The first action the Board should take is to instinct Personnel Department to recruit to fill the position. Administrative Officer should be instructed to meet with the executive committee to fill the interim position. The Committee is prepared to meet Thursday morning at 10;00 a.m. These are standarcl procedures to be followed. Supervisor Madigan and Ladd will meet as members of the screening committee for the filling of the permanent position of Director of EOC. Pat Barry made a statement at this time. He stated that they have worked hard to prove their worth; there have been considerable changes in the program. Tlaey~:~e initiated new programs. Mr. Barry said he hoped that he would not be creating an atmosphere of fear and uncertainty with the submitting of his resignation; he feels we now hove a good community' _action agency. Chairman Cameron thanked Mr. Barry for his services to the community; stating he felt he had done a magnificient job as Director of this program. 1t was moved by Supervisor Richter, seconded by Supervisor Madigan and unanimously carried that ftiyrsonnel Department immediately commence procedures to fill the position of Director of EOC. and instructed the Administrative Officer to meet with the Executive Committee to select an interim director. Supervisor Richter stated that Mr. Barry's talents will be missed. It was moved by Supervisor Madigan, seconded by Supervisor Richter and unanimously carried, a letter was authorized to 6e written and placed into Mr. Barry's personnel portfolio, setting out the sentiments of the Board members relating ro his duties and performance as director of EOC. 76-158 INFORMATIONAL ITEMS PRESENTED TO B04RD Supervisor igan os e y t e transaction of Dr. Homing and Johnson had not been discussed. Fbming and Johnson property problem discussed. Dan Blackstock, County Counsel, will check on this matter and will report back to the Board. Mr. Blackstock stated he had been served with summons and complaint in the matters of Campbell vs. Count~of $utte~lue to loss of horse and b25,000 bodily damages; also served with summons and complaint an Owens vs, Oroville and County of Butte. Summons and complaint served re Knutson vs County of Butte; the Court has granted them relief to fife a complaint. Page 85. febrvary 3, 1976 The County has also been served summons and wmplaint in the matter of Yocum vs County of Butte. 76-159 DISCUSSION: STATEMENT GIVEN TO SUPERVISORS RICHTER & MADIGAN BY JACK LANCASTER DEPUTY SHERIFF pervisor ~c ter state that about o week and a half ago he had received a dc~ument from Jack Lancaster, deputy Sheriff of Butte County. This document was also given to Judge Morony, who referred it fo the District Attorney. It is now evident that the Sheriff and Bill Talbifzer have . , a copy of this document; Supervisor Richter expressed his concern about this matter. He is concerned as to how the Sheriff had received a copy of this document. It is a very confidential document. Supervisor Richter said he would like to have an explanation of this matter. Discussed; no action taken. 76-160 PUBLIC HEARING: SECOND 8~ FINAL Hi;ARING ON 'PREAPPLICATION FOR A GRANT UNDER TITLE I OF THE HOUSING & COMMUNITY DEVELOPMENT ACT OF 1974 e sewn an Ina caring on preapp ication r a grant u er Title I of the Mousing and Community Development Act of 1974 held at this time. All indications are that HUD will approve the redirection of the X76,000 grant. Scot Tandy stated that on the Board members desk were copies of the letter written to Mr. Lavender fo re-direct last years grant application to use tha funds to the soufh of Oroville area. Hearing opened to the public. Appearing: I. Bob Winston, Mayor of Oroville. He stated that about a year and a haif ago a committee had been appointed by the City of Oroville to study and pinpoint the needs of the people of this community. The City of Oroville has been enbarked on a code enforcement project; sub-staridarcl buildings are being ordered to be demolished. He called attention to the fact that within the City, the people themselves install curbs, gutters, and other improvements. Mr. Winston objected to the application as he feels it does not fill the community needs. Community pride should be instilled within the people of the area. Supervisor Richter responded to Mr. Winston's statements. The area was selected as it is the worse In the County. It is a target area where the funds wuld be spent. He stated that most of the property owners do not have the funds to make the improvements; it is an area of intense poverty. Time spentdiscussing the program and views of the Boarcl members and Mr. Winston. Action to be taken discussed. Hearing closed to the public and confined to the Board. It was suggested that Administrative Officer be designated as the coordinator of the program and that a wntract 6e entered into with Mr. Connerly to do all the leg work to get the program started so that HUD could see that the County is moving on this. Time spent discussing how the X76,080 would be spent. X30,000 would be used for the rehabilitation of existing structures. 515,000 for the demolishing of other structures; cleaning up lots, eta. X26,000 ~oageh~~nstallation of public works-curbs, gutters; r February 3, 1976 ~,,, ~ ,,...~ $5,000 for planning. The $5,000 will be for the contrac# with Mr. Connerly; plus 10°lo for administration. Mr. Conner[y has the expertise to handle this matter. Mr. Nickelson said they would like to know the Board's intent today on haw to handle this program. Supervisor Ladd said be wavld like to know more about what would be done with the $12,100 that would be paid to Mr. Connerly. Mr. Nickelson explained the work that would be wvered by the contract with Mr. Connerly. Scott Tandy said that the first thing that would be done is that Mr. Connerly will have to prepare a program for the rehabilitation of the area. All the paperwork and administrative work will be handfed by Mr. Connerly. He said he would like to inquire and determine if Public Works Director would have his staff do some of the planning work for the curbs and gutters. Mr. Connerly will set up an ofi'ice in the south Oroville area and work out of it. On motion of Supervisor McKillop, seconded by Supervisor Richter and unanimously carried, the BoarrJ approved the re-direction of the grant of $76,000 b be used in the south Oroville area. 1t was moved by Supervisor Madigan, seconded by Supervisor McKillop and unanimously carried that it is the intent of this Board to contract with AAr. Connerly for $12,100 for the re-direction of the 1976 grant; that the contract will 6e brought back to the Board For approval, and Public Works will be asked to determine if they can do the engineering work for planning the curbs and gutters. 7b-Ibl DISCUSSION: ECONOMIC Di:.i/ELOPMENT DIRECTOR BE REDUCED TO PART TIME: APPROVE THAT !T BE FULL TIME INTO THE 1976-77 YEAR Berra is ter, Orovi e, was present at t is time to discuss the matter of why the Economic Development Director should be reduced to part time. The members of the Development Commission met last night aril they voted unanimously to have Mr. Nicholson kept on full time as director. Fle has served on this Commission for 12 years. Accomplishments of Mr. Nicholson as director set out. Mr. Richter read a prepared report an projects that Mr. Nicholson has handled and Fnalized. The grants that they have received have exceeded the cost of the operation of this department. Supervisor Mc[Cillop agreed that this is a very competitive matter and other counties and cities will receive the industries iF this County does not compete to bring them to Butte County. Vemon Fish, Chico, spoke an the request to keep Mr. Nicholson as a full time director. He stated that the Development Commission has been well pleased with Mr. Ni dwlson. Time spent by Board members setting out the it views on the work of the Development Commission. Mr. Nickelson, Administrative Officer, explained why this matter had been placed on today's agenda. He would like instruction from the Board as to how the budget for this department should be set up. Differences could be worked out now or a building committee meeting rauld be set. The Building Committee could determine ways to go in this matter. Time spent discussing the contract and the modifications suggested. Form of agreement set out and discussed. Terrnination of contract clause and the allegation of weight to certain phases of the work explained. Mr. Blackstock stated they were attempting to put together a standard agreement that can be used in the future. Additional fees and how they will be handled should be set out in the agreemenf. Problems drithin the agreement should be discussed and worked out before fhe agreement is ,approved. Chairman Cameron suggested #hat fhe agreement go back to the building committee to meat with the architects and them bring something back to the Board to be considered. I T e c os eating on t e Sacramento venue ssment D strict No. was held to discuss the resolution setting out the boundaries of the district. Mr. McCain explained the matter of the boundaries. It had been requested that Stewart Avenue be deleted from the district. He would like to recommend that the exact boundaries be modified at a later date. Proceed with the boundary map that exists now and then could come back to the Board with a revised boundary map at a later date when all facts are known. Mr. Blackstock agn:ed that that would be the best way to go. If the boundaries are changed at this time, the County would run into additional hearings. The Board could advise the public that they are doing this, but that there wilt be a new hearing when boundaries are fo be considered. qt the time the hearing regarding boundaries is held, there will be a complete new notification procedure. Clay Castleberry said he wncurs with this but also shares concern; it would be in order, maybe, to re-state that it is the intention of the Board that Stewart Avenue will be deleted from the pro(ect. On motion of Supervisor Richter, seconded by Supervisor Madigan and unanimously carried, Resolution 7b-18 detenninit~q that the public convenience and necessity require improvements and acquisitions to be made and paid for by special assessments was adopted and the Chairman authorized•to sign. Wayne Co eman, owner o a mo a me pa in Par ise, representing himself and the mobile home. park owners association, stated he is a party in interest to an action that the Board took in Executive session relating to the authorization grant to AI Anderson, County Auditor, to engage an attorney to bring suit against the Assessment Appeals Board. The Assessment Appeals Board had upheld their application'before the Board. Mr. Coleman felt the Assessment Appeals Board should have had the opportunity to express their views to the Board in the executive session. It seemed wrong to Mr. Coleman that he was not given an opportunity to appear at the executive session. He felt that in fain~ss~ to the people, the Boarci should direct the Assessor to have attorney consult with the attorney for the mobilehome park owners before additional taxpayers money is expended in a iaw suit. Mr. Blackstock stated that Phil Mace, attorney for the mobilehome pork owners, knows Mr. Marsh Maier, attorney for Assessor, and he could call him and discuss the matter with Mr. Maier. Mr. Bfackstock will report back in the Board regarding this matter. Mr. Jim Starr, owner of Roeky Lane Mobilehome Park, said he would be affected by this suit, also. He stated that Mr. King, chairman of the Assessment Appeals Board, had refused to allow the owners to present income tax approach during the hearings. He hoped that the Board would take a closer look of this problem. Mr. Harper L. Stewart, operator of the Villa Mobilehome Park, Paradise, set out the contents of a Fetter that he is sending to the Governor and to the State Board of Equalization. He also asked why he wasn't offered the opportunity to be present at the executive session held by this Board. He feels it is his tax dollars that are being spent fnr the Assessor's attorney. Mr. O'Conner, EI Dorado Mobilehome Park, Paradise, set out his opposition to the action taken by the Board in authorizing the Assessor to retain an attorney to bring action against the Assessment Appeals Board. Matter discussed; no action taken. 76-165 COUNTY COUNSEL AND CLAY CASTLEBERRY TO WORK OUT. MATTER OF ENCROACHMi:NT~PERMCI' TO ALLOW ALAMO CHARLIE PRODUCTIONS TO USE COUNTY ROADS IN THE PRODUCING OF A PICTURE Ernie Pa . manager o Orovi a Cham r of Comnerce, requested thaF the Board allow a motion picture to be made in Butte County and allow the company to use the County roads'for their activities. They have adequate insurance to cover any loss that the County might incur. The pic:t+ue.eompany involved is the Alamo Charlie Productions. County Counsel stated that the oompany would have to provide the County with an insurance policy. Mr. Castleberry stated that if is the Boand's desire, he could issue an page 84. On motion of Supervisor Ladd, seconded by Supervisor McKillop and unanimously carried, County Counsel and Mr. Castleberry was instructed to work out the matter of the issuance of an encroachment permit to the Alamo Charlie Productions. 76-Ibb DISCUSSION: FLOOD INSURANCE PROGRAM George amm was present to iscuss t e flood insurance program. Fie stated that the representative of the State Department of Water Resources was unable to appear today. He stated that a meeting could be scheduled for February 24, 1976 to have a representative present. Maps discussed. It was stated #hat the revised maps may not be ready until the end of the year. Mr. Nickelson stated that Federal assistance on loans moil( not 6e available in flood hazard areas. The only people that need insurance are those within the flood hazard areas. Mr. Castleberry is concerned as he has fo certify whether or not the property is within the designated flood areas. Maps discussed. The original maps sent to the county were wrong and have been returned ro be corrected. They did not have the rivers set out an the maps. George Stamm set out the altematiycs~that could be followed. I) The County could do nothing until the revised maps appear; they will show the areas that are subject to flooding. 2) County could do nothing until approached by a property owner in the area that is in the flood area. Could get into the program at that time using the erroneous maps, that would be subject to revision. 3) Could get into the program now, using the erroneous maps. Chairman Cameron said he vrould like to see a report go back to Washington telling them what a horrible job this map making company has done an our maps. This complaint mould be done through our Congressman and other representatives in Washington. Supervisor Ladd asked about the person that is not in the designated flood area; he would request a loan and a loan will nofi be approved until the County certifies that they are not in the designated flood area. Mr. Stamm explained what would happen then and how this could be handled. Matter discussed; no action taken. 76-167 DISCUSSION: REQUEST FOR ADDITIONAL STAFFING IN THE DISTRICT ATTORNEY'S OFFICE; REQUEST APPROVED FOR TEMPORARY PERIOD OF TIME Ken Leach, District Attorney, appeared to discuss the additional staffing requested for the District Attorney's affice. Fie sd d they would like to defer action on the copier that had been requested. Mr. !,each request discussed. He reported on the collections made during January. The pistrict Attorney's Office has been advised by the State Department of Benefit Payments that a penalty for non-performance would be taken from the bonus paym nts. ePage 90. Mr. Leach stated that this County is doing the things that are listed. They are trying to get into confonnanee by July I, 147b. Mr. Leach explained duties that would be performed by the additional personnel being requested. The investigator would be put on the 1,000 paternity cases that they have not handled to date. Mr. Nickelson explained the figures set out in the memo. He fel# that it is obvious that noone bas been able to develop guidelines fear staffing. It is not even agreed upon what a case load really is. He explained the staffing request. It was stated that after crash program, the staff could be reduced. It was suggested that the request could be approved for the time through June 30,147b . February 3, 1976 ~. ~ FebruarL+ 3,~ 1976 Mr. Richard A. French, Jr., 134AA Nimshew Stage, stated they were requesting an interim zoning= the property owners have agreed on a TM-5 zoning. They are only requesting this interim zoning so they can get started on the permanent zoning. Board members question Mr. French concerning the Water Quality Control Board. Mr. Lawson stated that Water Quality Board had received a copy of the zoning proposal and they have written back that they have no comments. Jahn Luvass, attorney at law-Chico, stated he hCisbeen retained by the Butte Creek Property Owners Association, comprised of about i00 property owners. They desire to protect their life style and to protect what water there is in the area. All they are requesting is fihat the status quo be retained at the present time. If the area is left as an A-2 zone, there may be many that will develop their properties. Chairman Cameron said as representative of the area he feels that this zoning should be approved under the Planning Commission so that a committee could be appointed to gat with the people in the area. This should not be a wide-open halter-skelter type zoning. He feels that at this time should go with the desires of the properly owner for the interim zoning. It was suggested that Baldwin Rock property be left out of the zoning. Charles Hile, Nimshew Stage, felt that Baldwin Rock should not receive special consideration. It seems as though Mr. Crisan, Welfare Director, had indicated that the County would have a surplus of money in one of the programs. It was relinqufs;ir~f-back to be used in other counties that were short. Now it seems that the County is about $25,OOD short on this service area.
