Scott, Wescott Christian Center, Oroville~ Pledge of allegiance to the flag of the United States of America 71-121 APPROVAL OF MINUTES On motion of Supervisor McKillop, seconded by Supervisor Madigan and unanimously carried, the minutes of January 19, 1971 were approved as submitted. 7I-122 COMMUNICATIONS Mrs, Charles Griffith, Ventura. Mrse Griffith writes regarding subdivision activities in Butte County and forwards newspaper clippings which she considers of interest. Discussed; no action taken, Councilman D, W, Spurgeon, Gridley, Mr, Spurgeon writes regarding the acquisition of proposed site for the transfer station in Gridleyo Discussed; no action takena Petition for interim zoning. A petition is filed with 39 signatures of Paradise residents requesting interim zoning pending formal application for rezoning on lots 12 through 23 on Assessor's Map 53-03. Referred to P1_anning Commission, Mrs4 Jean C. Covell, Paradise. Mrs, Covell requests that an ordinance be adopted extending the interim zoning of the area between Pearson Road,. Nunnelly Road, Sawmill Road, and the existing A-R zone to-the east to be presented for adoption on January 26, See action taken later in the meeting County Superintendent of Schools, Mr, Evans writes to invite members of the Boax•d of Supervisors to attend the 24th annual conference of the California Association of County Superintendents of Schools and the California County Boards of Education in Asilomar on March 14 through 17, 1971. Discussed; no action taken Meade Engineers. The engineering firm from Marysville requests consideration for use of their professional engineering services in general consultation, planning, design, inspection and contract administration for public works type projects. Referred to Director of Public Works. City of Oroville. Mr. Gonce, city administrator, writes regarding a study of the use of the Oroville Municipal Airport in which it was determined that some 70% of the persons hangaring or tying down aircraft at the Airport are county residentse The City Council requests consideration the same as that given to Chico Airport as to paxticipation in the upgrading of the Oroville Municipal Airport in the sum of $12,600 and requests that consideration of this amount be given by the Board in the Cour_ty's 1971- 72 budget. Discussed, Mr, Mickelson stated the City wanted assistance for runway worko It was stated that this request would be discussed again at a later dated Page 130. The Association writes regarding the Board of Supervisors'intent to appoint a board of trustees for supervising of the Butte County Hospital and requests consideration of the appointment of Miss Agnes Dix of Chico to the Board as a representative of the nursing profession. Referred to Supervisors Madigan and McKillop. Butte County Mosquito Abatement District. Mr. Hazeltine, manager, comments on the Board's xecent consideration for the need and desire for implementation of a dam on the Feather River to maintain higher water levels in and near Oroville. He points out certain possible difficulties regarding higher water levels in certain areas and the consequence of increasing of the mosquito problem. Discussed; no action taken at this time, County of Sonoma. The County forwards copy of its Resolution ~~31788 urging action to alleviate the problem of litter and waste disposal created by the sale of beverages in disposable, non-returnable containers, Discussed; suggested that this be discussed at a City-County meeting. Butte County Fair Board. The Board forwards copy of the minutes of its meeting of January 18, 1971. Discussed; Chairman Reynolds requested that the Administrative Officer check with Fair Board about flooring contract. Southern Pacific Transportation Company. Copies of their invoices to the State Public Utilities Commission for the share of the cost of maintaining automatic grade crossing protection during the calendar year 1970 in the amount of $1,230. This is for information only Public Utilities Commission. The Commission sends notice of prehearing conference regarding an application by Western Union Telegraph for certain rate increases, Information only. State Controller. The Controller's office forwards notification of apportionment of federal grazing fees for the fiscal year ended June 30, 1970. Information only, State Human Relations Agency. The Agency forwards copy of letter to Dr. Heindl acknowledging receipt of the County Drug Abuse Control Plan. Information only, Department of Conservation, Mr. Stearns, director, gives notice to the County that the administrative overhead rate for the Schedule A portion of our annual cooperative contract for fire protection services will be increased for the 1971-72 fiscai year to 10.5%. Referred to Administrative Officero It was stated that this matter would increase the tax rated Mr, Nickelson explained the situation. he stated that the flag was not being flowno Mr, Castleberry will check on this and report back to the Boarde Supervisor Madigan suggeste3 that the Auditor check on the receipts that are being filed for fees collected at this marinao 71-124 NOTICE OF COMPLETION: WELFARE REMODELING: PHASE 4 On motion of Supervisor Maxon, seconded by Supervisor Gilman and unanimously carried, the work of Modern Building Coo for the Phase IV remodeling of the Butte County Welfare Building was accepted, the Chairman was authorized to sign the Notice of Completion and authorization was granted for the final payment to the contractor less 10% pending expiration of lier_ period and completion of punch List items, 71-125 REPORT TO BOARD ON CORRESPONDENCE FROM DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT Clay Castleberry, Director of Public Works, reported on AB 2300, which amends the State Housing Law, stating that it will require local governments to adopt the latest editions of the Uniform Codes applicable to apartment houses, hatels and dwellings and their accessory structures by November 23, 1971, or they will be in effect anywaya Jim Glanders set forth the changes in the Law, He stated that there was a push to get uniformity in the building codeso Under this law, mobile homes will have to be inspected if they are outside the mobile home parks, Time spent discussing the changes; no action taken at this timed 71-126 AUTHORIZE BUDGET TRANSFEIi~S k'OR ROAD PROJECTS Public Works recommends the transfer of project funds from East Avenue (Ceres to Mariposa) in the amount of $25,000, and Palmetto Avenue ($30,000) to East Avenue (Pillsbury to Freeway)o These projects will be rescheduled when drainage is provided in accordance with Board policy, B, From road reserve to road and bridge maintenance --$100,000, This is necessitated by the addition of approximately $50,000 in employee benefits after the budget was made up last year, high maintenance costs in the Butte-Meadows_Jonesville area and the rise in costs of aggregate materials and an approximate 20% increase in asphalt costs; BCAG must be made from local funds and then Maim for reimbursement be made subsequently to the Council on Intergovernmental Relations There is a claim from the engineering firm for work completed in the amount of $12,260,88-wish no funds on hand in the Butte County Association of Governments to provide interim financing for payment of this claim, Time spent discussing financing of the claims for BCAGo Mro Nickelson explained the situationo Chairman Reynolds stated that this-would be an interim type funding to complete the Page 136, January 26, 1971 ___________________"anuary25,=1971 _,-__________---__ water and sewer study, Mr. Seely stated that this method of financing is er_tirely unsatisfactory. He said that as it stands now, the County is suppase ~tc exgend this money and then wait to receive the funds from the Federal Governmer,.to The County would advance the money and then file a claim with the Federal Goversanent for reimbursement of the funds that have been. expended, Supervisor McKillop stated that the Federal Government never ga.ves Y.he money until the work has been done. County Counsel explained how the Federal Government handled these grants. He passed out pamphlets concerning controlled burning. 6o Gordan Casamajor, Chico. He stated that leaves were not allowed to be burned within the city limits of Chico. He felt it would be quite complex if the residents of the county adjacent tc the city limits were allowed to burn their leaves, He requested that Section 2-10 be restricted to not allow burning in the areas around "the city limits. He felt there should be a definite boundary; the section should exclude the area in the perimeter of the Chico city limits, Supervisor McKillop suggested that the City of Chico prepare the boundary and plat to show the area that would restrict the burning of leaves. Mr, Casamajor said the City of Chico would be willing to cooperate and do what they could to help in this matter. Mr. Casamajor asked if the railroad companies would be allowed to lztrn along their tracks. Mr, Blackstock said there was concern about how a public entity could get rid of the debx•ison their property. Mr. Blackstock said he has avoided setting up a permit section in. the regu7.ations, He said the State would send down regulations concerning permits. Page 1390 January 26, 1971 ___ ____ __ ________January2611971_-===_____________ 71-162 REPORT ON HOSPITAL MATTERS BX S~7PERVISORS MC KILLOP AND MADIGAN Supervisor McKillop and Supervisor Madigan met with the President of the Butte-B1enn Medical Association and the administrators of the various hospitals in the Gountya They all agreed with the report of Dr, Green and felt a completely separate Board should be appointed to manage the hospital, It was agreed that each Board of Supervisors member would appoint a member to the Board of Trustees, the Trustees would appoint 3 doctors to be on the Board and the 9th member would be the president of the Butte°Glenn Medical Societyo The Board of Trustees would have the right. to appoint the hospital administrator, It has been suggested that Dra Bailey be appointed acting administrator until the Board and the new administrator are appointed, Time spent discussing the appointment of the Board members, Chairman Reynolds felt the selection of the board should be screened in an executive sessions Supervisor McKillop had several documents that had been given to him and he presented them to County Counsel to reproduce and present to each of the Board memberse Supervisor McKillop stated that the Board members should come up with suggested names for consideration within the next few weekso The terms of the Trustees should be staggered, On motion of Supervisor McKillop, seconded by Supervisor Maxon and unanimously carried, Dr, Bailey was appointed interim administrator of the Gounty Hospital until the permanent administrator is appointed, at an additional salary of $750 per monthe to be effective February 5th, 19710 Supervisor McKillop stated there are still mammoth collection problems at the hospital, He would like to have a verbal report on this problem at the Board meeting of February 2, 1971, 71-163 BOARD DISCUSSIONS Chairman Reynolds stated he had been informed that at the .joint Water District Board meeting held in Gridley today, they requested that they be given 30 days advance notice of hearings to be held by the Butte County Association of Governments, concerning water matters, Chairman Reynolds stated that he had not attended the City°Gounty meeting held last weeko He said he hoped that this Board would ihake every effort to speed up the development of the master plan for the sewer system for the Oroville area, He said this Board should go on record as supporting the development of the sewer system plan or it will be a catsstrophy to the County.
