM FUNDING OF ECONOMIC OPPORTUNITY PROGRAM Although the Agency has en note ie ram giona C5A o approval of the 1977 program and budget, actual funds have not as yet arrived. On motion of Supervisor Win~sto~, seconded by Supervisor Lemke and unanimously carried, Auditor was authorized to cover EOC operating expenses until such time as funds arrive from the federal agency. 77-9 APPROVE PAYMENT OF CH~Iv1 HILL BILLING & CONNERLY & ASSOCIATES, INC. BILLING: APPROVE CONTRACT WITH DATA PROCESSING SERVICES & ANNUAL KAMLOOPS AGREEMENTS On motion o Supervisor Madigan, seconded by Supervisor Lemke and unanimously carried, the following action was taken: I. Approved CH~1M billing in the amount of $9,260.5 and authorized the Auditor to make payment of said billing. Page 380. Authorized the payment of Cannerly 8 Associates, Inc. billing in the amount of $4,468.05 pursuant b their contract for County Housing and Community Development Program far the 197b-77 year and designated Administrative Officer to execute claims from Cannerly ~ Associates which comply with the approved contract. '', 3. Approved contract with Data Processing Services and San Benito County ,not to exceed $5,000 per year to cover sec ured tax services and authorized Chairman to sign. 4. Approved annual Kamloops agreements with California Kamloops for steelhead propagation in the amount of $500 and agreement for the propagation and conservation of fish within Butte County in the amount of $1,000 and authorized the Chairman to sign. 77-10 ADOPT ORDINANCE 1781 AMENDING SALARY ORDINANCE: IMPLEMENTATION OF AB 3121 REC~UIREMENTS A sa ary ordinance amendment is in order establishing the two positions in the District Attorney's Office and Five positions in the Probation Office necessary to staff far the implementation of AB 3121 requirements. Supervisor Moseley felt the County should hold up an the filling of these positions. tt was susgested that the positions could be frozen until such time as the Board gave the Personnel Office the okay to fill the positions, Time spent discussing action to be taken. Dan Blackstock, County Counsel, stoted that the major problem is the dealing with the question of jurisdiction. Who can file the complaint? Probation Department no longer has the standing. The complaint must have the stamp of the District gttorney's Office; complaints have to be filed under the heading of the District Attorney's office. it was moved by Supervisor Winston, seconded by Supervisor Madigan and unanimously carried that the second reading of the ordinance amending the salary ordinance be waived. On motion of Supervisor Winston, seconded by Supervisor Lemke and carried, Ordinance 1761 was adapted, Chairman authorized #o sign, and with the proviso that the Personnel OfFice be instructed to freeze the positions until the Board gives the Director authorization to fjill the positions. AYES: Supervisors Lemke, Madigan, Winston and Chairman Richter NOBS: Supervisor Moseley 77-~I1 DISCUSSION: ENVIitONMENTAL REVIEW DIRECTOR RECRUITMENT The final Filing dote for the Environfnental Review D~recbr +position was December 31, 1976. A total of 60 applications have been received for the position, The next step in the recruitment praccdur~ is for the Board to select a screening committee to review the applications and to interview qualified applicants. Supervisor Winston stated that statements have been made about additional layers of government. As far as he is concerned, this is in direct opposition to the directive of the public. Chairman Richter stated that the County Page 381. January 4, 1977 ________________ Januay4~ 1977 ____-_____--_-...~- must provide this function; the County cannot continue to operate with defective E.I.R.'s. That was the reason the County was going b this type agency. Supervisor Winston said he would like to see some of the unsatisfactory E.I.R.s, He would Bite to review them prior to making a decision regarding the stpffing of this position. The Chairman instructed Supervisor Winston to make inquiries with the departments involved and to study the E . I . R.s on file . Action on this selection of a screening committee put over to the meeting of January Il, 1977. 77-12 HEALTH INSURANCE: EXT1rND POLICY TO JUNE 30, 1977 New Yor Li Insurance Company as declared a $58,46 dividend for fiscpl year 1975-76. In additipn, the Company has indicated a 28% rate increase to be effective 2,/1/'77. Bid specifications for partial self insurance have been prepared. Insurance discussed. The previous Board members had decided that this should go out to bid. Bids were to be opened ,January 25th. Supervisor Winston said he shudders to think of this Countyi~~vinvolved in the insurance business. Mr. Cook, manager of Butte County Employees Association, said the Association would like to have this matter put over at this time. Suggested that the Board take a look at other counties that are self insured. Health insurance and rate increase discussed. Mr. Ed Black, representing the Blue Cross Insurance Company, said that one of the factors that concern him is whether his company can bid on this type package. He explained the matter of handling claims. He requested the Board to reconsider the matter of self insurance. Supervisor Lemke remarked on the package sent out by Mr. Rackerby. He felt he would like to buy the additional six months and further study the program. On motion of Supervisor Winston, seconded by Supervisor Madigan and unanimously carried, the second alternative regarding health insurance, as set out in Personnel Director's memo, wos adopted, present health insurance policy extended to June 30, 1977, and in the meantime the Board can set out the it desires in the matter. Mr. Rackerby stated that at the last meeting, the Board discussed the matter of the dividend and the apportioning of it back to the retired employees. Their share amounts to under $2,000. laefunds set out. It was moved by Supervisor Lemke, seconded by Supervisor Madigan and unanimously carried that the dividend check be accepted and idistribution authorized to the retired employees of their share of said dividend. 77-13 APPROVE COMMITTEE"5 REPORT; COUNTERCYCLICALfANTIRECE5510N PUBLIC WORKS FUNDS It ~s estimated the County will receive approximately $1,000,000 of Public Works Title tl funds to be used to maintain basic county services. January 4, 1977 committee recommends the money be used to fund ongoing county departments in order ro build fund balances for possible #ransition the $0 PSE workers in fiscal year 1977. Jim Rackerby, Personnel Director, gave some background material in this matter. Same of these CE TA workers have been with the County for three years. He explained the problem of replacing some of the positions. Problem of lay offs set out. CETA employees are looking for the intention of this Board. Mr. Rackerby said he would be bringing in some of the positions that should be transitior~d, Use of the funds discussed. On motion of Supervisor Lemke, seconded 6y Supervisor Madigan and unanimously carried, Committee's report to utilize Title II Public Works funds adapted, as recommended by Mr. lZackerby, to Fund the out-going programs. 77-t4 D15CUSSION OF CURRENT DROUGHT CONDITIONS AFFECTING AGRICULTURE I N BUTTE COUNTY Jas Bandy, Agricultural Commissioner, present to discuss the current drought conditions affecting agriculture in Butte County. in 1976 the County was below the normal rain fall. Loss to agriculture set out. IVIr. Bandy explained the tong fierm affects of this drought. At the present time, he is trying #o establish an evaluation of the' ~~ I a; s to the crop growers in this County. Mr. Bandy explained the steps the County could take ro help in this matter. The County could be declared a disaster area. Mr. Bandy said he is not recommending that the Board adopt the resolution declaring the County a disaster area at this time. He requested that this be put over one week so that he can evaluate the situation and have all the Facts prior to adopting a resolution. He felt the new Board members should be aware of the legal problems imposed by the State, They should realize the legal responsibility to the County taxpayers. He said he would be happy to Delp the Board as much as possible. 77-16 APPEARANCE; ELWOOD IZONEY. CHICO Mr. Elwood Roney, Cl'iico; stated he was present because of the present drought conditions. He felt it was of the utmost importance for the County #o adopt a resolution setting cut the problem of the drought. He urged the Board to declare this County a disaster area and ask the Federal Government far assistance. He was told this would be handled next week. Page 383. He feels that there are too many controls. 77-I$ APPEARANCE: AL APPLE MAN Mr. App eman stated he belongs to the District Mining Council. He thinks that the miners have about had it. They will not obey laws that are not laws, In the mining field, there are a lot of veterans from the Korean War. They want to be left atone to live thou life as they want to live it. Before any more restrictions are permitted, it should be rel~lized that mining is an industry. 77-19 APPEARANCE: ROBERT SPEER, CHICO-ZmN1NG IN BUTTE CI~EK CANYON Robert Speer, resident of Chico and a landowner of Butte Creek Canyon, said the proposal for rezoning that has been developed is now in the ', hands of the Planning Department. Approved final map of Kelley Ridge Estates Unit 5 (43 lots) for recording, accepted offers of dedication and authorized the Chairman to sign agreements. 7721 DIRECTED PUBLIC WORKS TO BRING ORDINANCE RE BOUNDARY LINE MODIFICATION C ay Castleberry, Director of Public Works, reported on the matter of boundary line modifications; recommended that approval for directing processing to County Surveyor eliminating one or two steps in processing. Handling of the modifications discussed. ; . On motion of 5upervlsor Winston, seconded by Supervisor Madigan and unanimously carried, Public Works was directed ro bring back an ordinance setting out the boundary line modification procedures and that they should prepare the proper documentation. T7-23 PLANNING DEPARTMIENT DESIGNATED TO BE RE5PON5iBLE FOR i:.f.RsAND ENFORCEMENT OF GUIDELINES Mfr. $ ac stoc reports t at a meeting had been held last night regarding the environmental guidelines with the committee that had been appointed by fibs Board. The guidelines will be delivered to the Board members. A number'of modifications have been made to the guidelines. The guidelines will be senti to the comma#tee to make the corrections. It can be seen that a tremendous amount of work wi I I have to be done as these matters go through the procedures. • It was suggested that the Planning Department be named as the envtronrnentai guideline coordinator. Planning Department could be the coordinator up to the time the change is made. Mr. Slackstock explained the procedure for handling this ma#fer. Appointment of Board member to replace Supervisor McKillop put over to Tuesday, January II, 1977. 77-29 DISCUSSION; EMERGENCY MEDICAL CART: COUNCIL Supervisor igan state ~ e a 3scusse this with Supervisor Lemke yesterday. It was felt by Supervisor Madigan that the best thing to do was •to present the Board members with copies of some of the proposals. Tl~; proposal presented by the Executive Director would cost the County $74,4p0, Supervisor Madigan felt this organization is tap heavy with exe~ative positions. If any of the Board members one free to go b the Council meeting in tbedding, there will be a meeting next Saturday. Costs far Emergency Medical Care Council discussed. Mr. Nickelson said one of the ma#or problems is the justifying of the expense for the' communication system. Butte County has an excellent communication system. Mr. Nickelson questioned whether we should continue to stay in the program. Supervisor Madigan explained how the program could be handled. Supervisor Madigan said he would attend the meeting in'l~dding on Saturday. He wit) have copies of the proposed budget for Board members. 77- Page 38c5. January 4, 1977 Januar~+ 4 1977 _'_ _ _ _ _ _ 77-30 DISCUSSION OF SELECTION OF COMMITTEE TO ASSIST CAO IN WRITING LETTER TO GOVERNOR BROWN IN RI; SB 90 D15C~LAIMERS ~ AB 3121 COSTS Clif Mickelsan, Administrative Officer, has compiled a lisp of increased costs regarding SB 90~disclairr~srs and AB 3121 costs. A letter will be sent to the Governor with a copy of the list of costs. Judge Houghton would like to sentence this woman to the Alameda County jail so the woman could continue to work at her place of employment. The prisoner would cover the cost of this incarceration through the work furlough program.
