Patrick Murphy, Saint Thomas Catholic Church, Oxoville Pledge of allegiance to the Flag of the United States of America 73-136 APPROVAL OF MINUTES On motion of Supervisor Gilman, seconded by Supervisor Ladd and unanimously carried, the minutes of January 23, 1973 were approved as mailed. 73-137 COMMUNICATIONS Bertha /i, Smith, Paradise, Mrs. Smith writes in opposition to licensing or o ~,`Z 5 regulation of homeowners sales such as patio, yard and garage sales, Discuss:~d; no action taken. Harry Squ.th, Paradise. Mr. Smith writes in opposition to licensing or 4`~ ~ regulation of home type sales. Discussed, Supervisor-C~mexon said d he was satisfied with present ordinance. No action taken, Fred Hillss Oroville. Mr. Hills writes on behalf of John V. Gaxgan requesting consideration of a late application for land to come in under the Williamson Act. Discussed. County Counsel will answer the letter and request more information. Mr, Blackstock will repoxt back to the Board. League of Women Voters of Butte County. The League requests consideration by the d 0 G ~ Board for appointment of a lay committee to study chargex with view l towards making several changes and list of such changes are enclosed. Discussed; matter deferred to next week to make a decision in this matter, Paradise Ghamber of Gommerce. Dale Reed, Chairman of the Paxadise Merchants Association, asks that the Board appoint the Paradise Merchants D ~ Association, which is the commercial arm of the Paradise Chambex, to ~~~ act as an advisory committee on increasing the services within County ^i Service Area No. 13. This is a lighting district currently serving the business area of Paxadise. Application for a dance license. Butte County Rodeo, Discussed; action deferred until next week in order that the Sheriff's approval may be obtained. William Penn Mott, Jr,, Director, Department of Parks and Recreation. Sixty day notice that the State desires to resume control of Lime Saddle recreation area, Letter read and discussed. Clay Castleberry, Director of Public Works, -~ stated that he has asked County Counsel to prepare a resolution concurring 1~~4 with the State taking over this recreation area, Mr. Castleberry explained the action that should be taken. Supervisor Gilman questioned Mr. Castleberry about the small fishing access turn-grounds, Discussed the matter of State taking over the operation of the recreation area, See motion following communications. 73-138 PARADISE MERCHANTS ASSOCIATION TO ACT AS ADVISORY COMMITTEE ON INCREASING SERVICES WITHIN COUNTY SERVICE AREA N0. 13 Letter from the Paradise Chamber of Commerce suggesting that the Paradise Merchants Association act as an advisory committee on increasing the services within County Service Area No, 13 read and discussed, It was moved by Supervisor Cameron, seconded by Supervisor Gilman and unanimously carxied that the Paradise Merchants Association be appointed to County Service Area Noe l3 lighting committee to work with Public Works Department in the fuxther development of lighting in the Paradise area, and that the Board be advised of the names of the people to serve on said committee, 73-139 CONCUR WITH DEPARTMENT OF PARKS & RECREATION OF THEIR ASSUMING CONTROL OF THE LIME SADDLE RECREATION AREA On motion of Supervisor Gilman, seconded by Supervisor Madigan and unanimously carried, the Board concurred with the Department of Parks and Recreation in their assuming control of Lime Saddle Recreation-area, and that Public Works Department continue with the planning of the turn-grounds and with the State ultimately taking over the maintenance of the turnaroundse 73-1~r0 PLANNING DIRECTOR DESIGNATED AS SECRETARX OF THE PUBLIC LANDS & PUBLIC PROTECTION COMMITTEE OF THE NINE NORTIiERN COUNTIES SUPERVISORS ASSOCIATION Supervisor Gilman read a letter from the secretary of the Nine Northern Counties Supervisors Association requesting that he name a secretary of the Public Lands and Public Protection Committee, of which he has been asked to be Chairman, He suggested that Jim L~agen16P1anning Director, be named as January 30, 1973 _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _January=3Q,=173 = _ - _ _ _ _ _ _ - - - _ _ - _ secretary; he feels there should be a laison between Planning and the Supervisors Association. Appointment discussed. On motion of Supervisor Gilman, seconded by Supervisor Madigan and unanimously carried, Jim Lawson, Planning Director, was designated secretary to the Public Lands and Publio Protection Committee of the Nine Northern Counties Supervisors Association. 73-141 DISCUSSION: ALLOWING MOBILE HOME OR TRAILER TO BE PLACED ON PRIVATE PROPERTY TO HOUSE ELDERLY RELATIVE Supervisor Gilman said he would like the Board to give consideration to the providing of some mechanism in the County whereas people who desire to assume the responsibility for an elderly relative could place a mobile home or trailer upon there property. He feels that the time has arrived when the Board should take some positive action in this matter, He feels that it gives the older people some dignity to live alone and it relieves the County of the responsibility of having them institutionalized. The mechanism could set out where these homes could be placed. Request discussed. A use permit could be issued annual for the placing of these homes. Tt was moved by Supervisor Gilman, seconded by Supervisor Madigan and unanimously carried, that the problem of placing trailers or mobile homes for elderly people on the property of the relative that desires to assume responsibility for such person be referred to the Planning Commission, on a priority basis, with the request that they give some direction of how they felt would be the most appropriate way to handle these requests, and that they report back to the Board in two weeks with their suggestions. 73-142 AUTHORIZE PURCHASE OF TORSION BALANCE_SCAI,ES: HEALTH DEPARTMENT On motion of Supervisor Ladd, seconded by Supervisor Gilman and unanimously carried, authorization was granted for the purchase of a Torsion balance scales and weights at a price of $50.00 for use in the milk inspection laboratory, purchase to be from Mr. Ray Orrick. 73-143 GRANT RELIEF OF ACCOUNTABILITY ON UNSECURED ACCOUNTS ON AIRPORT PROPERTY 0 ` On motion of Sugervisor Gilman, seconded by Supervisor Ladd and ~~?'' unanimously carried, the Treasurer-Tax Cellector was granted relief of accountability for unsecured tax bills on airport property totalling $12,601,24. 73-144 AUTHORIZE CALL FOR BIDS FOR HOSPITAL E UIPMENT On motion of Supervisor Ladd, seconded by Supervisor Gilman and unanimously carried, call for bids on aflame photometer and a spectrophotometer, for tb hospital, at an estimated cost of $3,500 and $2,500 respectively, was authorized, with bid opening set fox February 23, 1973 in the Purchasing Office and with a report to the Board on March 6. 73-144 REPORT ON TYPEWRITER PURCHASES Guy Hart,-Oroville, was present to discuss the report on typewriter purchases. Chairman McKillop said that Mra Hart has received a copy of the memo from Purchasing Department concerning these purchases, He explained his objections to the memo. He made reference to the State of California products list. He said mainteaance of the typewriters should be supplied by the dealer. He objected to the purchase of the IBM typewriters by two departments, Mr. Hart said that this year the County is going to be asked to bid typewriters out and are going to be asked to use the State bidders list. His typewriters are not on the list. He requests that his machine be placed on the list to be considered. Report discussed; no action taken, Page 17, January 30, 1973 3anuary_30,_1973 - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - 73-145 TRAVEL REQUEST DISCUSSED: ACTION TAKEN Bob O'Brien, veterans service officer, requests authorization for himself and Lura O'Bryan to attend the mid winter training conference of the California Association of County Veteran Service Officers, This will be held in Tiburon, California February 14 through 16, 19730 Number of nights lodging two, Estimated cost of trip $170, Travel by private car, Mro O'Brien feels that there is necessity for two persons to attend this conference and has submitted a memo of justification, Request discussed, Clif Nickelson, Administrative Officer, explained the request; he does not feel that it is necessary for both of these people to attend the conference. On motion of Supervisor Gilman, seconded by Supervisor Ladd and unanimously carried, the request of Bob O'Brien, veterans service officer, for himself and Lura O'Bryan to attend the mid winter training conference was denied and authorization was granted for one person to attend said conference as set out above.,. 73-146 BUDGET TRANSFERS APPROVED On motion of Supervisor Madigan, seconded by Supervisor Ladd and unanimously carried, the following budget transfers were approved: B-66 Oroville Constable - $94 from transportation and travel to insurance general B-67 Chico Marshal - $184 from transportation and travel to insurance general B-68 District Attorney - $500 from transportation and travel and $500 from office expense with $1,000 going to jury and witness expense. RECESS: 10:15 RECONVENED: 10:30 73-147 REPORT ON REVENUE SHARING William Lawrence, Assistant Auditor, spoke to the Board on revenue sharing. Shasta County has registered a protest; Mr, Lawrence said his office has checked out the figures and he does not know the basis of Shasta County's protest. Funds discussed. County Counsel recommended that a letter be sent to the developer advising them of the probability that they might not be able to develop the lots, Tentative map discussed, Chairman McKillop felt that the map should be approved with the conditions recommended by the Planning Commission and that Mr, Lawson write a letter to the developer that there is a strong possibility that these lots would ~tqt be able to meet the criteria Page 19. Supervisors Cameron and Madigan 73-151 HEARING SET WITH PLANNING COMMISSION Supervisor Gilman said it would be well if the $aard would take a position and give the Health Department direction in these parcel map problemso He felt the Board should reaffirm their intention in these matters, Chairman McKillop said the Planning Commission would like to have a meeting with the Board of Supervisors to receive direction from the Boardo He said he would like the Board to set a date for such a meetings Dates for meeting discussede February 7th, .1973 at 8:00 a.m, in the Board room was set as time for said meetingo 73-152 TENTATIVE PARCEL MAP DENIED: AS RECOMMENDED BY PLANNING COMMLSSION On motion of Supervisor Ladd, seconded by Supervisor Gilman and unanimously carried, the following tentative parcel map was denied as recommended by the Planning Commission: 1. J. M. Hill, AP 43-OZ-19, 2 lots, on Linde Avenue, across from 12th Avenue, Chico. Engineer: D, R. Roper 73-153 GRANT REQUEST FOR RELIEF OE RESPONSIBILITY FOR SUPPORT_0_F_PARENT Eugene Stowie, Chico, appeared to discuss his request for relief of responsibility for support of parent. Dan Blackstock, County Counsel, gave the background on this item. The Welfare Department had made a recommendation of non-approval of this matter. Mr, Stowie stated he had been abandoned by his parents and has not been supported by them since this abandonment, A memo from the Probation Officer states that tr7re~e was an order for support by the. parents when this man was placed in a foster home; there is no record that shows the parents supported the child. Mr, Stowie is not speaking of support of this parent, merely a three month period far which he is being requested to contribute towards, Request discussede On motion of Supervisor Gilman, seconded by Supervisor Madigan and unanimously carried, the request of Eugene Stowie for relief of responsibility for support of parent was granted, 73-154 DISCUSSION: RE~E5IGN OF COUNTY OFFICE SPACE Gene McFarren, architect, was present to discuss a proposal for redesign of offices in the Courthouse. He set up a plan of the County Law Libraryo He said Personnel office would move over to the old Judge's Chambers, He explained the plans for County Counsel's offices, Plans discussed. Supervisor Gilman asked what the proposed costs would be to remodel the new County Counsel's offices, Mro McFarren said he did not have the costs at this time, He said he would develop the cost analysis for the Board and present it to the Board next week. Matter placed back on the agenda for Tuesday, February 6, 1973. Personnel office requested permission to move into their new offices, Page 20. He said they were trying to settle the problem of space, He said it was being considered to move the analysts and clerk over to the personnel office, Problem discussed. It was felt that Personnel Office should be given direction to move into the old Judge's Chambers at this time; direction so given. No derision Made at this time of the use of the Personnel Office. - , 73-155 BIDS FOR TYPEWRITERS TO BE ACCEPTED FROM ALL TYPE HEAVY DUTY MACHINES Supervisor Cameron said that in the matter of the bids for typewriters, he felt that the bids should allow all heavy duty models of typewriters, Typewriter specifications discussed, It was moved by Supervisor Cameron, seconded by Supervisor Ladd a0d unanimously carried, that in going to bid for typewriters that the specifications include all heavy duty machinese and that bids would be accepted fxom all dealers, 73-156 APPEARANCE OF MRS'. LYNN DEMPSEI', DURHAM PLANNING COMMITTEE Mrs. Lynn Dempsey, co-chairman of the Durham Planning Committee, . said she would Iike to ask some questions concerning the hearing set for February 20th. She was told that the public hearing would be to decide whether the interim zoning would continue. All the Board needs to know at that time is whether the people are working on the permanent zoning. Interim zoning discussed, No action taken at this time, 73-157 APPEARANCE OF MR BOS MARTIN:BUILDER OF HOMES IN CHAPMAN TOWN Mr, Bob Martin, builder of single family residents on single lots, stated he was building some homes in Chapman Town, He has been informed by Mr, Castleberry that he would have to put in curbs, gutters and sidewalks. Mx, Castleberry explained this requirement. Mr, Castleberry feels that there is a drainage problem in this area, County Counsel stated that it should be clear in the xecoxd that this area has a very bad drainage problem. Because of this problem, the roads axe in dan•ger., The road in that axes is flooded now and any further development would increase the flooding, Mr. Martin does not feel that it would solve the drainage problem to install the curbs and gutters, Time spent discussing this mattero The Board had made a decision at the Board meeting of January 23, 1973 to concur with Public Work's decision and recommendation. The Board confirmed the action they had taken at last week's meeting regarding this man's request. 73-158 APPEARANCE OF MR. AARON URSEY: BUILDING OF CURB, GUTTERS & SIDEWALKS Mr. Aaron Ursey, Chico, set out his problem concerning building requirement of curbs' gutters and sidewalks in the Chico area, He said he has agreed to take care of the drainage by placing dry wells on the property, He said he would have financial trouble if he put in the curbs, gutters and sidewalks. He said there is standing water on the Esplanade side of the service street. Chairman McRillop said that since these are mutual problems, could the County approach the City of Chico and discuss this problem of drainage with them. Mr. Castleberry said this could be done. He said that the City of Chico is going to approach the Board with a uniform policy and suggest that the County consider the policyo Mr, Castleberry said the City of Chico was willing to meet to help solve these problemso Problem of Mro Ursey discussed. Supervisor Gilman said this was a problem area. He receives many phone calls about flooding on these streets. He feels that the curbs, gutters and sidewalks are needed in that area, Supervisor Ladd explained his feel~age r~~arding this area. January 30, 1973 _ _ _ _ - - -- - _ _ _ _ _ _ =January=30,=1973 _ _ _ _ _ _ _ ___ _ _ _ _ _ _ Mr. Lawson said the Board was talking about land use. The Commission consi ders the need for curbs, gutters and sidewalks where there is development that will increase the traffic. County Counsel suggested that maybe the Board should consider passing an ordinance requiring. curbs and gutters in specific areas and that maybe the drainage problem areas should be designated. These problems could then be handled in an administerial manner, Present situation discussed. Mr. Ursey stated that he would put in the curbs and gutters but that he did not want to put in the sidewalks. Supervisor Gilman said he felt that he had given consideration to this and he has not changed his mind. Supervisor Madigan concurred with Supervisor Gilman, County Counsel stated that no action was needed unless the Board changed the action that they have already taken. Mr, Ursey did not comply with the appeal time period; County Counsel felt that the appeal procedure should be followed, Chairman McKillop requested that Mr. Lawson place this matter on the agenda for discuss with the Planning Commission on February 7th, 73-159 APPEARANCE:_MR JAMES HANSEN~,.OROVILLE Mr. James Hansen, Oroville, said he was here today concerning a bill that is before the House; it is a revision of Title 18. The bill is 524 pages long. He read portions of the bill and set out his objections to the bill. He said this would be for the establishment of a national police force. He requested that the Board cheek up on this bill. No action takeno 73-160 APPEARANCE MR CLAUDE WILLIS FOREST RANCH AREA Mr. Claude Willis, Forest Ranch area, said he was present this morning to discuss a situation that is developing in the Forest Ranch area, A Mr, Tony Santos has been buying property in that area and is planting grapes on the property that has been purchased, He is denuding the land. Mr, Willis explained the problem that is being created by Mr. Santos. Mr. Willis said he did not feel that the area had the type soil that is good for grapes, Board members discussed the problem presented by Mro Willis, They did noL feel that they could do anything about this matter, Mr. Dawson said the Conservation Committee was looking into this matter. No action taken at this time concerning this problem, Mr. Willis said he has other problems that he would like to discuss with the Board. It was suggested that he have his items placed on the agenda for discussion. 73-161 APPEARANCE OF Ml~ DANTET~ SLACK OROVILLE: TERMINATION OF EMPLOYMENT AT HOSPITAL Mr. Dan Slack, Elgin Street, Oroville, reported that he had been fired from his job in the kitchen at the hospital. He told Mr. Slack that this should be taken up with the Hospital trustees, or that he could discuss the matter with Personnel. It was suggested that the departments get togethex and prepare a proposal for discussion at the meeting to be held on February 7th, Mr, Castleberry will relate this information to Mr, Lawson. Supervisor Gilman stated that the assessment practices committee has selected Mr. Burton Quigle to serve as the member of the public at large on this committee. The Board said that they approved said selectiono Mro Nickelson will notify Mr. Burton Quigle of this appointmento Supervisor Gilman said the Board would like the Chairman of the Board to contact Mr. William Bennett, State Board of Equalization representative, and request that he meet with the Assessment Practices Committee at his earliest convenience.
