Acquisition of right of way - Chica Durham Bike Path from Jones Avenue to Hegan Lane, County contract no. 26311-92-1, State contract no. 88-2- 04003 - a settlement agreement has been reached for acquisition of the last remaining parcel necessary for the completed Chico-Durham bicycle path, resolving all remaining issues of the condemnation action that was filed. Insured title to the parcel could not be obtained. The State of California Department of Parks and Recreation, which provided grant funding far the project is requiring that the County guarantee the integrity of the bicycle path by adoption of a resolution assuring appropriate steps will be taken, if necessary, to secure adequate title to the parcel and that a letter be submitted discussing title exceptions: PARCEL NOS , 41dNEB ~BE& 3 Henneman Farms, Inc. 0.775 $5,450. Contract change order no. 1 - Jail kitchen remodel project - CCO No. 1, in the increasing amount of $5,416, provides for replacing a portion of deteriorated sewer ling, replacing an existing fan motor and drive, and sacking the exposed concrete walls to provide smooth surface to accommodate Health Department standards - action requested - APPROVE CCO NO. 1 AND AUTHORIZE THE GENERAL SERVICES DIRECTOR TO SIGN. 15. Contract change order nos. 2 and 3 - Jail kitchen remodel project - CCO Nos. 2 and 3, in the increasing amount of $108,474, provide for furnishing galvanized structural steel member and plates for the exercise yard security screen ($42,504) and installation of the steel, galvanized security woven wire mesh and concrete work ($65,979), Funding is provided by Jail Bond Act funds, local match, and project contingency - action requested - APPROVE CONTRACT CHANGE ORDER NOS. 2 AND 3 AND AUTHORIZE THE GENERAL SERVICES DIRECTOR TO SIGN. 16. Contract change order no. 2 - Gridley Fire Station remodel - CCO No. 2 in the increasing amount of $1,030 provides for the substitution of concrete in lieu of asphalt and relocation of a gas line. Award of bid no. 44-95 - reroofing of Durham Memorial Hall - bids have been opened for the reroofing of the Durham Memorial Hall. The single bid of Butte Roofing Company of Chico in the amount of $15,886 is recommended far award - action requested - AWARD BID. 18. Administrative Office - the addition of a person/workstation in Personnel that was approved in the 1994-95 budget was not anticipated at the time of the Administration/Personnel/Purchasing Local Area Network system design. Board authorization is requested to upgrade one existing workstation ($215), and acquisition of a computer to provide for an additional workstation {estimated at $2,300/DEPARTMENT BUDGET) - action requested - APPROVE BUDGET TRANSFER B-135 AND PURCHASE OF FIXED ASSET ITEMS. Buildings and Grounds - purchase of used tractor - a used Ford tractor with front-end loader and backhoe attachments has been offered for sale to Butte County by Alameda County for the sum of $400 (DEPARTMENT BUDGET). Savings are available within the ISF fixed asset - contribution to other agencies budget - action requested - APPROVE PURCHASE OF FIXED ASSET ITEM. 20. District Attorney - Board authorization is requested to install a dedicated telephone line and related equipment for operation of California Law Enforcement Telecommunications System {CLETS) at the Family Support Division's new location at 1474 Myers Street, Oroville. The total cost of the telephone line and required connective equipment is $3,400 {66~ State/Federal and 34~/County) - action requested - APPROVE BUDGET TRANSFER 8-126 AND INSTALLATION OF TELEPHONE LINE AND RELATED EQUIPMENT AS REQUESTED. 21. Mental Health and Alcohol and Drug Services - Board authorization is requested to purchase one personal computer in the maximum amount of $2,500 (541.001 Substance Abuse - Other budget unit) far the manager of Substance Abuse Programs to aide in managing the program, grant processing, and enhancement of tracking funding for the division, and one lap top computer, computer workstation, laser jet printer, ink jet color printer, and three copy machines in the total amount of $10,053 (541.004 Mental Health-Substance Abuse (Youth] budget unit) for use in the Youth Services Community Counseling Centers to better distribute the workload and enhance the efficiency of operating the program - action requested - APPROVE PURCHASE OF FIXED ASSET ITEMS. 22. Probation Department - Title IV-A, Emergency Assistance Program - Board authorization is requested to purchase three personal computers with peripheral equipment at $1,b50 each, one industrial postscript laser printer at $2,000 and Novel software/LAN cards (5 user) at $1,000 with Federal funds approved for the Emergency Assistance Program and approved by the Board on December 13 , 1994 - action requested - APPROVE PURCHASE OF FIXED ASSET ITEMS. Page 37 February 14, 1995 95-32 23. Public Health Department - a 19$5 truck utilized by the Rabies Control Program has broken down and is no longer operable. A pick-up truck has been reassigned to the Rabies Control Program, and in order to properly transport animals, an insulated camper shell is needed (estimated cost of $1,200) (COUNTY/FEES) - action requested - APPROVE BUDGET TRANSFER B-130 AND ACQUISITION OF FIXED ASSET ITEM. 24. Treasurer-Tax Collector - Board authorization is requested to purchase a replacement microfilm camera in the amount of $6,950. The microfilmer is needed to prxess daily bank deposits - action requested - APPROVE BUDGET TRANSFER B-127 AND AUTHORIZE PURCHASE OF FIXED ASSET EQUIPMENT. 25. Welfare Department - Cal-Learn Program - in order to provide counties with the resources necessary to implement this program, the State is providing a one-time, 100$ State/Federal funded allocation for "start-up" costs. Board authorization is requested to purchase five personal computers, two printers and software in the maximum amount of $14,000 and ergonomic office furniture in the maximum amount of $15,597 - action requested - APPROVE BUDGET TRANSFER B-124 APPROPRIATING $24,597 FROM UNANTICIPATED REVENUE AND AUTHORIZE PURCHASE OF FIXED ASSET ITEMS. 26. Investments information reports - the Treasurer-Tax Collector submits the December 30, 1994 and January 31, 1995 reports in accordance with the County's Statement of Investment Policy dated June 1, 1994 - action requested - ACCEPT FOR INFORMATION. 27. County Library - requests Board acceptance of $6,000 in unanticipated revenue from the Chico Friends of the Library for continuation of additional public service staff hours at Chico Branch circulation desk - action requested - ACCEPT REVENUE. 28. Mental Health and Alcohol and Drug Services Division - the Departsent is requesting a revision to the adopted budget in order to reconcile actual current Federal and State income and expenses by budget units (541.002 Substance Abuse-Other and 541.004 Substance Abuse-Youth) as well as by line items - action requested - APPROVE BUDGET TRANSFER B-134 ACCEPTING AND ALLOCATING UNANTICIPATED REVENUE OF $933,150 AND PROPOSED BUDGET REVISION/TRANSFERS. Adoption of a salary ordinance amendment - Department of social welfare/Interim Statewide Autovaated Welfare System (ISAWS) - 1} eliminate the one remaining position of Principal Clerk which has been scheduled for elimination during the ISAWS implementation (the incumbent will be voluntarily placed in a vacant Office Assistant III/II/I position), and 2) reallocate an additional position of Welfare support Services Supervisor (from salary savings of the eliminated Principal Clerk position) - action requested - ADOPT ORDINANCE 3177 AND AUTHORIZE THE CHAIR TO SIGN. (FROM 1-24-95) 30. Adoption of a salary ordinance amendment creating the position of Court Executive Officer of the Butte County Superior and Municipal Courts pursuant to Government Code Section 68114.6 (this is an at- will employee to be appointed by the courts). The salary range assignment is $fi0,000-$72,000 annually (reduced by 5~ in koeping with other County employees), allowing the courts the discretion and flexibility to appoint the incumbent at any point within this salary range commensurate with experience, and the discretion to change the salary within this range at any time within the term of the contract. The salary ordinance further adds a new section and budget unit of Butte County Superior and Municipal Courts including one allocated position of Court Executive Officer - action requested - ADOPT ORDINANCE 3178 AND AUTHORIZE THE CHAIR TO SIGN. Introduction of a salary ordinance amendment - Probation Department - proposed is a salary ordinance amendment adding four allocated positions (one Probation Officer II, I, two Legal Typist Clerk or Legal Secretary I and one Legal Typist Clerk or Office Assistant II, I) as part of the Title IV-A, Emergency Assistance Program (federally funded reimbursement program) approved by the Board on December 13, 1994 - action requested - WAIVE READING OF THE ORDINANCE. 32. Introduction of a salary ordinance amendment - Welfare Department - flexibly staffing three Social Worker positions in the newly created SSI Outreach Program to be consistent with all other Services positions. These positions are 100 State funded - action requested - WAIVE READING OF THE ORDINANCE. Page 39 February 14, 1995 95-32 33. Introduction of an ordinance establishing speed limit on Floral Avenue, Chico area - the City of Chico has requested that a speed limit of 30 miles per hour (m.p.h.) be established on the remaining portion of Floral Avenue in County jurisdiction (approximate 0.1 Wile), to be consistent with the existing adjacent city speed limit. Public works has completed a traffic study of the subject roadway and concur with the request, recommending that a speed limit of 30 m.p.h. be established - action requested - WAIVE READING OF THE ORDINANCE. 34. Resolution proclai~inq February, 1995 ae American History Month in Butte County - action requested - ADOPT RESOLUTION 95-25 AND AUTHORIZE THE CHAIR TO SIGN. 35. Resolution proclaiping March, 1995 as Butte County Groundwater Awareness Month - action requested - ADOPT RESOLUTION 95-27 AND AUTHORIZE THE CHAIR TO SIGN. 36. Program Supplement No. 074 to Local Agency - State agreement no. 03-5912 - reimbursement of funds for qualified projects under Local Agency-State Agreement for Federal-Aid Projects No. 03-5912 requires execution of a Prograa Supplement to the Master Agreement. Program Supplement No. 074 covers funding for reimbursement of engineering and construction costa for the proposed project to place roadway illumination (pavement markers) at various locations throughout the County (Federal Funds/$270,000; Local Matching/$30,000; Total/$300,000) - action requested - APPROVE PROGRAM SUPPLEMENT NO. 074, ADOPT RESOLUTION 95-28 AND AUTHORIZE CHAIR TO SIGN. 37. Assignment of counsel - County Counsel proposes the assignment of McCloud v. County of Butte to the law firm of Marsh, Marsh and Volpe - action requested - APPROVE ASSIGNMENT OF COUNSEL. 38. Chief Probation Officer - pursuant to statute (Welfare and Institutions Cade Section 270) the County's Chief Probation Officer is appointed by the Juvenile Court Judge, upon nomination by the Juvenile Justice Commission. Helen Harberts has been so appointed for a four year contract term commencing February 21, 1995 (annual salary at the rate of $55,847}. While the Superior Court is the statutory appointing authority, the legal employer is the County - action requested - THE COUNTY'S FORMAL ACCEPTANCE OF THE EMPLOYMENT AGREEMENT FOR HELEN HARBERTS AS CHIEF PROBATION OFFICER. First modification to the Memorandum of Understanding (MOU} providing for formation and operation of the Butte Basin water Users Association - the modification of the MOU (approved by the Working Committee of the Butte Basin Water Users Association on December 14, 1994) provides for addition of the Del Oro Water Company to the Butte Basin Water Users Association and sets forth the voting and financial contributions of each of the fifteen participants (this modification does not impact Butte County's funding obligation or the weight of its vote) - action requested - APPROVE FIRST MODIFICATION OF THE MOU OF THE BUTTE BASIN WATER USERS ASSOCIATION AND AUTHORIZE THE CHAIR TO SIGN. 40. Revorted Jail Bond Act agreement - an agreement has been prepared with the State Board of Corrections for reverted jail bond act funds in the amount of $405,000 (State/$303,750 and Local/$101,250) for remodeling of the jail kitchen and construction of a security screen over the recreation yards at the new jail - action requested - ADOPT RESOLUTION 95- 29 APPROVING THE AGREEMENT AND AUTHORIZE CHAIR TO SIGN. 41. Testing services agreement - new court building - an agreement has been prepared with Applied Testing Consultants of Chico covering special testing services to be performed during construction of the new court building. The amount of the agreement is in the estimated amount of $22,000 - action requested - APPROVE AGREEMENT AND AUTHORIZE CHAIR TO SIGN. 42. Grant application - State Off-Highway vehicle Funding - the grant application has been prepared in the amount of $17,000 for fiscal year 1995-96 and provides for the removal of snow from the five miles of Humboldt Road in Butte Meadows from the "Green Gate" (Pasiute Campground) to 1/2 mile above Colby Creek Bridge, where the Jonesville Staging Area is located - action requested - ADOPT RESOLUTION 95-30 APPROVING THE GRANT APPLICATION AND AUTHORIZING THE CHIEF AD~+fINISTRATIVE OFFICER TO SIGN THE AGREEMENT AND SUBSEQUENT APPLICATIONS AND AGREEMENTS WITH THE STATE. State Department of Alcohol and Drug Programs (ADP) Drug/Hedi-Cal contract - ADP, by authority of an interagency agreement with the Department of Health and Human Services, has accepted the County Mental Health, Alcohol and Drug Services' Hedi-Cal proposal for fiscal year 1994-95 (anticipated revenue $624,442). The proposal is to capture Federal Druq/Hedi-Cal dollars for services provided by the County's two certified Drug/Hedi-Cal providers - Butte County Mental Health, Alcohol and Drug Services and the County's contracted perinatal service provider, Enloe Hospital "Touchstone" - action requested - APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. 44. Butte County Office of Education (BCOE) - the Welfare Department and the BCOE are requesting changes to Exhibit "A" of the Schools Collaboration Contract to provide an improved description of the services to be provided and identification of the agency providing the services. There are no changes in the cost of services or appropriations - action requested - APPROVE AMENDMENT NO. 2 TO CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. 45.
